University of National Defense. Creation. Sanctioned: November 12, 2014 Enacted: December 02, 2014

The Senate and Chamber of Deputies of the Argentine Nation, meeting in Congress, etc., are sanctioned by law:

Article 1-Create the National Defense University (UNDEF), which will have its headquarters in the Autonomous City of Buenos Aires, and a national action area.

Article 2 °-The National Defense University will be governed for its constitution, organization and operation as the integral framework of the current regulations in the field of Higher Education and National Defense.

ARTICLE 3-The National Defense University will be responsible for the training of military and civilian personnel, in different disciplinary areas, and military training for National Defense through undergraduate, graduate and graduate careers. It will carry out its activities in a cooperative manner, articulated and integrated with the national university system, without generating duplicity of efforts and at all times trying to exploit the national university experience.

Article 4 °-The National Defense University will operate in the field of the Ministry of Defense of the Nation and will be constituted on the basis of the University Institutes that currently operate in the orbit of the Ministry of Defense of the Nation and the Armed Forces. The national executive branch, through the Ministry of Defense, will implement the transfers to UNDEF, through agreements and other legal tools, of the educational services of such institutions and the budgetary appropriations. The Ministry of Education and the Ministry of Education, with the exception of the salaries of the military personnel assigned to the educational institutions of the University Institutes of the Armed Forces. The mechanisms for the continuity, graduation and certification of students will also be ensured, without prejudice to changes in educational plans and regimes to which there is a new institution.

Article 5 °-The implementation of the National Defense University will not affect the situation of the journal of the civil, teaching and non-teaching staff, transferred to the university, with the recognition of seniority and equivalence in the functions in the conditions determined by the rules currently governing the specific work activity.

Article 6-Military personnel assigned to the transferred institutions will continue to perform these functions at the University, according to the Ministry of Defense and the Major States of each of the Armed Forces. The Staff Regulations shall regulate the procedures for the provision of services of military personnel in activity at the university, ensuring that the positions of the educational institutions for the initial training of officers and non-commissioned officers, and of the Command and General Staff, specific and joint, will be performed by senior officers belonging to the respective Forces.

Article 7 °-For the purpose of conducting the process of formulating the institutional project of the UNDEF and the draft provisional Statute, the national executive branch, through the Ministry of Defense, will designate one (1) Organising Rector.

ARTICLE 8-UNDEF shall have academic and institutional autonomy under the arrangements set out in Article 2 of this Law. The UNDEF Statute must provide for its governing bodies, both collegial and unipersonal, as well as its composition and powers, and must ensure: (a) The constitution of the Governing Board as a higher governing body, which shall be chaired by the Minister of Defense who will take the resolutions with the advice of the other members. The Board of Directors of the Ministry of Defense, the Rector of UNDEF, the Chief of the Joint Chiefs of Staff of the Armed Forces, and the Chiefs of Staff of the Army, the Air Force and the Navy; b) of the Advisory Board of Management to be chaired by the Rector and who will integrate: one (1) representative for each of the Armed Forces and one (1) for the Joint Chiefs of Staff of the Armed Forces, the Dean and the academic management authorities that the (c) The constitution of the Advisory Council consisting of 11 (11) members appointed by the national executive branch on a proposal from the following bodies: three (3) by the National Interuniversity Council; one (1) by the Ministry of Defence; one (1) by the Ministry of Education; one (1) by the Ministry of Science, Technology and Productive Innovation; one (1) by the Joint Chiefs of Staff; and the presidents of the Defense and Education committees of the Honorable Chamber of Deputies of the Nation and the Honorable Chamber of Senators of the Nation respectively. It will have the main function to monitor and guarantee the democratic and republican conception in the plans and programs of study; the quality, the plurality of ideas and the diversity of criteria in the design and implementation of the substantive functions of the university; the relevance and relevance in the military training and in the training of civilians for the defense.

Article 9-Budget items for the creation and operation of UNDEF will arise from the corresponding reallocations of the national executive branch in the current national budget, and of the items allocated in the tax year following the penalty of this law.
