201. Regulation of the Federal Minister for Agriculture, Forestry, Environment and Water Management, amending the Regulation on the limitation of waste water emissions from the purification of exhaust air and aqueous condensates

On the basis of § § 33b (3), (4), (5) and (7) and 33c (1) of the Water Rights Act 1959-WRG 1959, BGBl. N ° 215/1959, as last amended by the Federal Law BGBl. I n ° 98/2013, shall be assigned in agreement with the Federal Minister for Science, Research and the Economy:

The regulation of the Federal Minister for Agriculture, Forestry, Environment and Water Management on the limitation of waste water emissions from the purification of exhaust air and aqueous condensates (AEV exhaust air purification), BGBl. II No 218/2000, as amended by the BGBl Regulation. II No 62/2005, shall be amended as follows:

1. In § 1 para. 1 Z 6 the word "AAEV" through the phrase " General Waste Water Emissions Ordinance (AAEV), BGBl. No. 186/1996 " replaced.

2. § 1 (1) Z 7 reads:

" 7.

Fuel heat output: the average amount of heat supplied to a plant by means of the hourly average amount of heat related to the lower calorific value, the amount of heat to be achieved in continuous operation (nominal load) in order to achieve the installation performance. is required. In the case of unfired waste-heat shackles, the fuel heat output is obtained analogously from the average heat quantity supplied with the hot exhaust gases. The fuel heat output is set out in Directive 2010 /75/EU on industrial emissions (integrated pollution prevention and control), OJ L 327, 22.7.2010, p. 3. In Section 1, Section 5, Z 4, the phrase "according to § 33a WRG" through the phrase " according to § 33b (2) and (11) of the Water Rights Act 1959 (WRG), BGBl. No. 215/1959, in the version of the Federal Law BGBl. I No 98/2013, " replaced.

4. § 2 reads:

" § 2. The parameters of Appendix A mentioned below cover hazardous waste water constituents according to § 33b (2) and (11) WRG 1959: Toxicity, antimony, arsenic, lead, cadmium, chromium-total, cobalt, copper, nickel, mercury, zinc, tin, ammonium, Cyanide readily releasable, nitrite, sulphide, adsorbable org. . Halogens (AOX), sum of hydrocarbons, blow-out org. . Halogens (POX), phenol index and the sum of the volatile aromat. Hydrocarbons benzene, toluene, xylenes and ethylbenzene (BTXE). "

5. § 4 (2) to (4) reads:

" (2) The following shall apply to self-monitoring:

1.

Unless otherwise provided for in Z 2 to 4, an emission limit for a waste water parameter of Appendix A shall be deemed to be complied with if, for five consecutive measurements, four measured values are no greater than those of the Emission limitation and only a measured value does not exceed the emission limit by more than 50% ("4 of 5" rule).

2.

At the temperature parameter, the "4 out of 5" rule is to be applied to the samples one day; the highest measured value must not exceed the 1,2-fold of the emission limit.

3.

In the case of the pH parameter, the "4 out of 5" rule should be applied to the samples one day; the emission range must be exceeded or fallen below 0.3 pH units not more than a maximum of 0.3.

4.

In the case of continuous measurement of the temperature or pH parameters, the "4 of 5" rule is to be replaced by the 80% reduction over the water run-off time of one day.

(3) The following shall apply to external surveillance:

1.

If no other arrangements are made in Z 2, the measurement shall be repeated if, for up to four times a year, a measurement of a waste water parameter of Appendix A is determined between the The emission limit and its 1,5-Fachem are located. If, during the repeated measurement, the measured value is not greater than the emission limit, it shall be deemed to have been complied with. In the case of more frequent monitoring in the year, the "4 of 5" rule shall apply in accordance with paragraph 2.

2.

For the parameters temperature and pH value, paragraph 2 applies.

(4) In the case of an introduction of aqueous condensate from a combustion plant with the recovery of residual heat from the combustion gas (combustion-value firing system or condensing boiler according to § 1 para. 2 Z 3) into a public sewerage system, the Emission limits for the parameters of Annex A, column II, in the context of self-monitoring and in the context of external monitoring, also as being complied with if:

1.

the incineration plant has a fuel heat output of not more than 400 kilowatts,

2.

the incineration plant exclusively with

a)

Natural gas according to ÖNORM EN 437 "Test gases-test pressure-equipment categories" of 1 July 2009 or liquefied gases in gaseous state according to ÖNORM C 1301 " Liquid gases for combustion purposes-propane, propene, butane, butene and their mixtures-requirements and Verification procedure " of 1 May 2001, or

b)

Heating oil extra easily sulphur-free (HEL sulphur-free with a sulphur content of no more than 10 milligrams per kilogram) in accordance with ÖNORM C 1109 "Liquid fuels-heating oil extra light-gas oil for heating purposes-requirements" of 1 May 2011, or heating oil Extra easy to use with biogenic components according to ONR 31115 "Liquid fuels-heating oil extra easily with biogenic components-minimum requirements" of 1 September 2009 or with fatty acid methyl ester in accordance with ÖNORM EN 14214 " Fuels for motor vehicles- Fatty acid methyl ester (FAME) for diesel engines-requirements and test methods " of 1 November 2011, or

c)

Pellets made from harvested fresh wood and chemically untreated wood residues from the property class A1 according to ÖNORM EN 14961-2 "Solid biofuels-Fuel specifications and classes, Part 2: Wood pellets for non-industrial use" of 15 July 2011 or

d)

Wood chips from harvested fresh wood and chemically untreated wood residues from the property class A1 according to ÖNORM EN 14961-4 "Solid biofuels-Fuel specifications and classes, Part 4: wood chips for non-industrial use" of 15 July 2011, or

e)

Lumber of property class A1 according to ÖNORM EN 14961-5 "Solid biofuels-Fuel specifications and classes, Part 5: Non-industrial timber" of 15 April 2011, or wooden briquettes made from harvested fresh wood and chemically Untreated wood residues in property class A1 according to ÖNORM EN 14961-3 "Solid biofuels-Fuel specifications and classes, Part 3: Wood briquettes for non-industrial use" of 1 August 2011

will be fired,

3.

for the incineration plant, proof of an individual examination or a type-examination in accordance with Article 5 (2) of the Agreement between the Federal Government and the Länder in accordance with Art. 15a B-VG on energy saving, BGBl. No 388/1995,

4.

for the fuel combustion plant, tested in accordance with Z 3, or the type-tested type and size of the building series which belongs to the combustion plant, by a qualified person or specialist institution to comply with the emission limits for the parameters Lead, cadmium, chromium-total, copper, nickel, zinc, and tin according to Annex A, column II in the resulting aqueous condensate has been demonstrated under the following conditions:

a)

Installation, operation and maintenance of the incineration plant demonstrably in accordance with the manufacturer ' s information on the basis of the individual test or type test in accordance with Z 3,

b)

Loading of the incineration plant with maximum fuel heat output,

c)

The temperature of the condensate to be tested is greater than 30 °C,

d)

in the case of automatic combustion plants (natural gas/liquefied petroleum gas, heating oil, wood pellets, wood chips):

Sampling at the earliest two hours after the start of the test, sampling as sampling, with at least two samples to be drawn over the test period,

e)

in the case of manually charged combustion plants (piecember/wooden briquettes):

Quantity proportional mixing sample with sampling over the whole test or part sample of the whole homogenised condensate of the test (the test comprises two periods of combustion),

f)

Application of the analytical methods according to § 7 para. 4 AAEV to the unfiltered original sample (determination of the total contents),

g)

no measured value for one of the parameters mentioned above is greater than the associated emission limit according to Annex A, column II,

5.

The combustion gas ducts, the heat exchanger and the condensate discharge pipe are made of corrosion-resistant material,

6.

The installation, operation and maintenance of the incineration plant shall be verifiably carried out in accordance with the manufacturer ' s information on the basis of the individual test or type test in accordance with Z 3, and the installation shall be carried out at least every two years in accordance with the National legislation on the periodic inspection of incinerators is examined and

7.

the results of the verifications to be carried out in accordance with Z 6 are documented and kept ready for inspection by the Authority at the time of the inspection. "

6. In § 4 (5), the first sentence of the parenthesis shall be deleted. " (No 29 of Annex A) " and, in the second sentence, the phrase " No 29 of Appendix A " through the phrase "Sum of hydrocarbons" replaced.

7. According to § 5 (3) the following is added:

" (4) § 1 para. 1 Z 6 and Z 7, § 1 para. 5 Z 4, § 2, § 4 para. 2 to 4, para. 5 and the annexes A and B in the version of the Ordination BGBl. II No. 201/2014 shall enter into force with the day following the customer's presentation.

a)

An introduction pursuant to Section 1 (2) shall not cause any impairment of the biological degradation processes in a public sewage treatment plant.

b)

The parameter G F in the context of external surveillance pursuant to § 4 (3), if there is reasonable suspicion or concrete indication of the effect of the flow-water-damaging effect of an introduction pursuant to § 1 (2), but not in the context of self-monitoring pursuant to § 4 (2).

c)

The definition of the parameter to be filtered shall not be subject to the definition of the parameters which can be set down.

d)

In the case of biological waste water purification, the emission limit shall be maintained only at a temperature of the biological stage of the waste water purification plant of greater than 12 ° C. The waste water temperature is not greater than 12 ° C if, in the case of five uniformly distributed measurements over one day, the waste water temperature is no longer than a measured value of 12 ° C.

e)

Limited by parameter toxicity.

f)

In the case of aqueous condensate from a combustion plant firing exclusively with chemically untreated biomass, a higher emission limit shall be permitted provided that it is ensured that this does not adversely affect the biological degradation processes in the public wastewater treatment plant.

g)

The emission limit is to be determined on a case-by-case basis in the case of corrosion risk for cement-bound materials in the sewage treatment or sewage treatment plant sector (ÖNORM B 2503: 2012 08 01).

Appendix B

Method requirements in accordance with § 4

1.

The parameters toxicity, antimony, arsenic, lead, cadmium, chromium-total, cobalt, copper, nickel, mercury, zinc, tin, ammonium, chloride, fluoride, phosphorus-total, sulfate, total org. . Carbon (TOC), Chemical Oxygen Demand (COD), Biochemical Oxygen Demand (BSB) 5 ), adsorbable org. . Halogens (AOX), the sum of the hydrocarbons and the phenol index of Appendix A are to be determined on the basis of a homogenized daily mixing sample which is not deposited.

The parameters temperature, filterable substances, ph-value, cyanide readily releasable, nitrite, sulfide, sulfite, blow-off org. . Halogens (POX) and the sum of the volatile aromat. Hydrocarbons benzene, toluene, xylenes and ethylbenzene (BTXE) of Appendix A are to be determined on a sample basis. The daily frequency and intervals of the sampling frames shall be determined as a function of the drainage behaviour of the waste water constituents (properties); concentrations and rates shall be determined in proportion to the quantity.

The emission limits of the parameters toxicity, filterable substances, antimony, arsenic, lead, cadmium, chromium-total, cobalt, copper, nickel, mercury, zinc, tin, phosphorus-total, total org. . Carbon (TOC), Chemical Oxygen Demand (COD), Biochemical Oxygen Demand (BSB) 5 ), adsorbable org. . Halogens (AOX), sum of hydrocarbons, blow-out org. . Halogens (POX), phenol index and the sum of the volatile aromat. Hydrocarbons benzene, toluene, xylenes and ethylbenzene (BTXE) of Appendix A relate to total contents.

4.

The emission limits of the parameters antimony and phosphorus total of Appendix A are based on the following or equivalent analytical methods. For an antimony or phosphorus aggregate parameter of Appendix A, an analytical method shall be deemed equivalent if its limit of determination is not greater than the emission limit specified in Annex A to Annex A.
