MERCOSUR
VISTO: The Treaty of Asunción, the Protocol of Ouro Preto, Decision No. 01/98 of the Council of the Common Market and Resolution No. 25/97 of the Common Market Group.
CONSIDERING:
That a wider dissemination of the name, acronym, emblem and banner of MERCOSUR contributes to consolidating the identity and image of the integration process;
That it is necessary to ensure proper protection to the name, acronym, emblem and flag of MERCOSUR;
That the name Common Market of the South, the MERCOSUR acronym and the emblem of MERCOSUR, in the Spanish and Portuguese languages, were duly communicated in the terms of article 6 of the Paris Convention for the Protection of Industrial Property to the other members of that Convention.
THE COUNCIL OF MERCATE COMUN
DECIDE:
Art. 1 - They are symbols of MERCOSUR the name Common Market of the South, the acronym MERCOSUR, the emblem of MERCOSUR and the banner of MERCOSUR in the Spanish and Portuguese languages, which consist as an Annex and are part of this Decision.
The graphic characteristics and colour combinations of the emblem and the banner of MERCOSUR are contained in the Annex.
Art. 2- The symbols of MERCOSUR are for use by MERCOSUR, MERCOSUR States Parties and MERCOSUR bodies, and may be used, without prior authorization, by national natural or legal persons of MERCOSUR States Parties in a manner consistent with MERCOSUR ' s objectives.
Art. 3 - Without prejudice to the provisions of article 6 of the Paris Convention for the Protection of Industrial Property, the Common Market Group may develop directives that should be duly disclosed in order to guide the use of MERCOSUR symbols by third parties, natural or legal persons.
The use of the MERCOSUR symbols must respect the guidelines emanated from the Common Market Group.
Art. 4 - The symbols of MERCOSUR may not be used when they are associated with objectives and activities incompatible with the principles and objectives of MERCOSUR, when they are contrary to public morals or when they can cause confusion between the user and the organs of MERCOSUR with the public, inducing error or causing discredit from the organism.
The symbols of MERCOSUR may in no case be used to designate organs or institutions that may be identified or confused with MERCOSUR bodies, such as Tribunal, Council, Group, Commission, Committee, Working Group or Forum.
Art. 5 - Commercial companies shall observe the following requirements for the use of the term MERCOSUR,
(a) that the word MERCOSUR is not used in isolation, but being part of the denomination or social reason;
(b) That this denomination is related to the social object; and
(c) that is not misused to induce error or misleading with official agencies.
Art. 6 - Each State Party shall, in accordance with its legislation, ensure that appropriate measures are taken to prohibit the misuse of MERCOSUR symbols and ensure their proper use in the terms of this Decision, in particular articles 3 and 4.
For this purpose, the States Parties shall extend and ensure to the symbols of MERCOSUR protection equivalent to that of national symbols in the respective domestic legal systems in respect of sanctions for non-compliance with this Decision.
Art. 7 - The use of the MERCOSUR symbols will not enable its appropriation by the user, nor will it generate any rights over them. In no case will such symbols be able to register as marking or integrating a marking set.
Art. 8 - The Common Market Group, where it deems appropriate, may regulate this Decision.
Art. 9 - From its entry into force, this Decision repeals Decision CMC No. 01/98.
