200. Regulation of the Federal Minister for Transport, Innovation and Technology, amending the Air Operator's Certificate of Air Operator Regulation (EC) 2008
On the basis of § 131 of the Aviation Act, BGBl. N ° 253/1957, as last amended by the Federal Law BGBl. I n ° 108/2013, shall be arranged:
The Air Operator Certificate-Regulation 2008, BGBl. II No 254, as last amended by the BGBl Regulation. II No 78/2013, shall be amended as follows:
1. In the title, after the word "concerning" the phrase "provisions relating to flight operations and" inserted as well as in the parenthesis the word "Air Operator Certificate-" through the phrase "Air operator certificate and flight operations-" replaced.
2. Following the pro-mulgation clause, the following breakdown and heading shall be inserted:

Scope
§ 20b. In this section, certain air traffic control arrangements for the aircraft in question are laid down, to the extent that they are not used within the scope of air carriers (§ 101 Z 1 Aviation Act).
EU legislation
§ 20c. (1) Insofar as provisions relating to non-commercial air transport operations involving aircraft, helicopters, balloons and gliders (NCO) and technically complicated motor-driven aircraft (NCC), as well as the implementation of flight training courses, in the framework of training facilities in Regulation (EU) No 965/2012, as amended by Regulation (EU) No 800/2013 amending Regulation (EU) No 965/2012 laying down technical requirements and administrative procedures relating to the Operations carried out pursuant to Regulation (EC) No 216/2008 of the European Parliament and the Council, OJ C 327, 28. No. OJ L 227 of 24.08.2013 S.1, these are to be applied as from 25 August 2016, unless otherwise specified in paragraph 2.
(2) In accordance with Article 10 (3) of Regulation (EU) No 965/2012, as amended by Regulation (EU) No 800/2013, the following shall be determined:

Declarations on the ability and means to fulfil the responsibilities relating to the operation of aircraft pursuant to Article 5 (3) of Regulation (EU) No 965/2012, as amended by Regulation (EU) No 800/2013, and applications for Special authorisations granted in accordance with Annex V (sub-SPA) and applications for authorisation in accordance with Annex VI (sub-NCC) of Regulation (EU) No 965/2012, as amended by Regulation (EU) No 800/2013, shall be from 25 December 2015 to 25 February 2015. 2016 at Austro Control GmbH. | in Regulation (EU) No 965/2012 as amended by Regulation (EU) No 379/2014 amending Regulation (EU) No 965/2012 laying down technical requirements and administrative procedures with regard to air operations, as provided for in Regulation (EC) No No 216/2008 of the European Parliament and of the Council, OJ L 145, 31.5.2008 No. OJ L 123 of 24.04.2014 S.1, these are to be applied as from 21 April 2017, unless otherwise specified in paragraph 2. |

(2) In accordance with Article 10 (4) and (5) of Regulation (EU) No 965/2012, as amended by Regulation (EU) No 379/2014, the following shall be established:

October 2016 at Austro Control GmbH. The Austro Control GmbH has received such statements from the time it has been received. Applications all with the specialised flight operations or commercial air transport operations involving aircraft of flight performance class B or non-technically complicated helicopters starting and ending on the same aerodrome/place of use, or provisions related to balloons and gliders; Regulation (EU) No 965/2012, as amended by Regulation (EU) No 379/2014; |
