Law 27347

Amendment.

The Senate and Chamber of Deputies of the Argentine Nation, meeting in Congress, etc., are sanctioned by law:

Article 1-Amend article 84 of the Penal Code, which is worded as follows: Article 84: It shall be repressed with imprisonment of one (1) to five (5) years and special disablement, if any, for five (5) to ten (10) years for Recklessness, negligence, impermeability in your art or profession or non-observance of the regulations or duties in your charge will cause another death. The minimum penalty will be raised to two (2) years if more than one fatal victims.

ARTICLE 2 °-Incorporate as Article 84a to the Penal Code, which shall be worded as follows: Article 84a: It shall be repressed with imprisonment of two (2) to five (5) years and special disablement, if any, by five (5) to ten (10) years That the reckless, negligent or anti-regulatory driving of a motor vehicle will cause another death. The penalty shall be in prison for three (3) to six (6) years, if any of the circumstances provided for in the preceding paragraph were given and the driver was on the run or did not attempt to assist the victim as long as he did not incur the intended conduct. in Article 106, or under the effects of narcotic drugs or with a level of alcoholemia equal to or greater than five hundred (500) milligrams per litre of blood in the case of drivers of public transport or one (1) gram per litre of blood in the other cases, or driving in excess of speed of more than thirty (30) kilometers above the maximum permitted at the place of the event, or if it is being disabled to do so by competent authority, or shall violate the signalling of the traffic light or the signs of transit indicating the direction of vehicle traffic or when the traffic signals are circumstances provided for in Article 193a, or with a reckless fault, or where more than one of the fatal victims is involved.

Article 3-Amend article 94 of the Penal Code, which will be worded as follows: Article 94: Prison shall be imposed from one (1) month to three (3) years or a fine of one thousand (1,000) to fifteen thousand (15,000) pesos and special disablement for one (1) to four (4) years, the one who, by recklessness or negligence, by impropriety in his art or profession, or by non-observance of the regulations or duties to his office, will cause another harm in the body or in the health. If the injuries are described in Articles 90 or 91 and are more than one of the injured victims, the minimum of the penalty provided for in the first subparagraph shall be six (6) months or three thousand fine.

ARTICLE 4 °-Incorporate as article 94 bis of the Penal Code, which is worded as follows: Article 94 bis: It shall be repressed with imprisonment of one (1) to three (3) years and special disablement by two (2) to four (4) years, if the Injuries to Articles 90 or 91 are caused by the reckless, negligent or anti-regulatory driving of a motor vehicle. The penalty shall be two (2) to four (4) years in prison if any of the circumstances provided for in the preceding paragraph are verified and the driver is on the run, or shall not attempt to assist the victim as long as he does not engage in the conduct provided for in Article 106, or under the effects of narcotic drugs or with a level of alcoholemia equal to or greater than five hundred (500) milligrams per litre of blood in the case of drivers of public transport or one (1) gram per litre of blood in other cases, or was driving in excess of speed of more than thirty (30) kilometers above the maximum allowed at the place of the event, or if it is being disabled to do so by competent authority, or shall violate the traffic light signalling or the traffic signals indicating the direction of traffic, or when the traffic lights are circumstances provided for in Article 193a, or with a reckless fault, or where more than one injured victim is involved.

ARTICLE 5-Amend Article 193a of the Penal Code, which shall be worded as follows: Article 193 a: It shall be repressed with imprisonment of six (6) months to three (3) years and special disablement to drive for twice the time of the conviction, the driver who will create a situation of danger to the life or physical integrity of the persons, by means of participation in a test of speed or skill with a motor vehicle, carried out without the proper authorization of the competent authority. The same penalty shall apply to the person who will organize or promote the conduct provided for in this article, and to whom he will make it possible to carry out a third party through the delivery of a vehicle with motor of his property or entrusted to his/her custody, knowing which will be used for that purpose.

ARTICLE 6-Commune to the national executive branch.
