Law 14.177

LLAMADOS a LICITATION PUBLICA.

BUENOS AIRES, September 30, 1952

Article 1.- Amend Decree 29.387, dated 31 October 1944, confirmed by the Law 12,911in the manner determined by this law.

Art. 2.- Ads calling for public tenders for supplies or services to be effective in the Federal Capital, provincial capitals or governorates and elsewhere, will be made in the following form: 1. Federal Capital: publications in the Official Gazette of the Nation 2. Capitals of provinces or governorates: publications in the Official Gazette of the Nation and the province or the governorate concerned 3. In other places: in addition to the publications set at point 2. they will also be made in a newspaper of the corresponding locality.

Art. 3.- Notices relating to the publications referred to in the previous article shall be made in advance and by the number of days determined below: First call (a) In advance of eight (8) days, to be published for five (5) days, when the tender does not exceed five thousand pesos national currency ($ 500.00) b) In anticipation of fifteen (15) days, having to be published for ten (10) days, when the tender exceeds the amount of five hundred thousand pesos national currency ($ 500,000). Second call (a) With a five (5) day advance, it must be published for three (3) days, when the tender does not exceed five thousand pesos national currency ($ 500,000) b) In anticipation of ten (10) days, it must be published for five (5) days, when it is more than five hundred thousand pesos national currency ($ 500,000).

Art. 4.- Where this is suggested by the increased shortage in the position of the tendered article, the executive branch or the competent authority, in accordance with the respective laws, may reduce the terms set forth in the previous article, regardless of the probable amount of the acquisition, but in no case shall the time limit be lower than those stipulated for the second bid.

Art. 5.- In the case of major supplies or services that are necessarily to come from abroad, publications may be available in the countries deemed appropriate, through the respective Argentine diplomatic representations, as well as to refer to the latter copies of the terms of reference for potential stakeholders

Art. 6.- In the absence of Official Gazettes, notices will be issued in a newspaper of the capital of the province or governorate in whose territory the supply or service must be made effective, without prejudice to being published in a newspaper of the corresponding locality in the case of paragraph 3., article 2.

Art. 7.- Where due to the importance of supply or service, the competent authority which provides for tendering shall deem it appropriate, in addition to the publications authorized in article 2, paragraphs 1, 2 and 3, they may also be made and with the same anticipation and number of times, in one or two newspapers of the Federal Capital or of the province or governorate where the provision is to be made or the service provided.

Art. 8.- In the event that in the capital of province or governorate in whose territory the service or supply is to be made, there are no advertising bodies whose periodicity allows to complete the entirety of the established publications, the announcements will be made in the newspapers that are published every time they appear within the time limits set for the call.

Art. 9.- The terms set by this law for publications are minimal.
