Amendments. Sanctioned: November 14, 2012 Enacted: December 11, 2012

The Senate and Chamber of Deputies of the Argentine Nation, meeting in Congress, etc., are sanctioned by law:

Article 1-Substitute the points 1 and 4 of Article 80 of the Penal Code which shall be drawn up as follows:

Article 80: Imprisonment or perpetual imprisonment may be imposed, the provisions of Article 52 may be applied, to which I shall kill: 1 °. To your ascendant, descendant, spouse, former spouse, or to the person with whom you maintain or have maintained a relationship of partner, I will mediate or not to live. 4 °. For pleasure, greed, racial, religious, gender, or sexual orientation, gender identity or expression.

ARTICLE 2-The following texts: 11 and 12 of Article 80 of the Penal Code. To a woman when the fact is perpetrated by a man and I will measure gender violence. 12. For the purpose of causing suffering to a person with whom a relationship has been maintained or maintained in the terms of paragraph 1.

Article 3-Substitute Article 80 in the fine of the Criminal Code, which shall be worded as follows: Where in the case of paragraph 1 of this Article, in exceptional circumstances of attenuation, the judge may apply imprisonment or seclusion from eight (8) to twenty-five (25) years. This will not apply to those who had previously carried out acts of violence against the female victim.
