44. Regulation of the Federal Minister for transport, innovation and technology, with which the regulation on the transmission of comprehensive planning and the construction of high-performance track State border at Kufstein - Innsbruck - border on the burner or parts thereof on the Brenner Eisenbahn GmbH (BE-Ü VO) is changed

Pursuant to section 3 of the Federal Act on the establishment of a "Brenner Eisenbahn GmbH", Federal Law Gazette No. 502/1995, in the version of Federal Law Gazette I is no. 32/2002 in consultation with the Federal Minister of finance prescribed:

The regulation of the Federal Minister for transport, innovation and technology through the transfer of the comprehensive planning and the construction of high-performance line border changed when Kufstein - Innsbruck - border on the burner or parts thereof on the Brenner Eisenbahn GmbH (BE Ü VO), Federal Law Gazette II No. 335/1997 in the version of regulation BGBl. No. 489/2001 II is as follows:

1. in the title, the phrase "of the Federal Minister for transport, innovation and technology" is replaced by the phrase "of the Federal Minister for transport, innovation and technology".

2. paragraph 1 section 1:



"(1) the Brenner Eisenbahn GmbH following planning or construction are transferred:"



(a) comprehensive planning in connection with the construction and planning the conservation of high performance distance part State border at Kufstein - Innsbruck region;

Planning time frame: four years; Planning budget: 58,138 million euro (price: 1 January 1996);

(b) the construction of the high-performance section Kundl/Radfeld Baumkirchen;

Construction time frame: six years from the building permit;

(c) the implementation of preparatory measures for the comprehensive planning of the construction and the principle design of the high performance lines part space Innsbruck - State border at Brenner (Brenner base tunnel) as a member of the European economic interest grouping;

Planning time frame: two years; Planning budget: 8,357 million euro (price: 1 January 1999);

(d) the comprehensive planning of the construction of the high-performance lines part space Innsbruck - State border at Brenner (Brenner base tunnel) as a member of the European economic interest grouping;

Planning time frame: three years; Planning budget: 45 million euros (price: 1 January 2002).

The budget for the under lit. b listed building measures is set to train legal construction approval."

3. § 3 par. 2 to 4 are:



"(2) the extent of preparatory measures for the comprehensive planning of the construction and the principle design of the high performance lines part includes space Innsbruck - State border at Brenner (Brenner base tunnel) as a member of the European economic interest grouping:"



1. adjustment and updating of the "feasibility study Brenner base tunnel" in geological, technical and economic terms, unless in the meantime new findings available since their creation;

2. creation of a network of surveying (geodetic benchmark network) in the project area;

3. planning and implementation of the first phase of exploration work as the basis for the to planning and the preparation of a technical concept for the further investigation work and estimate;

4. creation of an overall concept for the implementation of all planning activities and other tasks relating to the construction of the Brenner of base tunnel.

(3) the extent of the comprehensive planning of the construction of the high-performance lines part space Innsbruck - State border at Brenner (Brenner base tunnel) as a member of the European economic interest grouping includes:



1. addition and completion of the exploration work;

2. all planning measures must be completed high-performance lines act before issuing a regulation according to § 3 para 1 (such as E.g. the creation of documents necessary in the framework of an environmental impact assessment under the environmental impact audit Act);

3. all planning measures which make it possible that the granting of railway-legal building permit and other permits necessary for the execution of the construction can be obtained on its foundations;

4. acquire of the necessary rights on land, as far as this is reasonable and necessary already during the planning in regard to the assurance of the line for this part of the high-performance lines;

5. deepening and complement the studies to the concessions and financing models.

(4) the construction design for the design of railway technical equipment, as well as for the construction and engineering works is to build on the documents referred to in paragraphs 1 and 3. Insofar as the rail-technical equipment to such backup, traction power and telecommunications, the detailed planning of the Austrian federal railways are to be included. "
