53. Federal Act amending the Family Law Balancing Act 1967
The National Council has decided:
The Family Law Balancing Act 1967, BGBl. No. 376, as last amended by the Federal Law BGBl. I n ° 40/2014, shall be amended as follows:
(1) In § 8, the following paragraph 6 is inserted after paragraph 6:
" (6a) For a person who has a permanent disability in accordance with § 2 para. 1 lit. (c) there is no entitlement to the increased family allowance if, in a calendar year, it relates to an income which exceeds the limit laid down in Article 5 (1). If the income in a subsequent calendar year is less than the limit laid down in § 5 para. 1, the entitlement to the increased family allowance lives up again. If the incapacity to work is in accordance with § 2 para. 1 lit. c has been established as a permanent state, no further expert opinion is required. "
2. In accordance with § 55 (28), the following paragraph 29 is added:
" (29) § 8 para. 6a in the version of the Federal Law BGBl. I No 53/2014 shall enter into force with the date of the publication of this Federal Law. "
