The Senate and Chamber of Deputies of the Argentine Nation assembled in Congress, etc., sanction with force of law:

Article 1 - Amend Decree-Law 16.767, dated 11 September 1956, approving the Statute of Teachers of the Ministry of Education and Justice, as follows:

STATUS OF THE DOCENT MINISTERY OF EDUCATION AND JUSTICE

PART I

General provisions

Article 1 - For the purposes of this Act, a teacher is considered, who imparts, directs, supervises or guides general education and systematized education, as well as a person who collaborates directly in these functions, subject to pedagogical norms and regulations of this statute.

(Note Infoleg: Article 2 of the Act No. 19,891 B.O. 23/10/1972. the incorporation of the basic assignment by state of education, the assignment by office, in the monthly retribution of staff from all branches of education, does not modify the status of teachers in this article.

Article 2 - The present law determines the duties and rights of teaching staff serving in agencies under the Ministry of Education and Justice.

CHAPTER I

Teaching staff

Art. 3o ­ The teaching staff acquires the duties and rights set forth in this law from the time they take over the function for which they are appointed and may be found in the following situations:

(a) Activate. It is the situation of all staff performing the specific functions referred to in article 1 and staff in the use of leave or in the availability of pay;

(b) Passive: It is the situation of staff in the use of leave or in unpaid availability; of which it performs functions not covered by article 1; of those for auxiliary functions for loss of their conditions for active teaching; of which it is serving military service and of teachers suspended under administrative summary or judicial process. (c) Withdrawal. This is the situation of retired staff.

Art. 4o The duties and rights of teaching staff are waived:

(a) By an accepted waiver, except in the case where the retirement benefit is presented;

(b) For cesanty;

(c) Exoneration.

CHAPTER II

The duties and rights of teachers

Art. 5o ¬ These are the duties of the teaching staff, without prejudice to those establishing the laws and general decrees for the civil personnel of the Nation:

(a) Decently, effectively and loyally perform the functions inherent in your office;

(b) Educate students in the democratic principles and in the form of government established in our National Constitution and in the laws dictated accordingly, with absolute partisan freedom;

(c) Respect technical, administrative and disciplinary jurisdiction, as well as the hierarchical route;

(d) Observe conduct in line with the educational function and not engage in activities that affect the dignity of teachers;

(e) Expand your culture and promote the improvement of your pedagogical capacity;

(f) Comply with timetables that correspond to passive functions.

Article 6: The rights of the teacher, without prejudice to those who recognize the laws and general decrees for the civil personnel of the Nation:

(a) The stability in the position, in the category, hierarchy and location, which can be modified only by resolution adopted in accordance with the provisions of this statute;

(b) The enjoyment of fair remuneration and retirement, updated annually, in accordance with the requirements of this statute and the laws and decrees establishing the form and manner of its updating;

(c) The right to promotion, increase of weekly classes and transfer, without more requirement than their professional background and the results of the competitions established for each branch of education;

(d) The change in primary or subject functions in other areas of education, without lower retribution in the event of a decrease in or loss of abilities due to causes that are not attributable to it. This right is acquired to the ten years of teaching services, computed the supplements and extinguished by achieving the necessary conditions for obtaining retirement;

(e) The knowledge of the background of the applicants, and of the payrolls made according to the order of merits, for appointments, promotions, increments of weekly and permutas;

(f) The concentration of tasks;

(g) The exercise of their activity in the best pedagogical conditions of premises, hygiene, teaching materials and number of pupils;

(h) Recognition of the needs of the family nucleus;

(i) The enjoyment of the statutory holidays;

(j) Free aggression for the study of educational problems and the defence of their professional interests;

(k) Participation in the school government, in the classification and discipline boards;

(l) A year of paid leave in all its posts and every ten years in the course of the teaching, in order to conduct further studies in accordance with the respective regulations. Graduate leave when obtaining scholarships;

(m) The defence of their legitimate rights and interests, through the actions and resources that this statute or laws and decrees establish;

(n) Social assistance and its participation, by choice, in the government of the same;

(in) The exercise of all political rights inherent in their citizenship status.

CHAPTER III

Function, category and location of establishments

Art. 7o ­ The agencies that govern the various branches of education shall classify the educational establishments:

I. By stages and types of study in:

(a) Higher education institutes;

(b) Average and differentiated educational establishments;

(c) Primary schools.

II. By the number of students, grades, divisions or specialties, in:

(a) First category;

(b) Second category;

(c) Third grade.

III. By its location, in:

(a) Urban;

(b) Outside urban radio;

(c) Unfavorable location;

(d) Very unfavourable location.

It shall also fix the functional organic plant of each establishment, in accordance with the provisions of this statute, except the primary branch.

CHAPTER IV

Scaffolding

Art. 8o ­ The teaching scale is determined in the different branches of the teaching, by the hierarchical degrees resulting from the functional organic plant, corresponding to the technical divisions and the respective educational establishments.

CHAPTER V

From the classification boards

Article 9 The Ministry of Culture and Education and the National Councils for Education and Technical Education shall constitute permanent bodies known as the classification boards that shall perform the functions provided for in this statute and its regulation, with regard to the teaching staff of the agencies and establishments of their respective units - except that of the institutes of teacher training. They will be composed of 5 active teachers, 3 of whom will be elected by the secret and compulsory vote of the teaching staff. They will last 4 years and cannot be re-elected for the next period. In each election, 9 alternates (6 by the majority and 3 by the minority) shall be elected, which shall be automatically incorporated into the respective classification board in cases of the absence of the holder or vacance of the position. The other 2 teachers will be appointed by the Ministry of Culture and Education or by the National Councils of Education or Technical Education, as appropriate; they will last 2 years in their posts and may be re-appointed. They will also be appointed 4 alternates who will automatically join the board in accordance with the designation order, in cases of absence of the incumbent or vacance of the position. In order to integrate the classification boards, an antiquity will be required in teaching not less than 10 years, of which not less than 5 must be the holder of education and have a teaching degree in the conditions required by article 13. The election shall be made to the simple plurality of suffrages, with 2 representatives to the list that has obtained the greatest number of votes and a representative to which he is following. In the event of a single list, or that the votes obtained by the second-place list do not reach 10% of the total votes obtained by the winning list, the three counts will be awarded to the candidates. The elect shall enter by order of list, be holders or alternates and the votes shall be computed by list not using the tachas. In the jurisdiction of the National Education Council, classification boards shall be constituted in the same number as that of seditional inspections or electoral school districts and in the other jurisdictions by areas according to their needs. They should have the administrative staff required to be set in the budget law. Teachers who are members of the classification and discipline boards shall not be eligible to contest or register for internships and supplements while in exercise of their duties; they shall apply for leave with pay in the position to be performed and shall be compensated by a fixed monthly amount equivalent to 4 times the rate set for the teaching status. This compensation will be computable for the purposes of retirement.

Art. 10. The classification boards will be in charge:

(a) The review of staff history and the classification of staff by merit order, as well as the control, maintenance and custody of the relevant legages;

(b) Formulate the payrolls of candidates for admission, increase of weekly, internship and supplemental classes;

(c) Dictamine in requests for transfers, permits and reinstatements;

(d) Consider the request for stay in activity of teachers who have fulfilled the conditions required for regular retirement;

(e) Pronunciate in scholarship applications;

(f) Designate a member of the jury and propose to the contestants a list of which they will choose the remaining ones. In the event of disagreement with the resolutions of the classification board, the teacher may lodge a remedy of replenishment before the classification board and an appeal in subsidy to the superior authority of the respective branch of education. It may also use the right of recusal with cause in the manner in which it will determine the regulation of the law.

Art. 11. The classification boards will give the widest publicity to the lists, by order of merit of applicants for admission, increase of weekly classes, to promotions, transfers, internships and supplements.

CHAPTER VI

From the teaching career

Art. 12. ∙ Income to the teaching career shall be carried out by the lower rank of the respective scalfron, except for cases explicitly excepted in each branch of the teaching by this statute.

CHAPTER VII

From admission to teaching

Art. 13. The following general and concurrent conditions must be met in order to enter into the teaching by the way this statute and its regulations establish:

(a) Being native Argentine, by choice or naturalized. In the latter case have at least five years of continued residence in the country and dominate the Spanish language;

(b) To possess the physical capacity and morality inherent in the educational function;

(c) Having the appropriate national teaching;

(d) To possess the national title corresponding to the specialty, when it comes to providing subjects or posts for which there are teacher training establishments;

(e) Having an official professional, university or secondary technical degree, or certificate of professional training in accordance with the respective specialty, whether it is to provide subjects or technical-professional positions or practical activities of cabinet, laboratories, industrial and workshop plants in the establishments in which industrial, commercial, professional and professional education of women is provided;

(f) In higher education, possess the qualifications and backgrounds established by the regulation of each institute;

(g) Request entry and submit to the competitive examinations established by this statute. (Note Infoleg: By art. 5o Decree No. 2540/77 B.O. 6/9/1977, the present subparagraph (with the exception of the maximum hours established for the increase of hours) is suspended only to the effect of the provisions of articles 1 and 2 of that Decree.

Art. 14. . Can be entered into the teaching with professional technical qualifications of the matter or conform to the cultural and technical content of the subject;

(a) Where there is no national teaching course or post issued by teacher training establishments;

(b) When two successive deserts are declared to be called to contest for this subject or charge;

(c) In higher education, with scientific, artistic and teaching degrees or backgrounds of notorious significance.

(Note Infoleg: By art. 5o Decree No. 2540/77 B.O. 6/9/1977, this article is suspended (with the exception of the maximum number of hours established for the increase of hours) only to the effect of the provisions of articles 1 and 2 of the Decree).

Art. 15. ∙ Thereafter, no authorizations, qualifications, qualifications or endorsements shall be granted for the exercise of primary, secondary, normal, artistic, superior, commercial, industrial, professional of women and trades, and for those subjects and positions for which there are specific teaching degrees granted by teacher and teacher training institutes, with the exception of those legally recognized by agreements signed with provincial or foreign governments.

Art. 16. When no applicants are presented under the conditions laid down in articles 13, subparagraphs (c), (d) and (e), and 14, the regulation shall determine the manner of checking the suitability of candidates.

Art. 17. The regulation shall determine, with a restrictive criterion, the enabling and supplemental titles referred to in articles 13, subparagraph (e), and 14.

CHAPTER VIII

From the time of appointments

Art. 18. ∙ The designations of teaching staff shall be made for two fixed periods in the year.

CHAPTER IX

Of stability

Art. 19. ∙ Teachers under this statute shall be entitled to stability in office as long as their good conduct lasts and preserves the moral conditions, teaching efficiency and physical capacity necessary for the performance of their assigned functions.

Art. 20. When for reasons of change of curriculum or closures of schools, courses, divisions, grade sessions, subjects or educational posts are abolished and the incumbents must be made available, this will be paid. The superiority will proceed to give it a new destination, with the intervention of the respective classification board, which will take into account its qualification of teaching or professional technician and the shift in which they operate;

(a) In the same establishment or in the same location;

(b) In another location, with the consent of the person concerned.

The well-founded disqualification gives the teacher the right to remain up to one year in availability with pay, and another year in availability without pay, which shall be deemed to be a ceaser in office.

During these two years you will have priority to fill vacancies in the area.

CHAPTER X

Qualification of teachers

Art. 21. . Each teacher, holder, interim or alternate, the establishment or senior officer shall carry a personal legajo of performance, in which the information necessary for his or her qualification shall be recorded. The person concerned shall have the right to know all the documentation contained in the file, to challenge it in his or her case and/or to require it to be supplemented if he or she warns of omission, and to carry a duly authenticated duplicate.

Art. 22. The qualification will be annual, will appreciate the conditions and skills of the teacher, will be based on the objective records of the legajo and will conform to a scale of concepts and their correlative numerical valuation. In the event of disqualification, the person concerned may lodge a replenishment appeal against the classification board within 10 days of notice.

The synthesis of the documentation referred to in this chapter and, where appropriate, the additional data required will be uploaded annually to the classification boards.

CHAPTER XI

Teaching improvement

Art. 23. The school authorities will encourage and facilitate the technical and professional overcoming of the teaching staff in practice through training courses and scholarships for studies and research in the country and abroad.

CHAPTER XII

Promotions

Art. 24. The promotions will be:

(a) Location: those who determine the transfer of a teacher to a better located establishment or more favorable location;

(b) Category: those promoting staff, at the same level, to a higher level;

(c) Hierarchy: those who promote a higher degree.

Art. 25. Any promotion shall be made by competition of titles and backgrounds, to which evidence of opposition shall be added in the cases expressly indicated in this statute.

Art. 26. ∙ Teachers shall be entitled to promotions set out in this chapter provided that:

(a) Revises the status of article 3 (a) of active service;

(b) It has deserved synthetic concept not inferior to "very good" in the last two years;

(c) Gather the other conditions required for the provision of the vacancy to which it aspires.

Subparagraph (b) shall not rule when the open contest is declared desert for the provision of the respective charge or when it is concerned to provide charges in single-staff schools of very unfavourable or unfavourable location.

Art. 27. The promotions to management and inspection posts shall be made by qualifications, background and opposition, as provided for in the provisions of each branch of education.

Art. 28. The jurors referred to in this statute shall be appointed taking into account the specialization and hierarchy of the charge to be filled; they shall be composed of an odd number of members not less than three, one by the classification boards and the remaining by direct choice of the contestants, immovable until they produce dispatches and shall be issued within the time period established in the act of their designation. The number of jurors may not be altered later to their constitution.

CHAPTER XIII

From permutas and transfers

Art. 29. ∙ Teachers in an active or passive situation, except in availability, have the right to apply, permut, for their change of destination, which may be made effective at any time, less in the last two months of the school year.

It is permutable to the change of destination in positions of equal rank, denomination and category between two or more staff members.

Art. 30. ∙ Teachers may request a transfer for reasons of health, the need for the family nucleus or other reasons duly justified. If you do not mediate such reasons, you can only do so when at least two years have elapsed since the last change of location to your order. The classification boards shall dictate favourably or not, taking into account the reasons given and the background of the applicants. If a transfer to a post is requested for the performance of which the necessary qualifications, seniority or background may be made effective in another of less hierarchy or category.

Art. 31. The teaching staff who have served for three years in unfavourable or highly unfavourable location schools shall have priority, by order of seniority, for their transfer to better-located schools, except when the person concerned, with an average concept not less than "good", resigns to that right. If the person concerned does not have the qualification, antiquity or prioritization required for the charges to which the person is requested to be transferred or permutes, they shall be held in lower ranks.

Art. 32. Transfers, except those covered by the provisions of article 20, shall be made twice a year in advance of the dates set for appointments.

Art. 33. ∙ Staff without an enabling title may only apply for transfer to more favorable locations after ten years of service or five years since the last time the number of weekly classes has increased, provided that their concept is not less than "good".

CHAPTER XIV

Of the reinstatements

Art. 34. The teacher who requests his return to active service may be reinstated whenever he has exercised at least five years, with an average concept not less than "good" and preserves the physical, moral and intellectual conditions inherent in the function to which he aspires. This benefit does not reach those who have obtained the ordinary retirement and those who request it fulfilled the age established by the laws for the final retirement.

CHAPTER XV

Vacancy destination

Art. 35. ∙ Pre-position of staff on availability, in accordance with the rules of article 20, the annual vacancies in the jurisdiction of each classification board shall be for the following purposes:

(a) Transfers for reasons of health, needs of the family nucleus, concentration of tasks or other duly founded reasons;

(b) Income and accumulation of charges at the primary level;

(c) Increasing weekly classes, entering and accumulating middle-level charges;

(d) Ascense;

(e) Reinstatement.

The regulation shall set the respective percentages.

CHAPTER XVI

Remuneration

Art. 36. The monthly retribution of the teaching staff in activity consists of:

(a) Assignment by office;

(b) Bonus by antiquity;

(c) Location bonuses, differentiated function and regular length of the day.

The bonuses in subparagraphs (b) and (c) shall be calculated on the assignment by the post.

Art. 38. - Annually the Executive will establish the monetary value of the index.

Art. 40. Teachers in activity, regardless of the degree or category in which they are, shall receive bonuses per year of services, according to the percentages determined on the following scale:

These bonuses will be determined taking into account the total seniority in teaching and will govern from the month following the date on which the terms set for each period are met.

Art. 41. ∙ All non-conmultaneous teaching services are considered cumulative for the purposes of antiquity bonuses, in accordance with the definition of article 1, duly certified, provided in national, provincial or municipal jurisdiction, or in establishments adscribed to official education.

Art. 42. ∙ Licensing and availability of pay or unpaid leave granted for further development and exercise of legislative mandate do not interrupt continuity in services.

Art. 43. The location bonuses applied on the charge will be determined on the following scale:

Art. 44. Teachers shall enjoy family assignments on an equal basis to the civil staff of the Nation.

Art. 45. ∙ For each branch of education, rates will be allocated for the salary of each post performed by the teaching staff.

Indices relating to each function are set under the corresponding titles.

Art. 46. For each branch of the teaching, in addition, under the relevant titles, the indexes for bonuses in terms of differentiated function and the usual prolongation of the day.

Art. 47. The position of general director in the middle, technical and artistic branches is a teacher.

Art. 48. Directors and rectors; deputy directors and vice-rectors; rules and general masters of practical education; subregulars, secretaries, prosecretaries and district secretaries; pre-primary, primary, medium, technical, superior and artistic education may accumulate up to 12 (12) hours of chair or equivalent. Precited positions of equal or different categories are not cumulative to each other at any level of education.

Art. 49. ∙ Senior managers in charge of general education services and inspection staff of all branches of education who perform exclusively without accruing to other posts rented in the official order or in private educational establishments shall be over-assigned.

Art. 50. ∙ For the purposes of the application of the provisions set out in this chapter, the teaching staff shall make the affidavit of corresponding positions. The cases of falseness of the data will be punished with the cessation, without more formality than the checking of the facts.

Art. 51. Any creation of a teaching and technical-docent position in the Ministry of Education and Justice and in the National Council of Education shall be incorporated into the regime of this statute and adjusted to the respective scales and corresponding established remuneration rates.

In cases of restructuring, staff affected by the abolition of office shall have the right to maintain the remuneration reached and to ensure that their stability is not affected.

CHAPTER XVII

Retirement

Art. 52. ∙ Retirements of teaching staff under this statute shall be governed by the provisions of the relevant laws for the civil staff of the State, with the following exceptions:

(a) (Section repealed by art. 93 of the Act No. 18.037 B.O. 10/1/1969. Vigilance: 1 January 1969).

(c) Teachers who accumulate two or more positions shall also be entitled to partial ordinary retirement in any of them, indistinctly, provided that they count in the accumulated post at least five years old. They may continue to work in the other post or in up to twelve hours of weekly class or equivalent post, without having the rest of their teaching activity obtain promotions, or increase the number of weekly classes; (Note Infoleg: By art. 65 of the Act No. 18.037 B.O. 10/1/1969 provides that partial retirement referred to in this paragraph shall be granted only to participants who, in two or more educational positions, may obtain regular retirement for any of them and continue to hold one or more teaching positions exclusively. (Note Infoleg: By art. 1 Decree No. 78/94 B.O. 24/1/1994 repeals art. 52 (c). (Note Infoleg: By art. 4o de la Act No. 24,347 B.O. 29/6/1994 provides that participants who are eligible for the benefit of retirement, a partial regular provided for in the repeal of Act No. 14.473 (c), art. 52 (c), and are active as of 15 June 1994, may continue to meet the requirements for access to the benefits of the Public Previsional Scheme, at which time the payment of partial retirement will be suspended).

Art. 53. Teachers who have fulfilled the conditions required for regular retirement may continue in the active category if, through their request, they are authorized to do so by superiority, after the intervention of the classification boards. These requests should be renewed every three years and will be resolved according to the respective regulations.

CHAPTER XVIII

Disciplinary

Art. 54. The lack of teaching staff, depending on their nature and severity, shall be punished by the following measures:

(a) Friendship;

(b) Appreciation in writing, with annotation in the legajo of performance and constancy in the concept;

(c) Suspension up to five days;

(d) Suspension from 6 to 90 days;

(e) Poster of promotion;

(f) Retrogradation of hierarchy or category;

(g) Cessantía;

(h) Exoneration.

The suspensions shall be without service or pay.

Art. 55. The penalties of subparagraphs (a) and (b) of the preceding article shall be applied by the hierarchical superior of the establishment or technical body. The person concerned may appeal for replenishment and appeal in subsidy, to the head of the agency to which the sanction belongs, which will ultimately resolve, following a report of the inspection of education or of the seditional inspection, as appropriate, and the disciplinary board.

Art. 56. The sanctions of subparagraphs (c), (d) and (e) shall be applied by the competent general inspection, following the opinion of the Disciplinary Board, with appeal to the Ministry of Education and Justice or the National Council of Education, as appropriate.

Art. 57. The sanctions of article 54 (f), (g) and (h) shall be applied on the basis of the opinion of the Disciplinary Board, by decree of the national executive branch or resolution of the National Education Council, as appropriate.

Art. 58. " . None of the penalties specified in article 54 (c), (d), (e), (f), (g) and (h) may be applied without a previous summary to ensure the right of defence to the accused.

Art. 59. The teacher affected by the sanctions mentioned above may request, within the year, for a single time, the review of his case. The authority that applied it will provide for the reopening of the summary provided that the applicant provides new evidence.

Art. 60. ∙ The remedies must be filed, duly founded, within ten working days, from the respective notification, due to the filing of the appeal, to provide the evidence to the right of the applicant.

In cases provided for in article 54 (g) and (h), the person concerned, within thirty days of notification of the final administrative decision, may apply the right to replenishment and compensation in administrative or judicial proceedings.

Art. 61. ∙ Sanctions shall be applied, following the opinion of the Disciplinary Board, to teachers who are unable to prove, at the request of superiority, the charges made in public form or in summary proceedings affecting another teacher.

CHAPTER XIX

Disciplinary boards

Art. 62. ∙ The Ministry of Culture and Education and the National Councils for Education and Technical Education shall be constituted as permanent bodies known as disciplinary boards, which shall carry out the functions provided for in this statute and its regulations. They shall be composed of 5 active teachers, 3 of whom shall be elected by the direct, secret and compulsory vote of the teaching staff of the respective jurisdiction. They will last 4 years in the function and cannot be re-elected for the next period. In each election, 9 alternates (6 by the majority and 3 by the minority) should be elected and automatically incorporated by their order to the respective disciplinary board in cases of the absence of the holder or vacance of the position. The other 2 teachers will be appointed by the Ministry of Culture and Education or by the National Councils of Education or Technical Education, as appropriate; they will last 2 years in their posts and may be reappointed. Six alternates will also be appointed to be automatically incorporated into the disciplinary board in the designation order, in cases of the absence of the holder or office vacance. In order to integrate the discipline boards, an antiquity will be required in teaching not less than 10 years of which not less than 5 must be the holder of education and have a teaching degree in the conditions required by Article 13. The election shall be made to a simple plurality of suffrages, with 2 representatives to the list which has obtained the greatest number of votes and 1 to which it follows. In the event of a single list, or that the votes obtained by the list that occupied the second place do not reach 10% of the total votes obtained by the winning list, the 3 counts will be awarded to the candidates of the list. The elect shall enter by order of list, be holders or alternates and the votes shall be computed by list, not using the tachas. The joints should have a functional plant suitable for their needs. Teachers who are members of the discipline boards, who are required to apply for paid leave in the teaching posts they perform, shall be compensated by a monthly fixed amount equivalent to 4 times the index that this statute sets for the teaching state. This compensation will be computable for the purposes of retirement. The competence assigned to the discipline boards established by this article does not reach the teaching staff of the teacher training institutes, for whom the respective regulations shall establish a special regime.

PART II

Special provisions for primary education

CHAPTER XX

Income and enabling titles

Art. 63. ∙ Income in primary education shall be made by qualifications and background, with the addition of evidence of opposition in cases deemed necessary. The background to be considered by the classification boards is:

(a) Teacher degrees;

(b) Average grades;

(c) Antiquity of required titles or titles;

(d) Antiquity of arrangements. For graduates since 1943 and until the registers of candidates for charges are opened, the length of the proceedings will be determined by the antiquity of the title;

(e) Educational services previously provided;

(f) Residence;

(g) Publications, studies and activities related to education;

(h) Other titles and background.

In order to enter primary education, a maximum of forty (40) years of age will be required at the date of registration in the respective competition.

Persons over 40 years of age who have served as teachers under article 1 of this statute may apply for entry into the conditions of this statute in national, provincial or seconded educational institutes or under the authority of the National Education Council, regardless of the position or hierarchy, and have served at least during a full school course, or the equivalent in partial or discontinuable benefits, provided that the difference between the years of age is not compliant. This requirement must be computed at the time of registration of the person concerned. (Paragraph replaced by art. 1 of the Act No. 16,848 B.O. 10/12/1965).

Art. 64. Enable for primary education:

(a) The title of a national normal teacher, given by the normal schools, under the Ministry of Education and Justice or controlled by the Ministry, and that granted by the national universities and those issued by the provincial institutions whose validity is recognized by the Nation;

(b) The title of a normal teacher, whose validity and equivalence are recognized by laws or treaties;

(c) The title of national normal teacher, plus the respective specialty, for differentiated education establishments;

(d) The respective official teaching qualification for the so-called special subjects of common and adult schools;

(e) The title of librarian, issued by official authority and the standard teacher, or simply the librarian, in that order of priority to hold positions in the National Library of Teachers and in student libraries;

(f) The national standard teacher ' s degree and proven suitability for function where there are no applicants under the conditions specified in subparagraph (c);

(g) The national standard teacher ' s degree and proven suitability for function, where there are no applicants under the conditions set out in subparagraphs (d) and (e);

(h) The title of a national normal teacher and a health visitor issued by a national university, for the position of a health visitor of the National School Health Directorate.

Art. 65. In order to be appointed as a school teacher for adults and attached to the Armed Forces, a minimum age of five (5) years will be required in the exercise of teaching in primary-level schools and to have obtained no less than "very good" concept in the last three (3) years. In the event that there are no applicants under these conditions, they may be appointed less senior teachers but who comply with the requirement of the concept, unless the services provided are less than three (3) years, in which case the qualification must be credited during the entire performance provided.

To be appointed a full-time teacher in full-time schools it will be necessary to be a holder with a minimum age of five (5) years in the exercise of teaching in primary-level schools and to have obtained no less than "very good" concept in the last three (3) years.

Art. 66. The members of the National Education Council shall be teachers. The secretary-general of the National Education Council shall have a teaching degree. He is the general coordinator of the decisions of the senior administrative board. It will be appointed by the council and will last in its functions while enjoying its trust.

CHAPTER XXI

Scaffolding

Art. 67. The scale of teaching staff in common, differentiated and adult schools is as follows:

Common schools (Capital and Provinces): 1, Master or Master Secretary 2, Deputy Director. 3, Director, 4, Secretary of School Council (Capital) and Secretary of Inspection (Provinces).5, Area Inspector (Provinces). 5, Sectional or prosecretary of general technical inspection (provinces). 6, Sectional Technical Inspector (Capital, Provinces and Individuals, including Inspectors and Secretaries of General Inspections) 6, Regional Inspector (Provinces and Individuals). 7. General technical sub-inspector (capital, provinces and individuals). Schools of differentiated education: 1, Master or Master Secretary, 2, Deputy Director, 3, Director, 4, Technical Inspector of differentiated teaching. It includes outdoor schools, kindergartens, differential, deaf-mute, polyclinic schools and any other school of similar characteristics believed to be. When there is a cellar teacher in these schools, the entry into the race will be made by this hierarchical degree. Art. 68. The scale of the technical teaching staff of special subjects in the common, differentiated and adult schools is as follows:

1. Master of special matter (including choir and orchestra staff and swimming teachers of Instituto Bernasconi). 2, Special subject sub-inspector (including the special technical sub-inspector, language adviser to private schools). 3, Special Technical Inspector.

Art. 69. The scale of library staff is as follows:

1, Librarian. 2, Student Library Director. 3, Director of the National Library of Teachers. 4, Inspector of Libraries.

CHAPTER XXII

Promotions

Art. 70. - All promotions, referred to in article 24 (b) and (c), from the position of deputy director of kindergarten, to that of general technical sub-inspector or technical deputy director of schools, strictly following the ascending scale of article 92, in primary education, except for the technical inspector of special subjects and technical secretary, director and deputy director of the Instituto Bernasconi, who are governed by the provisions of the contests,

Art. 71. The promotions to the inspection charges will be made by a background and opposition contest.

Art. 72. In order to elect the office of a zone inspector, a sectional technical sub-inspector and a technical inspector, it is required at least to be a technical secretary of school council or of a sectional inspection with no less than 15 years of service; or a school director with no less than 2 years in effective office and 15 in teaching.

In order to elect the regional inspector or general technical sub-inspector, at least 2 years of actual exercise are required in the inspection post and all members of the inspection body may participate.

Art. 73. The background examinations by the classification boards shall be conducted on the basis of the following judgement elements:

(a) Effectiveness and responsibility in its teaching role;

(b) Labour, spirit of initiative, overcoming and assistance;

(c) Teaching and directive;

(d) Degrees of studies, publications and other educational activities.

Art. 74. The jury contests that will qualify the contestants will be held among the best qualified candidates. They will consist of a written test on educational issues and a practice of observation, organization and guidance of school work.

Art. 75. The results of the examinations of history and opposition will be established by the classification board, by the evaluation of titles, background and qualifications of the two approved opposition tests; their result, as well as the order of merit of the contestants, will be published.

Applicants shall have the right, in accordance with that order, to choose the vacancy of the incumbent office in which they wish to be appointed.

Art. 76. In order to choose the position of vice director, a minimum age of seven (7) years will be required for the teacher and concept not less than "very good" in the last three (3) years.

The regulation will determine teachers who will have the right to participate in the competitions for deputy directors and lower hierarchical positions within the household scale.

The position of vice-director shall be performed by same-sex staff as that of the students of the establishment and in mixed or unified schools, indistinctly by male or female staff in accordance with the rules of article 77

(Article replaced by Article 1 of the Act No. 18,613 B.O. 12/3/1970).

Art. 77. In order to opt for the post of director, a minimum age of three (3) years of service holders will be required in the post of vice director and ten (10) in total in the teaching and have concept not less than "very good" in the last three (3) years. When the position of director of single and 3rd grade common staff schools is to be a master of tenure with equal qualifications in teaching and concept.

The regulation will determine teachers who will have the right to participate in the contests for director in the different types of home schools.

The position of director will be performed by same-sex staff as the student of the establishment.

For mixed or unified schools this rule will not be governed, but if they have deputy director, the teacher called to exercise this function will be sex other than that of director.

Art. 78. In order to elect the position of director of schools for adults and attached to the Armed Forces, it will be necessary to have ten (10) years of services in teaching a minimum age of five (5) years as a holder in such schools and concept not less than "very good" in the last three (3) years. With regard to the sex of the teacher called for such a role, the rules of article 77 shall apply.

Art. 79. ∙ In order to elect management and inspection positions in schools of differentiated education and adults, the same old and concept requirements for those of common schools will be required, and for the differentiated the compulsory title of specialty will be added. It will also be essential to have served as a master in schools of the same type of education for at least five (5) years.

Art. 80. In order to elect the position of secretary of the school district or of seditional inspection, it will be necessary to be director with a minimum age of 2 years in office and 10 in teaching

Art. 81. ∙ To opt for the position of technical sub-inspector of special subjects a minimum age of 15 years is required in the effective exercise of the respective specialty. Teachers of physical education, acting in other branches of education, may submit to the competition to provide the post of sub-inspector.

Art. 82. ∙ The position of technical inspector of special subjects shall be provided by background examinations among the sub-sectors of the respective subjects.

Art. 83. In order to choose the position of student library director, it will be necessary to be a librarian with a minimum age of 5 years.

Art. 84. ∙ The post of director of the National Library of Teachers may be elected by the official librarians with no less than 10 years old in libraries under the Ministry of Education and Justice. The National Council of Education for the vote of two thirds of its members may designate without the need for competition, director of the National Library of Teachers when the candidate collects titles of eminent value, sufficient to justify the exception.

Art. 85. The position of a library inspector shall be provided by a background and opposition contest, to which the directors of libraries may be presented as national teacher and librarian.

Art. 86. The positions of technical secretary, director and director of Instituto Bernasconi will be filled by competition of titles and backgrounds and, if deemed necessary, opposition according to the conditions established by the corresponding higher school authority.

Art. 87. The position of general technical inspector shall be provided with one of the members of the inspectors ' corps, who shall be returned to his post prior to the requirement of superiority or upon request.

Art. 88. ∙ Teachers who are active outside the ranks of scalfón may aspire to the promotions dealt with in this chapter by re-entering the post of scalfón corresponding to it, at least one year earlier.

CHAPTER XXIII

Internships and supplements

Art. 89. For the performance of internships and supplements it will be necessary to establish the same conditions established for the appointment of holders.

The interim and alternate staff shall be appointed within three (3) working days of the need for their designation, and shall cease automatically by presentation of the holder

Art. 90. ∙ The performance of the interim and alternate non-trainers of the establishment and whose work exceeds the thirty consecutive days shall be qualified by the directorates, with the knowledge of the interested parties; the educational report, which has been uploaded to the Classification Board, shall appear as an antecedent in the respective lines.

The classification boards will prepare annually the lists of candidates for supplements, by order of merit, which will be determined with the judgment elements indicated for the entry into the race. These lists will be given the widest publicity.

Art. 91. ∙ The award of internships and supplements shall make it possible for the greatest number of applicants to be performed, without preventing, for reasons of school convenience, the supplements to the same degree, courses or section, during the school year, in the same alternate.

CHAPTER XXIV

Art. 93. As of 1 May 1958 the index is equal to 100 pesos according to the spirit of Article 6 (b). The value of these indices will be updated annually in accordance with the cost of living oscillations.

PART III

Special provisions for secondary education

CHAPTER XXV

The admission and increase of weekly classes

Art. 94. The admission to teaching and the increase of weekly classes, which may not exceed 24, shall be made by qualifications and background, with the complement, in all cases where necessary, of opposition evidence.

The classification boards shall designate the jurors composed of teachers with titles of the respective subjects.

(Note Infoleg: By art. 5o Decree No. 2540/77 B.O. 6/9/1977, this article is suspended (with the exception of the maximum number of hours established for the increase of hours) only to the effect of the provisions of articles 1 and 2 of the Decree).

Art. 95. ∙ Income in teaching shall be done with not less than six or more than twelve weekly classes, except for subjects or establishments where this is not possible.

The regulation shall establish the manner as teachers, with the qualifications referred to in article 13, subparagraphs (c), (d) and (e), with less than twelve weekly classes, reach that number in the shortest time.

Art. 96. ∙ The preceptor positions of secondary schools shall be filled with staff holding secondary school degrees, preferably teachers and teachers. The classification boards will prepare the lists of candidates by order of merit.

Art. 97. The positions of kindergarten teachers will be provided by qualifications, backgrounds and opposition contests, and special teachers of the application department and the kindergarten for title and background competitions, with the complement, in all cases where necessary, of opposition evidence. The classification boards will prepare the respective lists by order of merit.

Art. 98. The grade teacher positions of the application department will be provided by qualifications, background and opposition contests among teachers with no less than 5 years old in the common primary education. In order to prepare the lists of applicants by order of merit, the classification boards of the secondary education will request to know directly all the documentation that takes place in the possession of the primary education classification boards.

Art. 99. In order to be appointed a librarian in secondary schools, it is necessary to have a library degree issued by an official institute.

Art. 100. In order to be appointed as a class assistant and practical work, the title of a teacher will be required in the specialty.

CHAPTER XXVI

Scaffolding

Art. 101. The following ladders are established in secondary education:

CHAPTER XXVII

Promotions

Art. 102. The promotions to the managerial and inspection posts will be made by competitions of titles, background and opposition. Those who possess concept not less than "very good" may participate in the last three (3) years in which they have been qualified as teachers. The classification boards will only propose to the contestants who for their score have the right to participate in the opposition tests, an eight (8) jury candidates, taking into account the hierarchy of the charge to be filled, to choose two (2), including by notifying the score obtained by background. The respective classification board shall appoint the third member of the jury to act as its representative and the Ministry of Culture and Education. The classification boards will evaluate the qualifications and background of the candidates, and the jurors, the opposition tests.

Art. 103. In order to opt for promotions it will be necessary to review actively and possess the title referred to in article 13 (c).

Art. 104. ∙ The minimum antiquities in secondary, technical, artistic or higher education, official or seconded, which are as follows:

1. For vice director or vice-rector: 7 years in teaching.

2. For director or rector: 9 years in teaching.

3. For middle school inspector: 12 years in teaching.

Art. 105. For the promotion of the position of Chief Inspector of Section, which will be provided by a background examination, a minimum of 14 years will be required in the teaching and will be able to aspire the directors with 4 years in the position and the mid-education inspectors.

Art. 106. The position of a general sub-inspector shall be provided by qualifications and background in accordance with the requirements of articles 102 and 103. The mid-education inspectors with eighteen (18) years of age may participate in the teaching and concept not less than "very good". This contest will be held by jurors whose designation will be made in accordance with articles 28 and 103 of this statute.

Art. 107. The position of Inspector General shall be provided by qualifications and background in accordance with the requirements of articles 102 and 103. The general sub-inspectors and mid-education inspectors with eighteen (18) years old will be able to participate in the teaching and concept not less than "very good".

This contest will be conducted by jurors whose designation will be carried out in accordance with articles 28 and 103 of this statute.

Art. 108. ∙ The following minimum age shall be required to elect the charges referred to in this article;

(a) For deputy head of infant garden: 5 years;

(b) For subregent of the application department: 7 years.

(c) For infant garden director: 7 years.

(d) For regent of the application department: 9 years.

(e) For sub-inspector of special subjects of the departments of application and kindergarten: 10 years.

(f) For inspector of the application department and kindergarten: 12 years.

Art. 109. In order to aspire to the post of head of physical education department, it will be required to be a physical education teacher with 5 years old in the course of the course.

For physical education inspector, he or she will be required to be head of the physical education department with 5 years of age in this position and 10 within the scale of article 101 (d), or to be a physical education teacher with 12 years of age in the course.

Art. 110. ! The heads of the library shall be appointed among the active librarians, with no less than 3 years in office. For library inspector, he or she will be required to be head of library or librarian, in both cases, with an official librarian ' s degree and 12 years old with the charge of the respective scale.

Art. 111. The position of head of preceptors will be provided with a preceptor with a minimum age of 5 years and concept not less than "good", and in the last 2 years "very good".

CHAPTER XXVIII

Internships and supplements for senior managers in secondary education, application departments and kindergartens

Art. 112. ! Applicants for supplements and internships in secondary education shall meet the conditions required by this statute for the appointment of holders. For appointment, up to 2 establishments can be registered simultaneously.

Art. 113. The rectors or directors shall designate the alternate and interim among the teachers holding their establishment and applicants for the respective subjects in accordance with the merit order established by the Classifications Board.

Art. 114. The appointment of the alternate shall include the initial license and its extensions. In the case of successive leave over the course of a school period and in the same subject and course, the appointment of the alternate or interim who has already served in the post shall be a priority.

Art. 115. The performance of the interim and alternates who are not holders of the establishment, and whose work exceeds 30 consecutive days, will be qualified by the management. Prior to the knowledge of the interested parties, the educational report, which was uploaded to the Classification Boards, will appear as an antecedent in the respective lines.

Art. 116. ∙ Applicants for internships and supplements for managerial positions shall be holders in establishments where they wish to exercise and perform within the respective scale.

Applicants for the positions of rector or director, regent or director of kindergarten, in establishments with the positions of vice-rector or vice-director, sub-gerent or deputy director of kindergarten, shall be holders, acting or alternate of these last positions, corresponding to assign the internship or supplement in accordance with the provisions of the respective regulations.

They must have an antiquity in teaching according to the provisions of articles 104 and 108 of this statute, concept not less than "very good" in the last three (3) years in which they have been qualified and, in addition, meet the conditions established by the regulation.

The provision of internships and supplements for managers shall be governed solely by the requirements of this article and its regulations.

In the case of establishments, the managerial positions will be provided internly with the best-qualified teachers, in accordance with the merit order established by the classification board and acting as interim in the same establishment.

Special provisions for technical education

CHAPTER XXX

From admission to teaching

Art. 119. ∙ Teaching, in technical education establishments for the following charges:

I. Regional industrial or industrial schools (basic cycle):

(a) Teacher;

(b) Teacher of practical teaching;

(c) Helper of practical work;

(d) Librarian;

(e) Preceptor.

II. Professional schools of women:

(a) Teacher;

(b) Assistant Master of Practical Teaching;

(c) Librarian;

(d) Preceptor.

Art. 120. The admission to teaching and the increase of weekly classes, which may not exceed twenty-four, shall be made by competition of titles and backgrounds, with the supplement, where deemed necessary, of opposition evidence.

Art. 121. ∙ Income in teaching shall be done with not less than six or more than twelve weekly classes, except for subjects or establishments where this is not possible. The regulation will establish the manner as teachers with less than twelve weekly classes, reach this number with a shorter time, with respect to the spirit and norms of this statute.

Teachers of practical teaching shall enter the teaching with a charge of twenty-four classes or in charge of up to forty-four weekly classes according to the needs of each establishment.

CHAPTER XXXI

Scaffolding

Art. 122. ! In technical education, the following scallops will be collected:

I. Regional industrial or industrial schools (basic cycle):

(a) 1, Professor, 2, Subregent. 3, Regent. 4, Deputy Director, 5, Director, 6, Teaching. 7, Chief Inspector of Section. 7a, Chief of the Technical Department. 7b, Technical Secretary. 8, General Inspector, 9;

(b) 1, Teacher of practical teaching. 2, Master of practical teaching Section Chief. 3, Chief General of Practical Education;

(c) 1, Helper of practical work. 2, Chief of Practical Work. 3, Chief Laboratory and Cabinet.

The general head of practical education shall have access to the immediate superior positions of the scaffolding (a), entering by the deputy director provided that he meets the conditions required by this statute.

For the preceptor's office, the normal teacher's degree or the graduate of these schools will be preferred. For the position of librarian, the conditions specified in article 99 shall be required.

II. Professional schools of women:

(a) 1, Professor. 2, Deputy Director. 3, Director. 4, Teaching Inspector. 5, Chief Inspector of Section. 6, General Subinspector;

(b) 1, Teacher in practical education. 2, Teacher of practical teaching. 3, Regent.

The regent of women ' s professional schools will have access to the immediate senior positions of the scale:

(a) Entering for the deputy director, provided he meets the conditions required by this statute.

III. Scales common to industrial schools and women's professionals:

(a) 1, Teacher of physical education. 2, Head of the physical education department. 3, Inspector of Physical Education;

(b) 1, Librarian. 2, Chief Library. 3, Library Inspector.

(c) 1, Preceptor. 2, Preceptor Subdirector. 3, Head of Preceptors.

CHAPTER XXXII

Promotions

Art. 123. The promotions to the managerial and inspection posts shall be made by qualifications, background and opposition.

Art. 124. To opt for promotions it will be necessary:

(a) To possess the title referred to in article 13;

(b) Having a minimum age of 2 years previously held;

(c) Having a minimum age of 2 years in official education so that the aspirant has the right to have the services provided in adscribed institutes, for the purposes of antiquity for promotions;

(d) Be 5 years older than that established in each case when it comes to working teachers who do not possess the titles referred to in subparagraph (a) of this article.

Art. 125. In order to elect the established posts referred to in this article, the minimum age for teaching is required as follows:

Scale (a) of industrial schools:

For subregent: 3 years.

For regent or vice director: 5 years.

For director: 9 years.

For teaching inspector: 12 years.

Scale (b) of industrial schools:

For practical teaching teacher Section Head: 3 years.

For general head of practical education: 6 years.

Scale c) of industrial schools:

For head of practical work: 4 years.

For head of labs and cabinet; 6 years.

Scale (a) of professional women ' s schools:

For vice director: 5 years.

For director: 9 years.

For teaching inspector: 12 years.

Scale (b) of professional women ' s schools:

For practical teaching teacher: 4 years.

For regent: 9 years.

Common Scale of Industrial Schools and Women Professionals:

For the positions in subparagraphs (a) and (b) there shall be a requirement for conditions similar to those established for secondary education.

Art. 126. ! In order to provide the positions of Chief Inspector of Section, Chief of the Technical Department, Technical Secretary, Assistant Inspector General, the same requirements under Articles 106 and 107 of the special provisions for secondary education shall be required.

Art. 127. The position of inspector-general shall be provided by one of the members of the body of inspectors, who shall have the right to return to his or her office upon request or so shall be resolved by superiority.

CHAPTER XXXIII

From admission to higher technical institutes

Art. 128. ! In the higher technical institutes for the technical and teaching improvement of graduates and teaching staff of the technical education establishments, the provision of teaching posts, and of chairs will be carried out by qualifications, background and opposition.

CHAPTER XXXIV

Internships and supplements

Art. 129. ∙ The appointment of interim and alternate persons shall be governed by the provisions established for secondary education in the respective chapter.

CHAPTER XXXV

Transitional arrangements

Art. 130. The senior management and teacher in charge of non-technicals who are in charge of courses whose income requires the approved sixth grade, the masters of technology, drawing and special teachers of the industrial schools, of the basic cycle, mixed regional industrialists and women ' s professionals, in exercise of the date of adoption of this statute, shall be reviewed on a scale as teachers, to which effect the Ministry of Education and Justice shall proceed to make the adjustment of the current budget and distribution.

Art. 131. From the time of the present statute, the posts in the budget with the designation of the general head of workshops, master of workshop, master of workshop in industrial schools and master of workshop in women ' s professional schools, shall be reviewed, respectively, as the general head of practical education, master of practical teaching, teacher of practical education and teacher of practical teaching assistant, and shall not be subject to any such changes in the current term of office in the week.

Art. 132. ∙ The management and teaching staff of the temporary residence missions are obliged to move with them, in accordance with the provisions of the respective regulations.

After six years of teaching in these establishments, you may opt for the vacancies referred to in article 35 if you meet the requirements of articles 13 and 14.

PART V

Special provisions for higher education

CHAPTER XXXVII

Higher education institutes

Art. 135. For the purposes of this law, higher education institutes are for the training of teachers, the technical improvement of the teaching staff, and the investigation of the problems associated with teaching.

Art. 136. They are included in the category of higher education establishments, national secondary education institutes and teacher training courses in normal schools, national teacher training institutes and artistic improvement, national physical education institutes and teacher training institutes, technical teacher training, in-service and teacher research staff that can be established in the future.

CHAPTER XXXVIII

Provision of professorships and teaching positions

Art. 137. In order to be rector, vice-rector, director or vice-director of national teacher training institutes, the general and concurrent conditions of Article 13 will be required and 12 years of training will be accredited, of which 5 years in the respective teaching.

Art. 138. ! The managerial positions referred to in the preceding article shall be provided in the manner and periods that establish the regulations of the respective institutes and those performing in them, at the end of their term of office, may be returned to their previous functions.

Art. 139. The provision of professorship and teaching positions shall be made by set of titles, background, and opposition.

The jurors will be appointed by the board of directors of each institute taking into account the specialization and hierarchy of the charge to provide.

In cases of the creation and installation of new higher education institutes, and for the purpose of the initial designation of professors responsible for the provision of the respective chairs, the jurors shall be appointed by the Ministry of Culture and Education, which, also, for the processing of the respective contests, shall have the powers that the law or its regulation confer on the board of directors. This provision will also apply in cases of already existing higher institutes when they do not have in their functional plant with teachers in sufficient number for the constitution of their authorities. Art. 140. ! Teachers who, as recruits, enter teaching in higher education institutes and establishments in all branches, shall only enjoy the rights corresponding to their role and hierarchy established in the respective contracts.

PART VI

Special provisions for artistic teaching

CHAPTER XL

From admission to teaching

Art. 143. ∙ Income to the teaching career shall be held for any of the following positions:

(a) Preceptor.

(b) Librarian.

(c) Assistant Chair.

(d) Special master.

(e) Master of workshop.

(f) Master of degree.

(g) Professor.

Art. 144. ∙ The appointment of holders in technical-cultural, technical-professional or technical-teaching posts or subjects, shall be carried out in advance of qualifications and backgrounds, and of opposition if so decided by the respective jury.

Art. 145. At the end of the previous article, in any contest call the board of classifications will specify the correspondence that must exist between the titles and enabling history and the specific content of each position or subject.

Art. 146. ∙ Income in charge or chair corresponding to the primary or secondary stage shall be governed by the special provisions set out in this statute for the respective branches.

Art. 147. ∙ Librarian and preceptor charges will be provided with the title and background contest.

Art. 148. The qualifications and background examination shall be supplemented by the opposition contest, when the circumstances provided for in article 14 are presented or when vacancies should be provided in the courses and higher teacher training institutes.

Art. 149. ! Teachers who enter the teaching and institutes and establishments of artistic education as recruits shall only enjoy the rights corresponding to their role and hierarchy, as set out in the respective contracts.

CHAPTER XLI

Scales

Art. 150. ! The following ladders are established for the teaching staff of the establishments, institutes and distributions of artistic teaching:

(a) 1, Professor. 2, regent, general workshop chief. 3, vice director (or cycle manager). 4, director. 5, technical inspector of art. 6, general inspector of artistic teaching.

(b) 1, librarian. 2, head of libraries. 3, library inspector.

(c) 1 workshop master, 2 workshop chief.

(d) 1, preceptor. 2, preceptor.

Art. 151. Teachers included in the scale corresponding to subparagraph (c) of the previous article may enter the scale mentioned in subparagraph (a) if they prove in the respective contests, the possession of equals or better titles, background and merits than those required for the position of professor.

CHAPTER XLII

Promotions

Art. 152. " . Staff serving in artistic education may serve as senior hierarchical positions, after complying with the requirements of article 27 and the total seniority rates on the following scale:

(a) For workshop manager: 2 years.

(b) For preceptor chief: 2 years.

(c) For regent or general workshop head: 5 years.

(d) For vice director (or cycle manager): 6 years.

(e) For director: 8 years.

(f) For technical art inspector: 12 years.

Art. 153. ! Teachers who aspire to the posts of deputy director, director or art inspector, in addition to complying with the conditions of the previous article, shall be presented to the respective opposition evidence.

Art. 154. The position of a general inspector of artistic teaching shall be provided with one of the members of the body of art inspectors, who shall have the right to reintegrate into his or her duties when he or she so requests.

CHAPTER XLIII

From the contests

Art. 155. When vacancies are to be provided in the institutes and establishments of artistic teaching, the classification board will organize the contests in accordance with the requirements set out in this statute.

Art. 156. ! For the post of librarian, the official qualification or, secondaryly, the graduate of art and preceptor school, the graduate of art school or, failing that, the national or high school teacher.

Art. 157. ! In the contests for admission or promotion to technical-cultural, technical-professional or technical-docentes, the following priority order will be observed for the qualification of titles and background:

1. Title according to articles 13, 14 and 17.

2. Concurrent, artistic, teachers and professionals of an official and private nature.

3. Other teacher or professional degrees.

4. Studies, research, publications, works and other scientific, artistic or educational activities.

5. Awards and other distinctions.

CHAPTER XLIV

Internships and supplements

Art. 158. The alternate or interim shall meet the same conditions as those required for the appointment of holders.

Art. 159. ! Applicants for supplements or internships, including teachers in exercise, shall be registered annually in the register of the alternate or interim staff, which for this purpose shall carry the direction of each institute or establishment, specifying the charges or subjects for which they are entitled by their qualifications and background.

Art. 160. ! The directors of institutes and artistic educational establishments may designate the alternates or the interim among the holders and aspirants of the respective subjects, in accordance with the merit order established by the classification board.

Art. 165. ! In addition to the above indices, index five (5) is set as a different function bonus for: differentiated pedagogy inspector; staff of deaf mute institutes, excluding the secretary; differentiated school staff and amblyope grade teachers.

Art. 166. For the purposes of the application of the antiquity bonus scales established by article 40, subparagraphs (a) and (b), the services provided in units and/or establishments of the Ministry of Education and Justice of the Nation and those of the National Council of Education by doctors and dentists of the National Directorate of School Health, in the nature of such.

Art. 167. ∙ Be available to staff in differentiated education schools, grades of amphilims and deaf mute institutes, excluding the secretary, the same retirement regime determined by article 52 (i).

Art. 168. ∙ Since this Act, the fees shall be provided through competitive examinations and the regulation shall provide preference for those who have educational qualifications.

Art. 169. As of 1 May 1958 the index is equal to $100, according to the spirit of Article 6 (b). The value of these indices will be updated annually, according to the cost of living oscillations.

CHAPTER XLVIII

Special arrangements

Art. 170. ! The Monotechnic and Cultural Extension and Rural and Domestic Culture missions, the Learning and Vocational Orientation Commission, the National Council for Children and the National Library shall be governed by the following special provisions:

(a) The Monotechnical and Cultural Extension and Rural and Domestic Culture missions, for the purposes of the remuneration of their staff, will be considered as first-class technical education establishments;

(b) The criteria applied for primary education establishments under the National Council of Education will be followed in order to establish the grades for the various educational posts, teaching assistants, inspection managers and senior education directors;

(c) In order to establish the grades for the different teaching posts, teaching assistants, inspection managers and senior education directors, under the National Learning and Vocational Orientation Commission, excluding the current National Worker University, the criteria applied for technical education establishments directly under the Ministry of Education and Justice will be followed.

The president of the National Learning and Vocational Orientation Commission will have similar indices to the president of the National Education Council;

(d) (Section repealed by art. 44 of the Act No. 15,796 B.O. 26/1/1961).

(e) The benefits relating to remuneration and retiring regime established by this statute also include civil teaching staff in the armed forces institutes and teachers in primary and secondary schools under the national universities, teachers of the Blind Authority, under the National Social Welfare Directorate of the Ministry of Social Welfare and Public Health, and teachers of the National Mental Health Council.

Art. 171. ∙ The management and teaching staff of the current National Workers ' University are covered by the benefits relating to bonuses for years of service and retirement regime established in the present statute, and their monthly remunerations will be made in accordance with the following rates:

PART VIII

Special provisions for teaching

CHAPTER XLIX

Art. 173. ∙ These are covered by this statute, by teaching staff, managers and assistant teachers who serve in seconded educational establishments, in relation to the requirements of Act No. 13.047.

Art. 174. ∙ Teachers, managers and assistant teachers of the establishments covered by article 2 (a) of Act No. 13,047, shall enjoy equal monthly remuneration equal to that which, on an equal basis of specialty, work and seniority, receives similar staff from official establishments. Grade teachers serving with discontinuous fees will also enjoy a bonus not less than 30% calculated on the corresponding nominal base salary. This equalization shall be made in accordance with the provisions of Act No. 13.047.

Art. 175. ! The services provided in the seconded education shall have the same validity as those performed in official education, for the purposes of income, increase of hours and promotions, in all branches covered by this statute.

Once the teacher has entered the official education, he will be instructed in accordance with the provisions of this statute for the increase of weekly hours and promotions.

Art. 176. ! The teaching staff in seconded institutes, to be held in localities where teachers have no qualifications, shall be entitled to the teaching of the subject if they were three years old and deserved a favourable professional concept, in accordance with the provisions of article 8 of Act No. 13.047.

PART IX

CHAPTER L

Supplementary provisions

Art. 177. ! The different governing bodies of education in each branch shall take into account, from the date of effect of this statute, both in the formulation of the respective budgets for the expenses of the teaching staff, as well as in the preparation of the organic regulations of the distribution and the institutions of dependent teaching, the denomination assigned to each of the positions on the scaffolding, in order to retain unity in the interpretation and application of its provisions.

The Ministry of Education and Justice in the medium, technical, artistic and higher branches and the National Council of Education may create, abolish or modify posts by including them as appropriate in the respective scales, adapting them to the needs of the school organization without affecting the stability of the staff, who shall have the right to maintain the salaries reached.

CHAPTER LI

Transitional arrangements

Since the sanction of this law and, within one year, teachers who are over forty-five years of age may enter the primary education system, provided that they have previously performed teaching functions under article 1 of Law No. 14.473 (Territorial Status), in national, provincial or adscriptive educational institutes, with official superintendence, in the territory of the Nation, any part-time or partial discontinence. The entrance will be by the way of the contest that establishes Law No. 14.473 (Statute of the Teacher)". (Paragraph incorporated by art. 1 of the Act No. 16,444 B.O. 26/2/1962).

Art. 178. ! The new remuneration set by this Act shall be settled on 1 May 1958.

Art. 179. . Authorize the executive branch to deal with general incomes and with the charge of this law the greatest erogations that will entail the fulfilment of the preceding provisions.

Art. 180. For the calculation of the antiquity, the time that was separated from the function will be computed for the reincorporated staff.

Art. 181. Until such time as the classification boards are in place, the Ministry of Education and Justice and the National Council of Education shall designate managers and teachers on an interim and alternate basis, subject to the provisions of the relevant chapters of this statute.

The reinstatement of the staff declared to have ceased for political reasons will be made subject to the opinion of special commissions. The definitive location will be determined by the classification boards.

Art. 182. ! Professionals in the art of healing of the National School Health Directorate who in addition to their specific tasks carry out teaching in hygiene, prophylaxis, nutrition, vaccination and courses dedicated to teachers and teachers, with the issuance of vocational training degrees for teachers of the interior of the country and of the Federal Capital and for teachers of the differentiated education, who have a state of education under Law No. 3425, the extension of Law No. 1420

Art. 183. The technical-doctoral inspection staff and district secretaries under the National Education Council, who were held vacant as at 11 September 1956 by a decision of the Ministry of Education and Justice and who had not been confirmed until the enactment of the present Act, were established. The technical-docent inspection staff and district and sectional secretaries designated by competitive examination after the aforementioned date will continue to review their current situation.

The teaching positions of directors and deputy directorate shall be provided by competitive examination in accordance with the provisions of this law.

Except for this provision to directors and vice directors with an enabling title, of unfavourable or highly unfavourable location schools, which will be automatically confirmed when they credit good concept and one year old in office.

In addition, teachers of democratic education under the Ministry of Education and Justice are confirmed in their positions, with a teaching degree under the conditions of article 13, which are held in vacant positions as at 11 September 1956.

Art. 184. All provisions opposing this statute are repealed.
