RIGHT OF ACCESS, AMBULATION AND PERMANENCE

Persons with disabilities accompanied by Guide or Assistance Dog. Sanctioned: May 22, 2013. Enacted: June 10, 2013.

The Senate and Chamber of Deputies of the Argentine Nation, meeting in Congress, etc., are sanctioned by law:

Chapter I

General provisions

ARTICLE 1-Object. The purpose of this law is to ensure the right of access, ambulation and permanence to public and private places of public access and to public transport services, in its various forms, of any person with disabilities, accompanied by by a guide or assistance dog.

ARTICLE 2-Exercise. The exercise of the right of access, ambulation and permanence consists in the constant presence of the dog guide or assistance accompanying the person with disabilities.

ARTICLE 3-Gratuity. The access, wandering and permanence of the dog guide or assistance to the places mentioned in article 1 does not cause any additional expense for its user.

Chapter II

Dog for assistance

ARTICLE 4 °-Definition of guide or assistance dog. Is considered a guide or assistance dog who after overcoming a selection process, successfully completes its training, for the accompaniment, conduction, help and alert of persons with disabilities and obtain the certificate that so credit him. The certificate may be extended by a national or international institution officially recognised or approved by the implementing authority.

ARTICLE 5-Enabling. In order to exercise the rights set out in Chapter I, the user must have a credential and a badge issued by the implementing authority for which it shall be:

(a) to ensure compliance with the certificate referred to in Article 4. (b) to ensure compliance with the hygiene and health conditions referred to in Article 8. c) Identify the person with a user's disability guide or assistance. In the case of persons who are users of dog guides or non-resident assistance in our country, it will only be necessary to exhibit certificates and certificates issued by their country of origin and authenticated by consular representation.

ARTICLE 6 °-Identification. Each guide or assistance dog must be identified, by placing in place and visible form of the corresponding official flag. The certificate issued may be required only by the competent authority or by the person responsible for the place or service he/she is using.

ARTICLE 7-Obligations. The guide or assistance dog must be subject to a strap or harness with metal handle or other element of a similar function, the use of the muzzle being not mandatory. The user-enabled user must use the guide or assistance dog for those functions for which he has been trained. The entitled user will be liable for any damage the animal may cause to his or her charge.

ARTICLE 8-Sanitary and sanitary conditions. Guide or assistance dogs must comply with the hygienic and sanitary conditions laid down for domestic animals in general and in particular for their function as a guide or assistance dog, in addition to the following: (a) diseases communicable to man, understood by those diseases included in the table of anthropozoonoses in force at any time. (b) comply with the vaccination schedule, periodic treatments and diagnostic tests to be established by the implementing authority. Compliance with the hygiene and health conditions provided for in this Article must be certified annually by certification issued by the veterinary exercise.

ARTICLE 9 °-Loss of the rating. The person who is a guide or assistance dog will lose his or her qualification for any of the following reasons: 1. 2. To stop being linked to a guide or assistance dog. 3. For non-compliance with the hygiene and health conditions laid down in Article 5 (b). 4. For damage to persons or property caused by the dog guide or assistance according to the guidelines established for them by the regulations. The loss of the rating shall be declared by the same body as the one.

ARTICLE 10. -Mode of the exercise. The exercise of the rights set out in this law in relation to the transport of public or private passenger use is subject to the following characteristics of accessibility and removal of barriers: (a) The person with disabilities is accompanied Guide or assistance dog has preference in the reserve of the most suitable seat, with greater free space in its surroundings or adjacent to a corridor, according to the means of transport in question. Chapter III

Public places

ARTICLE 11. -For the purposes of Chapter I of this Law, public and private places of public access shall be understood as: (a) gastronomic establishments, commercial premises, public and private sector offices, places of leisure and free time, sports and cultural centres, public or private educational establishments, religious establishments, health centres and care facilities. (b) any public or private passenger transport, in its various forms, and the areas reserved for public use in the relevant terminals or stations using the different means of transport mentioned. c) Hotel establishments, hostels, camps, bungalows, apartments, spas, campsites and establishments in general intended to provide, by price, room or residence to persons, as well as any other places open to the public in which services are provided directly related to tourism. d) In general, any other place, local or public establishment and private public access.

Chapter IV

Sanctions

ARTICLE 12. -Penality. Those who in any way prevent, obstruct or restrict the enjoyment of the rights established in this law shall be punished in accordance with the provisions of Law 23592 and its amendments.

Chapter V

Final provisions

ARTICLE 13. -Authority of implementation. The national executive branch shall designate the implementing authority. The Autonomous City of Buenos Aires and the provinces will act as local enforcement authorities exercising the control, monitoring and enforcement of this law and its regulatory norms regarding alleged violations committed in its respective jurisdictions.

ARTICLE 14. -Training centers. The implementing authority will promote the creation of training centers with national, provincial and municipal bodies that have areas compatible with canine training.

ARTICLE 15. -Users and users of existing guide or assistance dogs must comply with the recognition and identification requirements provided for in this law.

ARTICLE 16. -Regulations. This law must be regulated within one hundred

Eighty (180) days from its enactment.

ARTICLE 17. -Accession. I invited the provinces and the Autonomous City of Buenos Aires to adhere to the provisions of this law.

ARTICLE 18. -Contact the national executive branch.
