336. Regulation of the Federal Minister for science, research and economy, modifies the pressure device regulation

On the basis of § 3 paragraph 3, 6, 19, 22 para. 1 and 24 of the boilers Act, Federal Law Gazette No. 211/1992, as last amended by the Federal Act Federal Law Gazette I no. 28/2012, is prescribed:

The regulation concerning pressure equipment (pressure device regulation - DGVO), Federal Law Gazette II No. 426/1999, is amended as follows:

1. in the title, the term "Federal Minister for Economic Affairs" is replaced by the designation "Federal Minister for science, research and economy".

2. the promulgation of clause is as follows:

"On the basis of § 3 paragraph 3, 6, 19, 22 para. 1 and 24 of the boilers Act, Federal Law Gazette No. 211/1992, as last amended by the Federal Act Federal Law Gazette I no. 28/2012, is prescribed:"

3. § 1 ABS. 1 is eliminated.

4. § 3 Z 3 to 6 is: "3 equipment in accordance with the directive of 2014/29/EC on the harmonisation of the laws of the Member States concerning the provision of simple pressure vessels on the market (recast) 1);

4. devices according to Directive 75/324/EEC on the approximation of the laws of the Member States relating to aerosol dispensers 2);

5. devices that are intended for the operation of vehicles, which are defined by the following directives and their annexes:-Directive 2007/46/EC establishing a framework for the approval of motor vehicles and their trailers, and of systems, components and separate technical units for such vehicles (framework directive) 3);

– Regulation (EU) No. 167/2013 on the approval and monitoring of the market of agricultural and forestry vehicles 4);

– Regulation (EU) No. 168/2013 on the approval and surveillance of two - or three-wheeled and four-wheeled vehicles of 5);

6 devices, which would be according to § 14 maximum under the category I and which are covered by one of the following rules:-Directive 2006/42/EC on machinery, and amending Directive 95/16/EC (recast) 6).

– Directive 2014/33/EC on the approximation of the laws of the Member States on lifts and safety components for lifts (recast) 7).

– 2014/35/EU directive on the harmonisation of legislation of Member States concerning the provision of electrical equipment designed for use within certain voltage limits on the market (recast) 8);

– Directive 93/42/EEC concerning medical devices 9);

– Directive 2009/142/EC of appliances burning gaseous fuels (codified version) 10).

6. in article 11, par. 1, 3 and 4, article 12, paragraph 1 and 3, article 13, paragraph 1, 2 and 3, § 17, § 19 para 2, 4 and 6, § 20 para. 3 and 5, article 21, para. 3 and 5, article 22, para. 3, 9, 10 and 10 lit. b the designation "Federal Minister for Economic Affairs" is replaced by the designation "Federal Minister for science, research and economy".

7 § 14 para 2 Nos. 1 and 2 is: "1 Group 1 includes substances and mixtures according to the definitions in article 2 paragraphs 7 and 8 of Regulation (EC) no 1272/2008 on classification, labelling and packaging of substances and mixtures, amending and repealing directives 67/548/EEC and 1999/45/EC and amending Regulation (EC) (No. 1907/2006 16)" , which are parts 2 and 3 of the regulation considered dangerous according to the following classification of physical hazards or health risks after annex I:-unstable explosive substances/mixtures or explosive substances/mixtures of subclasses of 1.1, 1.2, 1.3, 1.4 and 1.5.

-flammable gases category 1 and 2;

-oxidizing gases category 1;

-flammable liquids category 1 and 2;

-flammable liquids category 3, when the maximum permissible temperature above the flash point;

-flammable solids of category 1 and 2;

-self-reactive substances and mixtures of types A to F;

-pyrophoric liquids category 1;

-pyrophoric solids of category 1;

-Substances and mixtures, which in contact with water, emit flammable gases, category 1, 2 and 3;

-oxidizing liquids category 1, 2 and 3;

-oxidizing solids of category 1, 2 and 3;

-organic peroxides of types A to F;

-acute oral toxicity, category 1 and 2;

-acute dermal toxicity, category 1 and 2;

-acute inhalation toxicity, category 1, 2 and 3;

-specific target organ systemic toxicity - single exposure, category 1.

In addition, group 1 in pressure equipment includes contained substances and mixtures, the maximum permitted temperature is TS above the flash point of the fluid.

All substances not referred to in paragraph 1 and mixtures include 2 Group 2."

8 § 14 para 2 Z 1 corresponding footnote 16 is:

9. in article 21, paragraph 3, the phrase is "accreditation law - AkkG, Federal Law Gazette No. 468/1992" by the phrase "accreditation Act 2012 (AkkG 2012), Federal Law Gazette I no. 28/2012 in the amended" replaced.

10 section 24 the following paragraph 3 is added:

"(3) section 14 subsection 2 Nos. 1 and 2 in the version of regulation BGBl. II Nr 336/2014 enters into force on 1 June 2015."

11. According to § 25 the following section 26 together with heading is added:

"Implementation of legal acts of the European Union

section 26. This regulation following legal acts of the European Union are implemented: 1. Directive 97/23/EC on the approximation of the laws of the Member States relating to pressure equipment, OJ No L 181 of the 09.07.1997 p. 1, last amended by Regulation (EC) No. 1025/2012, OJ No. L 316 of the 14.11.2012 S. 12, and repealed with effect from the 19.06.2016 by the 2014/68/CE directive, OJ No. L 189 of the 27.06.2014 p. 164, and 2 Policy 2014/68/EC on the harmonisation of legislation of Member States concerning the provision of pressure equipment on the market (recast), OJ No. L 189 of the 27.06.2014 p. 164. In accordance with article 49 para 1 penultimate sentence of 2014/68/CE directive is pointed out that references to article 9 of Directive 97/23/EC apply from 1 June 2015 as references to article 13 of 2014/68/CE directive."
