Amendements à la Constitution

The Council,

That the Constitution of the Organization was adopted on 19 October 1953, entered into force on 30 November 1954 and that amendments to the Constitution were adopted by the Council on 20 May 1987 and entered into force on 14 November 1989,

Mindful of the need to review the Constitution with a view to strengthening the structure and streamlining the decisionmaking process of the Organization,

Recalling further its resolution No. 973 (LXXIV) of 26 November 1997 by which it resolved to establish an open-ended Working Group of representatives of interested Member States, under the chairmanship of the Chairman of the Council or a representative appointed by the Working Group, for the purpose of examining possible amendments to the Constitution of the Organization,

Having received and examined the proposed amendments contained in the Report of the Working Group on Possible Amendments to the Constitution (MC/1944), submitted by the Director General upon recommendation of the Working Group,

Noting that the provision of Article 30, paragraph 1, of the Constitution, which requires that the texts of the proposed amendments to the Constitution shall be communicated by the Director General to the Governments of Member States at least three months in advance of their consideration by the Council, has been duly adopted with,

Considering that the proposed amendments do not involve new obligations for Members,

Acting pursuant to Article 30, paragraph 2, of the Constitution,

Adopts the amendments to the Constitution, as indicated in the Annex to the present resolution, the texts in the English, French and Spanish language being equally authentic;

Member States to accept these amendments as early as possible in accordance with their respective constitutional processes and to notify the Director General accordingly.

Le Conseil,

Rappelant que la Constitution de l' Organisation a été adoptée le 19 octobre 1953, qu' elle est entrée en vigueur le 30 novembre 1954 et que des amendements ont été adoptés par le Conseil le 20 mai 1987 et sont entrés en vigueur le 14 novembre 1989,

Conscient de la nécessité de réviser la Constitution afin d' affermir la structure de l' Organisation et de rationaliser son processus de prise de prise de décisions,

Rappelant en outre sa Résolution No 973 (LXXIV) du 26 novembre 1997 par laquelle il a décidé d' instaurer un Groupe de travail à composition non limitée, constitué de représentants des Etats membres intéressés, sous la direction du Président du Conseil ou d' un représentant désigné par le Groupe de travail, dans le but d' étudier d' éventuel amendements à la Constitution de l' Organisation,

Ayant reçu et examiné les propositions d' amendements contenues dans le rapport du Groupe de travail chargé d' examiner d' éventuel amendements à la Constitution (MC/1944), soumises par le Directeur général sur la recommandation du Groupe de travail,

Notant que la disposition de l' Article 30, alinéa 1, de la Constitution, qui prescrit que les textes des amendements proposés à la Constitution soient communiqués aux gouvernements membres trois mois au moins avant leur examen par le Conseil, a été dûment respectée,

Considérant que les amendements proposés n' entraînent pas d' obligations nouvelles pour les membres,

Agissant en conformité avec le deuxième alinéa de l' Article 30 de la Constitution,

Adopte les amendements à la Constitution tels qu' énoncés dans l' annexe à la présente résolution, dont les versions française, anglaise et espagnole font également foi,

Invite les Etats membres à approuver dès que possible lesdits amendements, conformément à leurs règles constitutionnelles respectives, et à en informer le Directeur général en conséquence.

The Council-

After receipt and examination of the proposed amendments contained in the report of the Working Party on Possible Statutes for Statutes (MC/1944), submitted by the Director-General on the recommendation of the Working Party,

Noting that Article 30 (1) of the Statute, according to which the text of proposed amendments to the Statute should be communicated to the Governments of the Member States by the Director-General no later than three months before they are examined by the Council, has been properly complied with,

whereas the proposed amendments do not entail new obligations for Members,

Acting on the basis of Article 30 (2) of the Statute,

Adopts the amendments to the statutes as set out in the annex to this resolution, the English, French and Spanish texts being equally authentic,

Calls on the Member States to adopt these amendments as soon as possible in accordance with their constitutional procedures, and to notify the Director-General thereof.

Article 2

The Members of the Organization shall be:

other States with a cks interest in the principle of free movement of persons which shall be taken to make a financial contribution at least to the administrative requirements of the Organization, the rate of which will be agreed to by the Council and by the State concerned, subject to a two-thirds majority vote of the Council and upon acceptance by the State of this Constitution in accordance with its constitutional processes.

other States which have demonstrated their interest in the principle of free movement of persons and at least undertake to make a financial contribution to the administrative expenditure of the Organization, the rate of which shall be between the Council and the State concerned , a decision of the Council with a two-thirds majority and the prior adoption of this Statute by the State in question shall be required in accordance with its constitutional procedures.

Article 4

1. A Member State which is in arrears in the payment of its financial contributions to the Organization shall have no right to vote if the amount of its arrears equals or exceeds the amount of the contributions due from it for the preceding two years. However, the loss of voting rights shall become effective one year after the Council has been informed that the member concerned is in arrears to an extent entailing the loss of voting rights, if at that time the Member State is still in arrears to the said extent. The Council may justify, by a simple majority vote, maintain or restore the right to vote of such a Member State if it is satisfied that the failure to pay is due to conditions beyond the control of the Member State.

Un Etat membre en retard dans le paiement de ses obligations financières à l' égard de l' Organisation est privé du droit de vote si le montant de ses arriérés est égal ou supérieur à la somme des contributions dues par lui pour les deux années écoulées. Toutefois, la perte du droit de vote devient effective une année après que le Conseil a été informé du non-respect, par l' Etat membre intéressé, de ses obligations financières dans une mesure justifiant la perte du droit de vote, pour autant qu' à ce moment-là l' Etat membre en question soit encore redevable d' arriérés dans la mesure visée. Néanmoins, le Conseil peut, par un vote à la majorité simple, maintenir ou rétablir le droit de vote de cet Etat membre s' il apparaît que le manquement est dû à des circonstances indépendantes de sa volonté.

Article 4

1. A Member State which is in default with the payment of its financial contributions to the organisation shall not be entitled to vote if the amount of the late payment corresponds to the amount of the contributions owed by it for the last two years, or this exceeds. However, the loss of voting rights shall not take effect until one year after the Council has been informed that the Member concerned is in default of late payment in a manner which is likely to result in the loss of voting rights, provided that the Member State concerned is that date is still in default in the extent to which it is referred. The Council, notwithstanding the simple majority decision, may maintain or restore the right to vote of such a Member State if it is satisfied that the failure to pay may be due to the influence of the influence of the of the Member State.

1. The Director General and the Deputy Director General shall be elected by a twothirds majority vote of the Council and may be re-elected for one additional term. Their term of office shall normally be five years but may, in exceptional cases, be less if a two-thirds majority of the Council so far. They shall serve under contracts approved by the Council, which shall be signed on behalf of the Organization by the Chairman of the Council.

Amendments Involving Fundamental Changes in the Constitution of the Organization or new obligations for the Member States shall come into force when adopted by two-thirds of the members of the Council and accepted by two-thirds of the Member States in with their respective constitutional processes. Whether an amendment involves a fundamental change in the Constitution shall be decided by the Council by a two-thirds majority vote. Other amendments shall come into force when adopted by a two-thirds majority vote of the Council.

Amendments which bring about fundamental changes to the statutes of the organisation or new obligations for the Member States shall enter into force if they are decided by two-thirds of the members of the Council and by two-thirds of the members of the Council. Member States have been adopted in accordance with their respective constitutional procedures. Whether a change brings with it a fundamental change in the statutes will be decided by the Council with a two-thirds majority. Other amendments shall enter into force if they have been adopted by the Council by a two-thirds majority.
