Amending the medical act of 1998

The doctor Law 1998 - ÄrzteG 1998, Federal Law Gazette I no. 169/1998, as last amended by Federal Law Gazette I no. 46/2014 and the proclamations of the municipality Federal Law Gazette I no. 49/2014 as well as Federal Law Gazette I no. 50/2014, is amended as follows:

1. in article 3, paragraph 3 the phrase "articles 9 to 11 as training centres recognised institutions" is replaced by the phrase "sections 6a, 9 and 10 recognized schools".

2. in article 4, paragraph 1, the phrase "without prejudice to the paragraphs 32 through 35, 36, 36a and 37" is replaced by the phrase "without prejudice to sections 34 to 37".

3. paragraph 4 section 2:

"(2) General requirements referred to in paragraph 1 shall



"1 the permission of equity 2. trust necessary to the performance of the professional duties, 3. Health Fitness required to comply with the professional conduct, 4. sufficient knowledge of the German language, as well as 5 a legal residence in the entire Federal territory, involves the right to carry out an employed or self-employed activity."

4. in article 4, para. 3 subpara 2 lit. the phrase "in accordance with § 14 as an equivalent recognised or in addition completed test to the doctor for general practitioner or specialist examination" is b.

5. According to article 4, paragraph 3, the following paragraph 3a is inserted:

"(3a) about the proof of sufficient knowledge of the German language in accordance with paragraph 2 No. 4 and examination fee payable on the Organization and implementation of German exams, including one for the conduct of tests has by regulation in the borne area of effect to regulate the Austrian Medical Association. 6 paragraph 4 section 5 and 6:

7 paragraph 5, first sentence, and Z 1:

"Automatically detect medical qualifications according to the provisions of Directive 2005/36/EC are following professional qualifications:"



' 1. for the attainment of professional qualifications as rotation doctor medical training evidence of basic medical training referred to in annex V, point 5.1.1. Directive 2005/36/EC. '

8 § 5a paragraph 1 and 2 is:

'Article 5a. (1) the following professional qualifications, which have been supplemented, if necessary, by demonstrating the successful qualifying examination referred to in paragraph 2, according to the provisions of Directive 2005/36/EC as a medical professional qualifications for the attainment of professional qualifications as a general practitioner to recognize physician or every doctor are:



1. either a in a Member State of the EU or an other party of the EEA or the Swiss Confederation acquired medical proof of training which meets the requirements of the training referred to in articles 24, 25 and 28 of Directive 2005/36/EC not to entirely and the applicants who cannot demonstrate at least three years professional experience required for automatic recognition (article 10 lit. b of Directive 2005/36/EC) , or 2. a in a Member State of the EU or an other party of the EEA or the Swiss Confederation acquired medical qualifications for a specialization which has been acquired after the medical basic training to the acquisition of one listed in annex V, point 5.1.1. called and on the condition that a recognition for existing in Austria special subject of medicine is sought (article 10 lit. b of Directive 2005/36/EC) , and 3, if necessary, under the conditions of paragraph 2 in addition to the qualifications according to Z 1 or 2 as a compensatory measure proof of successfully completing qualifying examination.

(2) who has Austrian Medical Association to make the attainment of professional qualifications in the context of the procedure for the entry in the list referred to in paragraph 27 on the condition of the successful completion of an aptitude test, if completed training (continuing education) with regard to the aspired professional qualifications as a doctor, general practitioner or a specialist differs considerably from the Austrian training to the doctor, general practitioner or a specialist of the concerned special compartment and the main difference not by taking into account the acquired in the context of previous professional experience and established Knowledge, experience and skills will be balanced."

9. in Article 5a paragraph 3 No. 1, the phrase "whichever in the case of a relevant statement according to § 14 para 3 or 4, the identified shorter duration for the licensing," is omitted.

10 § 5a paragraph 6 reads:

"(6) third country diplomas are under application of paragraph 2 to 5 as medical qualifications to recognise if its holder"



1. in another Member State who is entitled EU or an other party of the EEA or the Swiss Confederation to the independent exercise of the medical profession and presents a certificate of the State concerned in accordance with subpara 1 in 2., that he three years actually and lawfully exercised the medical profession in the territory of that State."

11 paragraph 5b and heading shall be repealed.

12 paragraph 6:

„§ 6. After consultation with the Austrian Medical Association has by regulation to adopt professional qualifications to recognize further provisions relating to the referred to in articles 5 and 5a. the Federal Minister for health"

13. According to § 6 the following section 6a together with heading shall be inserted:

"Basic training during the training to the doctor, general practitioner or medical specialist

§ 6a. (1) persons who meet the requirements for the valid exercise of the medical profession as every doctor and intend to obtain the independent professional qualifications as doctor general practitioner or specialist, have previously within the framework of an employment relationship, at least nine-month practical training (basic training) to teach of clinical skills in surgical and conservative areas.

(2) the basic training is to complete approved training sites.



(3) approved training centres for the basic training are 1 general hospitals in accordance with § 2a Krankenanstalten-and Spa Institute Act (KAKuG), Federal Law Gazette No. 1/1957, as well as 2 special hospitals in accordance with § 2 par. 1 Z 2 KAKuG, by the Austrian Medical Association with decision have been recognised as a training ground for the whole or only a part of the basic training.

(4) a (partial) recognition as no. 2 training facility in accordance with paragraph 3 is possible, provided that the necessary conditions for the teaching of clinical basic skills in the special hospital are given.

(5) the recognition as training facility in accordance with paragraph 3 is Z 2 by the Austrian Medical Association to withdraw or limit, if that has been changed for the recognition as relevant circumstances or subsequently emerges that a prerequisite required for that purpose already originally failed.

(6) the obligation for the purposes of basic training before the start of training as a specialist in accordance with § 8 shall not apply to those special subjects which are laid down in the regulation referred to in article 24, paragraph 1."

14 paragraph 7 together with the heading:

"The doctor general practitioner training


7. (1) includes the doctor general practitioner training after successful completion of basic training in accordance with section 6a of the a period of at least thirty-three months. Persons who meet the requirements for the audit-related exercise of the medical profession as every doctor and intend to obtain independent professional permission, as general practitioner have following the basic training



1. within the framework of an employment relationship practical training to the doctor for general medicine, and 2. to take the exam to the GP and to demonstrate the success of the training and examination (section 26).

(2) the training has to be medicine, as well as areas of expertise specific to further the regulation in accordance with § 24 para 1 anyway, on the areas of general medicine and Interior.

(3) the training is, as far as paragraph 4 not otherwise determines to complete training sites in accordance with § 9. Also, training in these recognised training centres on one for the respective areas of expertise for training to the doctor general practitioner has to be fixed training site. This does not rule out a Division-wide or cross-organizational unit activity on the same site without prejudice to article 3, par. 3 after completion of basic training, as long as it is only to activities the competences acquired in the course of basic training, they take place outside the period of core training and at any time is a professionally responsible doctor at the location of the hospital available. Through organizational measures is to ensure that the resulting from this activity qualitative and quantitative requirements the rolling doctors as well as their training objectives are proportionate. The total number of beds attributable to the individual cycle doctor may not exceed when working in two departments, or other organizational units 60, when operating in three divisions or other organizational units 45 do not exceed. A Division-wide or cross-organizational unit activity in clinics is not permitted.

(4) at the end of the training, the Department is general medicine at least to the extent of six months in teaching practices or teaching group practices established to graduate doctors for general medicine, as well as teaching outpatient. For their organization and administration, the Austrian Medical Association, including the Commission for the medical training referred to in article 44 of the agreement in accordance with article 15a B-VG on the Organization and financing of health care, Federal Law Gazette has no. 105/2008, as amended by Federal Law Gazette I no. 199/2013, to ensure I. The eligible training total training in teaching practices, teaching group practices or doctrine outpatient lasts no more than eighteen months. 15 paragraph 8 together with the heading:

"Training as a specialist

8. (1) includes training as a specialist after successful completion of basic training in accordance with section 6a of the a period of at least sixty-three months, unless the regulation in accordance with § provides another 24 para 1 does not. Persons who meet the requirements for the audit-related exercise of the medical profession as every doctor and intend to obtain independent professional permission in a subspecialty of Medicine (special subject), have following the basic training



1. an at least siebenundzwanzigmonatige within the framework of an employment practical training in the corresponding special compartment (special trade - basic training), except the training in surgical fields in the period of at least fifteen months, and 2 one at least siebenundzwanzigmonatige practical focus training (special focus training) excluding training in the special compartment mouth, maxillo - facial surgery, and 3 to take the medical exam and demonstrate the success of the training and examination (section 26) within the framework of an employment relationship.

(2) the training is, as far as paragraph 3 and 4 not else determine to complete training sites in accordance with § 10. Also, the education in these schools on one for the respective special subject for the appropriate training as a specialist has to be fixed training site. This does not rule out a Division-wide or cross-organizational unit activity on the same site without prejudice to article 3, par. 3 after completion of basic training, as long as it is only to activities the competences acquired in the course of basic training, they take place outside the period of core training and at any time is a professionally responsible doctor at the location of the hospital available. (3) the Federal Minister of health at least six months and at most twelve-month duty rotation to other educational institutions, teaching practices, teaching group practices or doctrine dispensaries may make provision in the regulation in accordance with § 24 para 1 for practical training in various special subjects.

(4) as far as it is consistent with achieving the training goal, part of the special technical focus training, may be completed up to the maximum period of twelve months or in teaching practices teaching group practices of established specialists teaching outpatient total. Without prejudice to the work in a teaching practice, a teaching practice or a teaching clinic in accordance with § 12, § 12a and article 13 also the dependent action according to the previously acquired skills in a specialized area of training as a specialist in the framework of an employment relationship in a training facility of a hospital is allowed.

16 paragraph 9 together with the heading:

"Training facilities for training the Arzt für Allgemeinmedizin

§ 9 (1) departments and other organizational units of hospitals, including university hospitals, other organizational units of medical universities or universities, where a medical school is set up, as well as special hospitals, which have been approved by the Austrian Medical Association as training centres for the training to the GP are training centers for training in accordance with section 7.

(2) the recognition as a training facility for the training to the GP in the respective area of expertise is to provide, if guaranteed is that according to the technical requirements of the training facility



1 demonstrably has a medical service which by a specialist of the concerned special compartment is, at least during core working hours is present this or the specialist which the Director, providing the guidance and supervision of rolling doctors, and is employed in addition to this at least a further specialist entitled to independent practice of the concerned special compartment;

2. in terms of content and scope provided the necessary knowledge, experience rolling doctors medical services after and skills taught;

3. all necessary technical facilities to attain the objective of training and devices including the necessary teaching and examination material has;

4.

(3) at the same time with the recognition of a training school for training the Arzt für Allgemeinmedizin in accordance with § 7 is the number of training positions for training in the respective field, to set. These are the conditions referred to in paragraph 2 for the recognition as a training site including the number of trainee doctors, accordingly to take into account the possible number of beds, as well as the content and scope of medical services of the institution. The number of training posts set in a training facility for training the doctor general practitioner must not exceed the number of workers medical specialists.

(4) the initial recognition as a training facility is granted for a period of seven years, as of the effective date set out in the recognition decision. The period extended to seven years unless the re certification procedure in accordance with section 13a, that the conditions for recognition continues to exist.

(5) the recognition as a training facility has, where necessary, under terms and conditions to be made when their performance or observance for the legitimate pursuit of education, ensuring a high-quality level of education or to maintain the training requirements is available.

(6) the recognition as a training facility is without prejudice to the recognition period laid down in paragraph 4 of the Austrian Medical Association to withdraw or restrict, if



(1) it for the recognition as training school were originally has not given necessary conditions or 2. these partly or entirely fallen away or 3. evidence of facts, from which that the training does not meet requirements or changes in the supply contract, performance statistics and/or the personnel or material facilities of the training facility occur 4., which no longer guarantee the training results.

The same applies to the number of established posts of the training.

(7) with the recognition as a training facility that can be restricted extent of recognition according to, if the educational institution has not the entire area of the concerned department or the medical services rendered by you do not ensure that the required knowledge, experience and skills in the respective field entirely can be communicated every doctors.

(8) a retroactive recognition as a training facility or retrospective fixing of a training centre for training to the doctor general practitioner is allowed only on request and only for a period of not more than one year after submission. During this period, the requirements for that purpose without interruption must be located above.

(9) the training facilities are to include in the directory of schools for training the Arzt für Allgemeinmedizin, electronically guided by the Austrian Medical Association. The directory is continuously to update and publish on the homepage of the Austrian Medical Chamber.

(10) with regard to the recognition of and the establishment of training centers in university hospitals and other organizational units including any subdivisions of medical universities or universities, where a medical school is set up (§ 6 2002 University Act, Federal Law Gazette I no. 120/2002), the Austrian Medical Chamber has agreement with the Federal Minister for science, to establish research and business.

(11) the activities of a specialist as a consultant can then replace the recognition of a Department or other organizational unit as a training facility a hospital, if it already has at least a training facility and in so far as by the activity of the Konsiliararztes also combined the training of every doctor on a part of a specialist area to the extent of at least 30 hours per week, with activity in a teaching practice or teaching practice that may be ensured under the guidance and supervision of the Konsiliararztes. The consultant is also teaching practice holders in accordance with § 12 or members of a teaching practice in accordance with Article 12a, also the active becoming of every doctor in this teaching practice or teaching practice, taking into account the relevant provisions is permitted.

(12) in the case of the recognition of educational institutions and the establishment of training institutions the number of affected every doctors and departments or other organizational units, as well as the appropriate organizational framework of departmental or cross-organizational unit activity pursuant to § 7 para 3 shall be provided. "

17 paragraph 10 together with the heading:

"Training facilities for training specialist

10. (1) training centres for the training referred to in article 8 are departments and other organizational units of hospitals, including university hospitals, other organizational units of medical universities or universities, where a medical school is set up special hospitals, labaratory of health administration, occupational health centres in accordance with article 80 of the ArbeitnehmerInnenschutzgesetzes (after), BGBl. No. 450 / 1994, institutions are designed for the accommodation of mentally abnormal or cessation of offenders, as well as health departments in prisons , which have been approved by the Austrian Medical Association as training centres for the training as a specialist in a special compartment.

(2) the recognition is to grant training facility for training as a specialist in a special compartment is if guaranteed, that according to the technical requirements of the training facility

2. in terms of content and scope provided the necessary knowledge, experience rolling doctors medical services after and skills according to the special technical training, as well as the special focus training taught;

3. all necessary technical facilities to attain the objective of training and devices including the necessary teaching and examination material has;

(3) at the same time with the recognition of a training school for training as a specialist in a special compartment in accordance with § 8 is the number of training positions for the special compartment basic training and the special compartment focus training, to be set. These are the conditions referred to in paragraph 2 for the recognition as a training site including the number of trainee doctors, accordingly to take into account the possible number of beds, as well as the content and scope of medical services of the institution.


(4) for each training body in accordance with paragraph 3 in full-time employment (or several part-time specialists to the extent of a full time employment) is another related specialist entitled to independent practice of the concerned special compartment next to the mediations or the specialist responsible for the direct guidance and supervision of rolling doctors at least to deal with.

(5) for the purpose of ensuring longer-term medical supply of the Austrian population the Federal Minister of health may after consulting the Commission for medical training in accordance with article 44 of the agreement in accordance with article 15a B-VG on the Organization and financing of health care, Federal Law Gazette I no. 105/2008, as amended by Federal Law Gazette I no. 199/2013, within the framework of the regulation on the training of doctors (§ 24 para 1) Moreover, set , that the legal education requirement of paragraph 4 in determining training agencies in determining special subjects for a duration to be determined to refrain from is, if not a single education authority approval is sought. (8) recognition as a training facility is without prejudice to the recognition period set out in paragraph 7 of the Austrian Medical Association to withdraw or restrict, if



(1) it for the recognition as training school were originally has not given necessary conditions or 2. these partly or entirely fallen away or 3. evidence of facts, from which that the training does not meet requirements or changes in the supply contract, performance statistics and/or the personnel or material facilities of the training facility occur 4., which no longer guarantee the training results.

(9) with the recognition as a training facility that can be restricted extent of recognition according to, if the educational institution has not the entire area of the concerned special - basic training or special focus on training or the medical services rendered by you do not ensure that the requisite knowledge, experience and skills in the field of the concerned special - basic training or special focus training entirely can be communicated every doctors.

(10) a retroactive recognition as a training facility or retroactive establishment of a training centre for training in a special compartment is only on request and only for a period of one year counting from submission of the allowed. (11) the training centres are electronically guided by the Austrian Medical Association directory of schools for training as a specialist in a special compartment. The directory is continuously to update and publish on the homepage of the Austrian Medical Chamber.

(12) with regard to the recognition of and the establishment of training centers in university hospitals and other organizational units including any subdivisions of medical universities or universities, where a medical school is set up (§ 6 2002 University Act, Federal Law Gazette I no. 120/2002), the Austrian Medical Chamber has agreement with the Federal Minister for science, to establish research and business.

(13) in the case of the recognition of educational institutions and the establishment of training centers the number of affected every doctors and departments or other organizational units, as well as the appropriate organizational framework of departmental or cross-organizational unit activity in accordance with § 8 par. 2 shall be provided. "

18 paragraph 11 together with the heading:

"Maintaining the quality of education

§ 11 (1) the institution of the training facility has to ensure in the shortest time and in accordance with the training periods provided for the training to the doctor general practitioner or a specialist in the training facility for the best qualifying training of every doctors and to ensure the transmitted rolling doctors for the acquisition of skills aimed at achieving the objectives of the training, experience and skills. As far as it is necessary to attain the objective of training has theoretical teachings also accompanying the training to cover.

(2) the training facility has to submit a training plan to the cycle doctor to start practical education to the doctor, general practitioner or a specialist after basic training.

(3) the Director of Training Institute is also committed to the training of doctors with the aim of the independent exercise of the medical profession as a doctor for general practitioner or specialist of the respective special subject and responsible as the head of the Department or organizational unit for basic training (trainers). A training of doctors in a Department or other organizational unit, under her leadership, is not permitted.

(4) the trainers can be supported by a specialist authorised for the independent professional practice of the respective special subject.

"Specialization


section 11a. (1) after completion of training the doctor general practitioner or a specialist, a specialization in the form of a training course, which can be also special interdisciplinary, is possible. The specialization may not exceed a period of thirty-six months.

(2) the specialization is in training centres in accordance with the articles 9 and 10, in teaching practices in accordance with § 12, in teaching group practices referred to in Article 12a, teaching outpatient in accordance with section 13 or in facilities that serve the medical or psychosocial treatment, care or supervision to complete. Facilities, where specializations can be completed, in a to record by the Austrian Medical Association electronically guided directory that is continuously to update and publish on the homepage of the Austrian Medical Chamber.

(3) for further information about the duration, the content, the Organization of the specializations, as well as the qualification of doctors for general practitioners or specialists for each specialization has by regulation in the borne area of effect to regulate the Austrian Medical Association."

20 paragraph 12 together with the heading:

"Teaching practices

12. (1) when teaching practices within the meaning of §§ 7 para 4 and 8 para 3 and 4 apply the ordination sites of those doctors for general practitioners or specialists, where approval for the training of doctors to the doctor, general practitioner or a specialist has been granted by the Austrian Medical Association. These doctors are to record in the directory of the teaching practice owner electronically guided by the Austrian Medical Association, which is continuously to update and publish on the homepage of the Austrian Medical Association.

(2) the requirements for a permit referred to in paragraph 1 are to be set in the regulation referred to in article 24, paragraph 1. In particular, must



1. the ordination site the necessary to achieve the objective of the training facilities, particularly in equipment terms, as well as demonstrate the required frequency of patient, 2. the holder of the teaching practice to attain the objective of the training required at least four years experience as a practising physician, or as a freelance doctor during an ordination site, 3. the holder of the teaching practice in particular about the required knowledge of the basics of health economics have, 4. the holder of the teaching practice by presenting a written training concept , that the medical services provided in the site of ordination can convey the necessary knowledge, experience and skills the cycle doctor according to content and scope.

(3) the first-time approval is granted for a period of seven years, as of the effective date set out in the permit notification. The period extended to seven years, unless the re certification procedure in accordance with section 13a, that the requirements for approval continue.

(4) the permit is to withdraw without prejudice to the period laid down in paragraph 3 of the Austrian Medical Association, if



1. the requirements for the grant were originally not given or 2. these partly or entirely fallen away or 3. evidence of facts, from which that the training does not meet requirements or changes in the supply contract, performance statistics and/or the personnel or material facilities of the teaching practice occur 4., which no longer guarantee the training results.

(5) the approval shall expire with the closure of the ordination site specified in the notification of the teaching practice owner, as well as with setting, prohibition or invalidate the exercise of the profession of teaching practice owner to the date of registration of this date in the list.

(6) only a doctor can be trained within the framework of a teaching practice. The teaching practice is committed to the training of every doctor with the aim of preparing for the activity as a practising physician. The teaching practice owner has skills constantly to review experiences and skills and to assess to what extent they actually are been conveys the cycle doctor to the extent indicated in the rest products for the respective areas of expertise. Every doctor is to attract to the personal participation of the teaching practice holder and has to accept also responsibility, according to the level of his training what any person taken in consultation and treatment in an appropriate manner is to inform. This practical training has in the context of employment and a core training period of at least 30 hours per week to be during the day, in any case, the Office hours to cover.

(7) while maintaining the quality of education, part-time employment can be arranged with the cycle doctor at his request. The weekly service time may however to no more than half are minimized. The minimum and the maximum period of education in the framework of a teaching practice, provided part-time employment claim is made, appropriately extended.

(8) the beginning of the interruption, within one month of the teaching practice holder in writing in the way of the medical associations in the provinces of the Austrian Medical Association, if necessary by means of one of the Austrian Medical Association provided the application, stating the name, date of birth, to announce the change of the training scale as well as the completion of the training of every doctor in a teaching practice is, where appropriate, the registration number of every physician in the list as well as the training job number provided by the Austrian Medical Association available. "Teaching group practices

(5) the approval is to withdraw without prejudice to the period laid down in paragraph 3 of the Austrian Medical Association, if



1. the requirements for the grant were originally not given or 2. these partly or entirely fallen away or 3. evidence of facts, from which that the training does not meet requirements or changes in the supply contract, performance statistics and/or the personnel or material facilities of the teaching practice occur 4., which no longer guarantee the training results.

The same applies to the number of established posts of the training.


(6) the authorisation shall expire with the closure of the group practice specified in the notification, as well as with setting, prohibited or void the practice of self-study to the date of registration of this date in the list.

(7) the shareholders of a teaching practice are committed to the training of every doctors with the aim of preparing for the activity as a practising physician. They have to ensure in the shortest time and in accordance with the training periods provided for the training to the doctor general practitioner or a specialist within the framework of the teaching practice in the teaching practice for the best qualifying training of rolling doctors. The partner responsible in teaching group practice for the respective training has skills constantly to review experiences and skills and to assess to what extent they actually are been conveys the cycle doctor to the extent indicated in the rest products for the respective training subjects. 22 paragraph 13 together with the heading:

"Teaching dispensaries

13. (1) teaching dispensaries within the meaning of §§ 7 para 4 and 8 para 3 and 4 are those hospitals in the form of an independent outpatient clinics, which are recognised by the Austrian Medical Association as outpatient teaching clinics for training as a doctor, general practitioner or a specialist in a special compartment. The teaching dispensaries are to record in the electronically guided by the Austrian Medical Association directory of teaching outpatient that is continuously to update and publish on the homepage of the Austrian Medical Chamber.

(2) the recognition as a teaching clinic is to provide, when



1. for training is a specialist entitled to independent practice of the concerned special partition available (Ausbildungsverantwortlicher) and in addition to this, at least a further entitled to independent practice specialist of the concerned special partition is busy;

2. the Assistant or Deputy to such an extent is employed, that during the operating hours of the teaching ambulatory an activity of rolling doctors only under the guidance and supervision of a physician responsible for the training can be done by whose presence

3. you provided medical services to content and extent of the standing doctors convey in training the necessary knowledge and experience in out-patient examinations and treatments;

4. the teaching clinic has all necessary technical facilities to attain the objective of training and devices including the necessary teaching and research material;

5. the teaching clinic has a written training concept, which sets time and content structured teaching learning in accordance with the regulations adopted on the basis of this Act.

(3) the initial recognition is granted for a period of seven years, as of the effective date set out in the permit notification. The period extended to seven years unless the re certification procedure in accordance with section 13a, that the conditions for recognition continues to exist.

(4) at the same time with the recognition as a teaching clinic, the number of training posts is taking into account referred to in paragraph 2 for the recognition as a teaching clinic conditions including the number of trainee doctors to set the.

(5) for each training post, at least a further entitled to independent practice specialist of the concerned special compartment is next to the mediations to deal with.

(6) the winners of the outpatient teaching clinics have in shortest possible time and in accordance with the training periods provided for the training to the doctor general practitioner or a specialist in the framework of a teaching ambulatory in the teaching clinic to ensure the best qualifying training of doctors of the cycle. The training is committed to the training of these physicians with the goal of the independent exercise of the medical profession as a doctor for general practitioner or specialist of the respective special subject. It can be supported this connection by a specialist authorised for the independent professional practice of the respective special subject (training Assistant). The training has the acquisition of knowledge continuously to review experiences and skills and to assess to what extent they actually are been conveys the cycle doctor to the extent indicated in the rest products for the respective training subjects. The cycle doctor is to attract to the personal involvement and has to accept also responsibility, according to the level of his training about what each person taken in consultation and treatment in an appropriate way is to inform.

(7) the practical training is to attain the objective of training as evenly as possible with a core training time of 35 hours per week during the day on the work days of the week to break up. The period of core training has to ensure that the training of rolling doctors as possible in the main service time, where the majority of specialist permanent staff in the teaching clinic is present, is completed. Of the 35 hours per week are therefore at least 25 hours to complete in the time between 7:00 and 16:00.

(8) while maintaining the quality of education, part-time employment can be arranged with the cycle doctor at his request. The weekly service time may however to not more than half of the core training time (para. 6) are reduced. The minimum and the maximum period of education in the framework of a teaching ambulatory be provided part-time employment claim is made, appropriately extended.

(9) the beginning of the interruption, within one month of the head of the teaching ambulatory of the Austrian Medical Chamber using one of her available the application, specifying the name, date of birth, to announce the change of the training scale as well as the conclusion of a cycle doctor on an apprenticeship training is, where appropriate, the registration number of every physician in the list as well as the training job number provided by the Austrian Medical Association available. (10) the recognition as a teaching clinic is to withdraw without prejudice to the recognition period laid down in paragraph 3 of the Austrian Medical Association, if



(1) it for the recognition as a teaching clinic were originally has not given necessary conditions or 2. these partly or entirely fallen away or 3. evidence of facts, from which that the training does not meet requirements or changes in the supply contract, performance statistics and/or the personnel or material facilities of the teaching ambulatory occur 4., which no longer guarantee the training results.

The same applies to the number of established posts of education."

23. According to section 13, the following section 13a together with heading shall be inserted:

"Re certification procedures


§ 13a. (1) within the seven-year effectiveness period of recognition in accordance with § 9, § 10 and § 13 or the permit in accordance with section 12 and section 12a, the Austrian Medical Association has the conditions of recognition or approval on the basis of the Commission for the medical training referred to in article 44 of the agreement in accordance with article 15a B-VG on the Organization and financing of health care, Federal Law Gazette I no. 105 / 2008 as amended by Federal Law Gazette I no. 199 / 2013 , criteria to evaluate constantly. If a recognition beyond the more continuous over the period of effectiveness or permit is sought, an application for a seven-year extension with the Austrian Medical Association is within one year prior to the recognition or approval to introduce. In this case has the existence of the conditions for the recognition or the permit to examine the Austrian Medical Chamber in a re-certification procedure on the basis of the results of the evaluation and any occurring changes.

(2) the procedure referred to in paragraph 1 indicates that the requirements for recognition or approval persists, is administrative decision to extend the recognition or the authorisation for a further seven years. At the same time with the extension also the number of training posts is to be set.

(3) the procedure referred to in paragraph 1 reveals that the prerequisites for recognition or a permit no longer or no longer to fully apply, administrative decision to take back the recognition or approval or limit accordingly.

(4) the procedure referred to in paragraph 1 is not until the end of the recognition or approval administrative decision completed the recognition or approval continues to apply until the end of the process."

37. § 29 par. 1 Z 7a is eliminated.

38. in article 30, paragraph 1, first sentence, the phrase 'EEA Contracting States and the' replaces the phrase "Member States of the EU or an other party of the EEA Agreement or".

41A. Article 34 reads:


"§ 34. "Medical activity in imputed position for study purposes

35. (1) doctors, who are not authorized pursuant to section 4 to the exercise of the medical profession or whose medical Doktorate Z 1 comply with the requirements of article 4, paragraph 3, may exert a medical activity in imputed position only and only for study purposes.

(2) the doctors referred to in paragraph 1 may be involved in imputed position and to study



1. in university clinics, clinical institutions, or other organizational units including any subdivisions of medical universities or universities where a medical school is set up within the framework of the obligations assigned to them, with the approval of the head of the concerned organizational unit or any subunit each up to the period a year;

2. all other hospitals or medical and scientific institutions, the training centres within the meaning of §§ 9 and 10 Medical Association are, within the framework of the obligations assigned to them, with the approval of the Austrian each until the period of one year.

(5) an is approval in accordance with § 2 or an extension referred to in paragraph 3 to fail, if by the activity of the doctor postpromotionelle training (rolling) Austrian doctors or doctors, who are nationals of a Member State of the EU or an other party of the EEA or the Swiss Confederation, is endangered. Prior to issuance of a permit in accordance with paragraph 2 or an extension referred to in paragraph 3 is the Medical Association of the State in which the medical activity is exercised, to hear. (7) section 27 on the entry in the list and section 59 of the expiry of the permission to exercise the profession are the doctors referred to in paragraph 1 shall apply mutatis mutandis, that the omission of a requirement required for the permit does not lead to compliance with the conditions referred to in article 4.

43. § 37 para 1 first sentence reads:

"Nationals of a Member State of the EU or an other party of the EEA or the Swiss Confederation, legally exercising the medical profession in another Member State of the EU or an other party of the EEA or the Swiss Confederation may be medically active from their foreign based or location in order to provide services in Austria under the corresponding professional title referred to in article 43, paragraph 2."

44. in article 43, paragraph 2 of the parenthetical expression "(§§ 4, 27, 32, 33 und 44)"replaced by the parenthetical expression "(§§ 4, 27 und 44)'.

(determination of principle of) the support of hospitals, which are charged on country health fund, are obliged according to the designated range of services to ensure that the future demand for doctors for general medicine according to and taking on the outcome of the deliberations of the Commission for the medical training referred to in article 44 of the agreement in accordance with article 15a B-VG on the Organization and financing of health care, Federal Law Gazette I no. 105/2008, as amended by Federal Law Gazette I no. 199/2013" "that is a sufficient number of training positions for training the Arzt für Allgemeinmedizin available."

72A. in § 199 section 3 the expression is the expression 'article 3, paragraph 1 or 3', "§ 7 para 3, § 8 par. 2," added.

74. Article 215 shall be repealed.

75. According to article 234, 235 the following paragraph with heading shall be inserted:

"Transitional and coming into force provisions to article 1 of the Federal Act Federal Law Gazette I no. 82/2014"

235. (1) this Federal Act shall, if composed the following provisions not different results with 1 January 2015 in force.

(2) for persons who seek permission to the independent exercise of the medical profession as a certified physician in Austria, a request for registration in the list as a certified physician from 1 January 2015 is no longer allowed.

(3) persons, until no later than 31 May 2015 training as a doctor, general practitioner, specialist or in an additive started and have been entered in the list are entitled, this started training in accordance with the provisions of the medical Act 1998 as amended by Federal Law Gazette I no. 46/2014 to complete. This also applies to training according to § 8 section 5 in connection with § 10 par. 12 and 11 paragraph 9 doctor Act 1998 as amended by Federal Law Gazette I no. 46/2014.

(4) educational institutions recognized in accordance with articles 9, 10 and 11, teaching practices in accordance with § 12, teaching group practices in accordance with § 12a and teaching dispensaries in accordance with § 13 doctor Act 1998 as amended by Federal Law Gazette I no. 46/2014 shall apply with regard to persons referred to in paragraph 3 even after the expiry of the 31 May 2015 as a recognised educational institutions, teaching practices, teaching group practices or doctrine dispensaries, including the number of there established training centers. Those provisions of the medical Act 1998 I no. are 46/2014, which refer to recognised educational institutions, teaching practices, teaching group practices and outpatient teaching clinics, as amended by BGBl. continue to apply to them.

(5) the basic training in accordance with § 6a, the training to the doctor for general practitioner pursuant to section 7, the training as a specialist in accordance with section 8 or a specialization according to § 11a, each as amended by Federal Law Gazette I no. 82/2014 can be started only from 1 June 2015.

(6) regulations on the basis of this federal law may be adopted before its entry into force. You may apply at the earliest I no. 82/2014 with entry into force of the Federal Law Gazette.

(7) training in the field of General Medicine pursuant to § 7 para 4 as amended by Federal Law Gazette I no. 82/2014 is



1. seven to complete years after entry into force of paragraph 5 in the circumference of at least nine months, 2. after five years in the circumference of at least twelve months in teaching practices or teaching group practices of practising doctors and outpatient teaching clinics. The total duration of the training to the Arzt für Allgemeinmedizin extends seven years after entry into force of paragraph 5 to 45 months and another five years to 48 months. Seven years after entry into force of paragraph 5 may a part of beyond the scope of six months training period in other entities that serve the primary medical care, especially in outpatient clinics, general practitioners have been recognised as a training ground for the field, completed, where the extent of this part of the regulation in accordance with § 24 para 1 as amended by Federal Law Gazette I no. 82/2014 , to be determined.

(8) the Federal Minister of health has to evaluate the impact of the mandatory completion of training in the field of general medicine in teaching practices, teaching group practices or doctrine outpatient seven years after entry into force of paragraph 5 and to report to the National Council.

(9) with 1 July 2015 § 11 section 7 occur, section 12 paragraph 7, Article 12a para 6 and § 13 para 8 in the version of Federal Law Gazette I no. 82/2014 in force, as well as at the end of 30 June 2015 § 9 para 8, § 10 paragraph 8, article 11, para. 3 last sentence, article 12 paragraph 6, Article 12a para 8 and § 13 para 8 as amended by Federal Law Gazette I no. 46/2014 override.

Article 2

Change of the General Social Security Act

The General Social Insurance - ASVG, Federal Law Gazette No. 189/1955, as last amended by Federal Law Gazette I no. 68/2014, is amended as follows:

1. in article 81, b is inserted after the para 2a the following paragraph 2:

"(2B) the establishment (founding) is permitted by or participation in clubs, funds and companies with limited liability for the purpose of financing and organization of service conditions according to § 460 paragraph 1a by the Association, with the participation of other legal persons, specifically, carriers of hospitals, the Austrian Medical Association, as well as the provincial, and individuals on these is possible." Is a legal person justified the employment of training for every doctors and-ärzten under this provision, the relevant provisions of the service regulations are to be applied."

2. According to section 342a, 342 the following section is inserted b together with the heading:

"Total contractual rules governing rolling physicians and physicians in training contract doctors and-ärzten and contracting group practices


§ is 342 b (1) between the main Association for all health insurance carrier and the Austrian Medical Association and the provincial a binding for the Contracting Parties overall arrangement on the use of rolling doctors and-ärzten contract doctors and-ärzten and contracting group practices to complete.

(2) this overall agreement has in particular way to regulate scope and principles of reverse accountability of services which can be provided by every doctors and-ärzten for contract doctors and doctors and contract group practices at the expense of health insurance carrier. 3. § 343d para 1 No. 4 is:

"(1a) the Association and the health insurance carrier are entitled to support the training of every doctors and-ärzten according to enter 1998 temporary training relationships in the context of a service relationship § 12 and 12a of the medical act.
