SOLVENTS organic volatile solvents organic volatile Law 26.968 prohibited the sale, dispensing or supply of certain products to minors. Adopted: 6 August 2014 fact promulgated: August 27, 2014 the Senate and Chamber of deputies of the Argentina nation gathered in Congress, etc. they attest to the force of law: article 1 ° - is prohibited the sale, dispensing or supply any title to minors of age, adhesives, glues, contact cements, sealants or similar, containing in its formulation more than ten percent (10%) w/w (weight by weight) solvent organic volatile likely to be inhaled to cause psychoactive or mind-altering State. For the purposes of this Act are considered solvent organic volatile likely to be inhaled to cause effect psychoactive or mind-altering State the solvents listed in Annex A which forms part of this law, and that in the future are incorporated by resolution of the Ministry of health of the nation.
Article 2 ° - adhesives, glues, contact cements, sealants or similar only be marketed when they have the prior registration in a register (1) which will be led by the Ministry of industry of the nation, which will issue the corresponding certificate of registration.
Article 3rd - at the time of registration, the national enforcement authority must point to the registry if the product subject to registration contains more than ten percent (10%) of solvents organic volatile.
Article 4 ° - for the purposes of the registration established in article 2 of this law, it shall attach labels proposed for the product, the type of container that will be marketed and an affidavit in which should be informed, correspond, the percentage of solvents organic volatile to owning the product, the type of solvent and the percentage amount contained. On the label of the container must indicate that it is registered in compliance with this policy by means of the phrase: "Registered in the Ministry of industry product", the number of the certificate of registration and the number of the present law. Adhesives or sealants containing in its formulation more than ten percent (10%) of solvents organic volatile indicated in Annex A of the present, shall enter in its packaging: to) legends: "Sale prohibited to minors under eighteen (18) years", "inhalation can cause irreversible damage to health"; (b) the form of application of the product;

Them manufacturers or importers of those products covered in this law will be them responsible of meet them forecasts of the present article. Traders who sell the products covered by article 1 of the present, must see in your banner holding the phrase "Product registered in the Ministry of industry of the nation", the number of the certificate of registration and the number of the present law.
Article 5 ° - for those presentations equal to or greater than five (5) kg or five (5) liters of the product coverage in article 1 of this law, sold in premises having wholesale retail dealer shall be obliged: to) retain for the purposes of supervision by the enforcement authority, the documentation that accredits your purchase , which will include the quantity and brand of the product, date of the purchase and data of the supplier; (b) keep for the purposes of supervision by the enforcement authority, the documentation that accredits the sale, which will include the amount and date of sale, product brand, data of the buyer and signature, as well as the data of the individual who took part in the operation; (c) keep a layered and initialled with the data referred to in the preceding paragraphs.
Article 6 ° - remains prohibited the sale, dispensing or supply any title of products covered by article 2 of this law, in fractional form of the original container registered in the Ministry of industry of the nation.
Article 7° - the sanctions for non-compliance with this Act and regulations which, in consequence, handed down, without prejudice to the other responsibilities that may be applicable, shall be as follows: to) pesos fine five hundred ($ 500) to 50,000 pesos ($ 50,000); (b) closure of the establishment for a maximum of thirty (30) days; (c) closure of the establishment for a maximum of two (2) years in case of recidivism if the offender has previously been punished on two (2) occasions, with temporary closure; (d) disqualification to manufacture, import or sell products covered by article 1 for a maximum of two (2) years; (e) confiscation of infringing goods. These sanctions shall apply prior procedure summaries in the jurisdiction where the offence was carried out and shall be governed by the rules of administrative procedure corresponding, ensuring due process of law, adequate judicial review, and will graduate according to the gravity of the infringement and the extent of the breach. The proceeds from the fines imposed by the national enforcement authority will go to the Secretary of programming for the prevention of drug addiction and fight against drug trafficking.
Article 8 ° - will control authority and the sanctions provided for in this law, the national or local authority concerned as the jurisdictional scope in to develop the activity subject to control.
Article 9 ° - manufacturers, importers and marketers of products covered in article 2 ° will have a period of one (1) year from the entry into force of this Act to comply with the obligation arising from article 4.
