The Senate and Chamber of Deputies of the Argentine Nation assembled in Congress, etc. sanction with force of Law:
ARTICLE 1 Replace article 200 of the Criminal Code with the following:Article 200: He shall be repressed with imprisonment or imprisonment from THREE (3) to TEN (10) years and fine from PESOS DIEZ MIL ($ 10,000) to PESOS DOSCIENTOS MIL ($ 200,000), which poisons, adulterareesses or falsifies in a dangerous way for health, drinking water or food or medicinal substances intended for public use or the consumption of a collectivity of persons.
ARTICLE 2 Replace article 201 of the Criminal Code with the following:Article 201: The penalties of the preceding article shall apply to the person who sells, sells, supplies, distributes or stores for the purpose of marketing drinking water, food or medicinal substances or dangerous goods for health, dissimulating their harmful nature.
Article 3 Incorporate as article 201 bis of the Criminal Code the following:Article 201 bis: If, as a result of the poisoning, adulteration or forgery of drinking water or food or medicinal substances, the death of any person, the penalty shall be TEN (10) to VEINTICINCO (25) years of imprisonment or imprisonment; if they result in serious injury, the penalty shall be three (3) to QUINCE (15) years of imprisonment or two years imprisonment; if they shall be serious injuries, the penalty shall be three years of imprisonment.
In all cases, a fine of PESOS DIEZ MIL ($ 10,000) will be applied to PESOS DOSCIENTOS MIL ($ 200,000).
ARTICLE 4 Replace article 203 of the Criminal Code with the following:Article 203: When any of the facts provided for in the preceding articles are committed by imprudence, negligence, imperfectness in their art or profession or by non-observance of the duties to their office, a fine of CINCO MIL PESOS ($ 5,000) shall be imposed on CIEN MIL PESOS ($ 100,000); if it is a result of illness or death, the prison of SEIS (6) months to CINCO (5) years shall apply.
ARTICLE 5o Replace article 204 of the Criminal Code with the following:Article 204: It shall be repressed with imprisonment of SEIS (6) months to THREE (3) years that, being authorized for the sale of medicinal substances, will supply them in kind, quality or quantity not corresponding to the medical prescription, or different from the declared or agreed, or exceeding the regulations for the replacement of medicinal substances, or without the presentation and archive of the prescription of those products that, according to the current regulations, cannot be marketed without that requirement.
ARTICLE 6 Replace article 204 bis of the Criminal Code with the following:Article 204 bis: Where the offence provided for in the preceding article is committed by negligence, the penalty shall be a fine of CINCO MIL PESOS ($ 5,000) to CIEN MIL PESOS ($ 100,000).
ARTICLE 7o : Replace as article 204 ter of the Criminal Code the following:Article 204 ter: He shall be repressed with imprisonment from UNO (1) to CUATRO (4) years and fine from PESOS DIEZ MIL ($ 10,000) to PESOS DOSCIENTOS MIL ($ 200,000), which produces or manufactures medicinal substances in unauthorized establishments.
ARTICLE 8 Replace article 204 of the Criminal Code with the following:Article 204 quater: It shall be repressed with a fine of PESOS DIEZ MIL ($ 10,000) to PESOS DOSCIENTOS MIL ($ 200,000), which, having in its charge the direction, administration, control or monitoring of an establishment intended for the sale, storage, distribution, production or manufacture of medicinal substances, knowingly, fails to comply with the duties assigned to it by allowing the commission of one of the 204.
Article 9 Incorporate as article 204 quinquies of the Criminal Code the following:Article 204 quinquies: It will be repressed with SEIS prison (6) months to THREE (3) years that without authorization sells medicinal substances that require a prescription for marketing.
ARTICLE 10. Contact the national executive branch.IN THE SESSION OF THE ARGENTINE CONGRESS, IN GOOD AIRES, TO CATORCE DAYS OF THE OCTOBER OF THE YEAR DOS MIL NEW.
