255. Regulation of the Federal Minister for Agriculture, Forestry, Environment and Water Management on reporting requirements in the livestock and meat, eggs and poultry sectors (Livestock Reporting Regulation 2014)

On the basis of § § 22, 23 and 28 of the Market Order Act 2007 (MOG 2007), BGBl. I n ° 55/2007, as last amended by the Federal Law BGBl. I No 47/2014, shall be arranged:

Scope

§ 1. This Regulation shall be used for

1.

Regulation (EC) No 1249/2008 laying down detailed rules for the application of the Community trade-class schemes for carcases of bovine animals, swine and sheep and establishing the prices thereof, OJ L 327, 31.12.2008, p. No. OJ L 337, 16.12.2008, p. 3,

2.

of Regulation (EU) No 807/2013 laying down detailed rules for the application of Council Regulation (EC) No 1234/2007 as regards the collection of prices for certain bovine animals on representative markets of the European Union, OJ L 327, 31.12.2007, p. No. OJ L 228, 27.08.2013 p. 5,

3.

Regulation (EC) No 315/2002 on the determination of the prices of fresh or chilled ovine carcases on representative Community markets, OJ L 327, 31.12.2002, p. No. OJ L 50, 21.02.2002 p. 47 and

4.

of Regulation (EC) No 546/2003 on the transmission of certain data with regard to the application of Regulations (EEC) No 2771/75, (EEC) No 2777/75 and (EEC) No 2783/75, OJ L 270, 21.8.2003, p. No. OJ L 81 of 28.03.2003 p.12.

Responsibility

§ 2. The market organisation "Agrarmarkt Austria" (AMA) is responsible for the enforcement of this Regulation and of the acts referred to in § 1.

Definitions

§ 3. For the purposes of this Regulation:

1.

Livestock markets: livestock markets, which are regularly loaded with farm animals and in which in the last calendar year on average more than 100 pieces of young or yearling cattle, 100 calves or 500 pieces of piglets were driven up per market day;

2.

Slaughterhouses: slaughterhouses in which in the last calendar year more than 6 000 units of cattle, 2 500 pieces of calves, 50 000 pieces of pigs, 500 000 pieces of broiler, 100 000 pieces of turkey or 2 500 sheep were slaughtered. Slaughterhouses shall also be considered to be holdings which leave animals slaughtered and implement the quantities referred to in the first sentence;

3.

Intermediaries: natural or legal persons or groups of persons who, in the last calendar year, have purchased purchases of more than 2 500 pieces of calves, slaughterhouse, young or yearling cattle, 25 000 pieces of piglets or 2 500 sheep. As intermediaries, producer groups (e.g. bovine animals and swine blocs), which meet the volume turnover referred to in the first sentence, shall also be considered as intermediaries, and shall be considered as intermediaries;

4.

Packing centres: packing centres where more than 5 000 000 eggs have been packed in the last calendar year;

5.

Disguised holdings: establishments in which more than 500 000 pieces of chickens or 100 000 pieces of turkey were dismantled during the last calendar year.

Mandatory

§ 4. Reporting Obligations

1.

in the case of commercial markets, the person responsible for the management of the market; and

2.

in the case of slaughterhouses, brokers, packing centres and cutting plants, the farmer.

Frequency and timing of notifications

§ 5. The notifications according to § § 8 to 12 have to be made weekly and have to be received on Tuesday after the end of the calendar week at the AMA.

Country of origin

§ 6. The quantities and prices are to be shown separately in the cases of § § 8 (1), 9 (1), 11 (1) and 12 (1) and (1) of the country of origin.

Formal requirements

§ 7. (1) The notifications shall be made using the forms laid down by the AMA, which shall be subject to the following conditions of entry:

1.

Name/Company and address of the reporting person,

2.

reporting period,

3.

Quantity data on the individual categories according to § § 8 to 12,

4.

Price indication of the individual categories according to § § 8 to 12,

5.

information on the country of origin, as provided for in § 6, and

6.

Signature.

(2) The AMA may allow notifications without the use of the form, provided that the information referred to in paragraph 1 is included.

(3) The notification may be made in any technically permissible form.

Reporting requirements for bovine animals and beef

§ 8. (1) slaughterhouses and intermediaries shall report quantities and prices for the marketed meat of the following categories:

1.

Halves, in each case after bulging, seeding, oxen, cows, calves and young cattle separately, for the meat-and fat-tissue classes E, U, R, O, P in the sense of the carcase classification regulation, BGBl. II No 71/2011, total,

2.

Halves, in each case after bulging animals, oxen, cows, calves and young cattle, separated for the meat and fat tissue classes E, U, R, O, P according to these classes,

3.

Halves of Sanimals of the meat and fat tissue class R,

4.

Halves of Jungsanimals of the meat and fatty tissue classes U 2, U 3, R 2, R 3, O 2 and O 3,

5.

Halves of Sanimals of the meat and fat tissue classes R 3,

6.

Halves of oxen of the meatiness and fatty tissue classes U 2, U 3, U 4, R 2, R 3, R 4, O 3 and O 4,

7.

Halves of cows of the flesh and fatty tissue classes U 3, R 2, R 3, R 4, O 2, O 3, O 4, P 2 and P 3,

8.

Halves of Kaline of the meatiness and fatty tissue classes U 2, U 3, R 2, R 3, R 4, O 2, O 3 and O 4,

9.

Halves of young bovine animals aged eight months or more, but less than 12 months of meat and fatty tissue classes U 2, U 3, R 2, R 3, O 2 and O 3 and

10.

Carcases of calves of less than 8 months of age.

(2) Commercial markets and intermediaries shall report the quantities and prices separately for the following categories.

1.

Marketing of bulls marketed separately according to milk and meat breeds aged between eight days and four weeks within the meaning of Article 1 (3) lit. (a) or (b) of Regulation (EU) No 807/2013,

2.

Young bovine animals marketed at the age of six months or more, but less than 12 months in the sense of Article 2 (3) (3). a of Regulation (EU) No 807/2013,

3.

Male bovine animals marketed in accordance with Art. 2 para. 3 lit. b of Regulation (EU) No 807/2013,

4.

Female annual bovine animals marketed in accordance with Article 2 (3) (3). b of Regulation (EU) No 807/2013. '

(3) The quantities shall be determined in pieces and in kilograms (total weight and average weight).

(4) Prices are the purchase prices without value added tax (weighted average prices), in the case of paragraph 2 (1) per animal, in all other cases referred to 1 kg.

Reporting requirements for pigs and pigmeat

§ 9. (1) slaughterhouses and intermediaries shall report quantities and prices for the marketed meat of the following categories:

1.

Pig halves of the commercial classes S, E, U, R, O, P in the sense of the Carcass Classification regulation, BGBl. II No 71/2011, as a whole, and separated according to these commercial classes;

2.

Halves of breeding sows.

(2) Commercial markets and intermediaries have to report the quantities and prices for the piglets marketed.

(3) The quantities shall be determined in pieces and in kilograms (total weight and average weight).

(4) Prices are the purchase prices without VAT (weighted average prices), based on 1 kg.

Reporting requirements for sheep and sheepmeat

§ 10. (1) slaughterhouses and intermediaries shall report the quantities in pieces and in kilograms (with average weight) and prices for the marketed live lambs and for meat of fattening lambs and alto sheep.

(2) Prices are the purchase prices without VAT (weighted average prices), based on 1 kg.

Reporting requirements for eggs

§ 11. (1) Packages shall have the quantities (in pieces) and the prices of marketed eggs of grade A, sorted on humps, in accordance with the weight categories XL, L, M and S, in accordance with Article 4 (1) separately and separately according to the following categories pursuant to Art. 12 (2) Regulation (EC) No 589/2008 laying down detailed rules for the implementation of Council Regulation (EC) No 1234/2007 as regards the marketing standards for eggs, OJ L 145, 31.5.2008, p. No. OJ L 163, 24.06.2008, p. 6.

1.

Eggs from organic production,

2.

free-range eggs,

3.

Eggs from soil conservation and

4.

Eggs from cages.

(2) Prices are the selling prices from the packing centre (packing set-off prices), without VAT (weighted average prices by weight), based on 100 pieces.

Reporting requirements for poultry and poultrymeat

§ 12. (1) slaughterhouses and cutting plants shall report the quantities in kilograms and the prices for the marketed meat of the following categories:

1.

Broiler, fresh, bratready or grilled, each loose and on cup and

2.

Chest of turkeys, fresh, vacuum-packed.

(2) Prices are the selling prices of the free retail business, excluding VAT (weighted average prices), based on 1 kg.

(3) For slaughterhouses, for whole chickens of category A (chickens 65%), slaughterhouses have the selling prices of slaughterhouses, excluding VAT (weighted average prices), based on 1 kg.

Recording requirements

§ 13. The notifiers shall keep the records required for the reports in accordance with § § 8 to 12. The records shall be kept for three years from the end of the calendar year to which they relate, with the care of a regular entrepre. Longer retention periods in accordance with other regulations shall remain unaffected.

Final provisions

§ 14. With the entry into force of this Regulation, the cattle reporting regulation 2008, BGBl. II No 42/2008, except for force.
