NATIONAL BUDGET FOR 1949 LEY No. 13.249

The Senate and Chamber of Deputies of the Argentine Nation, assembled in Congress, etc., sanction with force

LEY:

ARTICLE 1 - Please note in the amounts below, in accordance with the details contained in annexed tables, the budget for the period 1949 of the central administration and decentralized agencies:

ARTICLE 2 - Please provide the following amounts of resources for the exercise of 1949 of the central administration and decentralized agencies for the financing of the expenses authorized by article 1 of this Act:

The expenses of the "Aid Services" of the General Administration of State Railroads and General Administration of Sanitary Works of the Nation set forth in Article 1 (Chapter II, subsection B) of this Law shall be financed with the amounts transferred to them by the respective agencies from their budgetary authorizations and plans of works, by the facilities that these services make.

Article 3 - Authorize the Executive to issue public debt securities in sufficient quantity to meet the following needs, provided in the annexes below:

ARTICLE 4 - Provide the Executive Branch with a view to increasing the amount authorized for the period 1948, the amount allocated by this Act for the execution of public works, for which - and in accordance with the provisions of article 4 of Act No. 12,961 - the relevant modification of the resource tables and erogations shall be made.

ARTICLE 5o - The executive branch is authorized to enter general incomes up to the sum of six hundred and twenty million pesos national currency ($ 620.000,000) of the Benefit of Change Fund.

ARTICLE 6 The deficit imposed in the year 1949 by the exploitation of the services provided by the General Administration of Sanitary Works of the Nation, General Administration of State Railroads and Administration of Fluvial Transport, shall be solved by the National Treasury, as a returnable advance to the extent and opportunity that the resources of such services permit it. The advance in favour of the Fluvial Transport Administration will be made under the conditions set out in article 7 of Decree 9.906 of May 4, 1945.

The executive branch is empowered to carry out the necessary credit operations for the purposes of this article.

ARTICLE 7 - In the sum of one hundred and fifty million pesos national currency ($ 150,000,000), the resources of the National Energy Fund for the year 1949, which will be affected according to the distribution that the Executive Power determines on the proposal of the National Energy Directorate, to fulfill the purposes of its creation. The National Directorate of Energy and its dependent agencies will incorporate into their respective budgets with approval from the Executive Branch, the amounts allocated to them in the distribution of that fund to cover their investments.

Disclose from the above amount the following amounts for contributions from the fund for the financing of the investments budgeted under this Act for the following agencies:

ARTICLE 8o - Note in the sum of twenty-nine million two hundred thirty-four thousand four hundred ninety national pesos ($ 29,234,490), the contribution that, for the financing of the budget of the National Social Insurance Institute, will have to contribute from their own resources the different sections that make it up, according to the following detail:

Article 9 The deficit resulting from the exploitation of joint aircraft companies to be solvent by the State, in accordance with article 7 (h) of Decree 728/46 (law 12.911), shall be cancelled by the Executive Power by the financial means it deems most appropriate, in accordance with the possibilities of the National Treasury.

ARTICLE 10. - Authorize the executive branch to make use of the short-term credit to cover eventual treasury requirements during the period of 1949 for an amount of up to one billion pesos national currency ($1,000,000.000).

ARTICLE 11. The executive branch is empowered to advance national universities with the resources provided for in the period 1949 for the application of the university tax established by law 13,031, the necessary amounts required for the normal development of such agencies.

Also authorize the Executive Branch to anticipate the Technological Institute of Sud the amounts necessary for financing the budget approved by this law. Such advances shall be covered by the resources that the agency may determine for the financing of the Honorable National Congress.

ARTICLE 12. - The Executive Power shall provide the Financial Aid Institute for the Payment of Retirement and Military Pensions with the provisions contained in this Act, corresponding to the differences made by the National Treasury of the retirement and pension assets referred to in articles 20 and 26 of the Act 12.913 (Decree 13.641/46). The Financial Aid Institute for the Payment of Retirements and Military Pensions shall directly account to the National Account for the investment of such funds.

ARTICLE 13. - Authorize the Executive Branch to introduce to the budget, the modifications that require the incorporation of the resources and erogations of the special accounts services not covered by this law and whose operation in the period 1948 was provisionally provided under the authorization granted by article 17 of Act 13.072.

ARTICLE 14. The executive branch is authorized to make, by decree issued with the intervention of the Ministry of Finance and in the presence of duly justified reasons, compensation between the main provisions of the general budget, provided that the total authorized for "Personal expenses" or "Other expenses" is not altered and the staff plant is not increased.

ARTICLE 15. - The Executive Power by decree issued with the intervention of the Ministry of Finance shall establish for the special accounts incorporated in this law the respective operating regimes, being entitled also to introduce in the budget and calculation of the resources of such accounts, the extensions or reductions that financial or economic reasons make essential as a result of the increase or decrease in the income in relation to the expected.

ARTICLE 16. - Authorize the Executive Branch to deduct from the annual supplementary salary of State staff, the amount to be paid in the form of compulsory insurance premiums established by law 113 and corresponding to the following year.

An adjustment of the amounts deducted from premiums will be made annually, taking into account the salaries actually allocated during the period to such staff.

To this end, the Executive Branch, through the Ministry of Finance, shall determine by regulation the procedure to be followed in order to make such adjustments, as well as to carry out any refunds.

ARTICLE 17. - Substitute Article 9 of Law 11.672 by the following:

"Article 9 - All legal acts to which the national government is a party, its units or decentralised entities, which correspond to be formalized by public writing, shall be granted with the intervention of the Government of the Nation. The same formality shall be filled with contracts of any kind authorised or concluded by the Executive Branch and decentralized divisions with individuals or companies, when the nature or importance of such agreements is appropriate in the opinion of the competent authority that approves the contract.

"Except the cases in which another form has been legally established for the granting of public scriptures."

ARTICLE 18. - The positions of teachers of ordinary and private day schools, visiting school hygiene and cellars assigned by Subparagraph 1 - Staff costs of Annex 14 - National Council of Education shall be distributed among schools of Capital, provinces, territories, national colonies, individuals providing free primary education, climates, hospitals or immigrants and schools homes, in the following proportion:

Authorize the Executive Branch to amend the number of posts set for each jurisdiction by decree issued through the Ministry of Justice and Public Instruction if the needs of education so require, subject to technical reports that justify the measure.

ARTICLE 19. - Authorize the National Council of Education to ensure that school teachers ' departures affect up to nine hundred (900) posts for teachers who, while retaining their moral or intellectual skills and having a minimum of 10 years of continuous service, are declared auxiliary teachers in accordance with the provisions in force, are temporarily or definitively in a state of physical incapacity for the exercise of active teaching.

ARTICLE 20. - Note in the sum of five hundred thousand pesos national currency ($ 500,000), the Emergency Fund provided for in Article 8 of Law 12.961, at the disposal of the Presidency of the Chamber of Deputies of the Nation.

ARTICLE 21. - Authorize the Presidency of the two Houses of the Honorable Congress of the Nation to have the surpluses of the respective budgets and collections, to strengthen their shares and to meet extraordinary demands.

ARTICLE 22. - Incorporate into this budget the credits approved by special laws, except those authorized as "for once" for 1948.

ARTICLE 23. - Of the total of sixty million two hundred fourteen thousand three hundred two pesos national currency ($ 60,214.302) provided for in Article 1 of this Law as "additional credit", fifty-five million two hundred fourteen thousand three hundred two pesos national currency ($ 55,211,302), shall be distributed in accordance with the following detail:
