PRODUCTION ALGODONERA Ley 26.060 Créase el Plan de Desarrollo Sustentable y Fomento de la producción Algodonera. Algodonero Agricultural Insurance. The Senate and Chamber of Deputies of the Argentine Nation assembled in Congress, etc. sanction with force of Law:

SUSTAINABLE DEVELOPMENT PLAN AND ALGODONERA PRODUCTION

ARTICLE 1 Consider the Sustainable Development and Promotion of Algodonere Production Plan with application in regions or areas that, due to their ecological characteristics, productive culture and seed areas, bring together the character of " Algodonean specialization". The Implementation Authority will identify regions, provinces or areas that meet this character.

ARTICLE 2 The Secretariat of Agriculture, Livestock, Fisheries and Food of the Ministry of Economy and Production of the Nation shall be the Authority for the Application of this Law.

PART I

AGRICOLA ALGODONERO

Article 3 Authorize the national executive branch and the provinces that accede to this law to hire insurance and related services, and/or financially assist the producer in the hiring of the same, against the extraordinary drops of production due to the climatic, physical, thermorial and biological adversities that affect a cotton geographical area identified as such by the Implementing Authority.

ARTICLE 4 The national executive branch and/or the provinces adhering to this law shall extend the coverage to the producers through the effective transfer of the rights to compensation provided for in the insurance contracts, held by the national and/or provincial State.

ARTICLE 5o The contracting of the insurance provided for in Article 3 shall entail the loss of the right to enjoy the benefits of the Agricultural Emergency Act 22.913 in accordance with Article 9 of the said rule.

The loss of the right referred to in the preceding paragraph may not be opposed to the producer in the event of failure to collect the compensation for such insurance for any reason not attributable to its liability.

ARTICLE 6 The Implementation Authority will assist insurers and reassurers, through the provision of the necessary information, through agricultural risk maps and other available data and methodologies, in order to optimize the assessment of the risks affecting cotton production.

PART II

INCOME COMPENSATION FUND FOR ALGODONERA PRODUCTION

CHAPTER I:

ARTICLE 7 Please refer to the Fund for Compensation of Income for Algodonera Production (FCIPA) in order to ensure the sustainability of cotton cultivation through mechanisms to mitigate the effects of abrupt and negative price oscillations and promote long-term certainty for each cotton producer.

CHAPTER II: DURATION

ARTICLE 8 The Fund shall be established for a term of ten (10) years, from the date of entry into force of this Act.

(Note Infoleg: by art. 1 Act No. 26,933 B.O. 30/5/2014, extends the constitution of the Fund established in this article, for a term of ten (10) years from the date of entry into force of the reference law)

CHAPTER III

BENEFITS AND ACCESS CONDITIONS

Article 9 The Fund will benefit the cotton producers who meet the following conditions:

(a) They must register, to voluntarily receive the Fund plan, in advance of planting, during the months of July and August of each calendar year.

(b) The exploitation for which compensation is sought is in the area defined by the Implementation Authority.

(c) Be a period of time to apply for the Fund ' s benefits for the operations of sale of raw cotton and/or fibre and seed by the producers actually made and verified, the period from February to August, inclusive, each year.

CHAPTER IV: FUNDING

ARTICLE 10. The Implementation Authority will define at the beginning of each cotton campaign the reference price.

CHAPTER V: UNDER FUND AND FINANCING

ARTICLE 11. The initial constitution of the Fund will be made, on the basis of fifty million pesos ($ 50,000.000), through a subsidy provided by the funds of the National Treasury, being able to grow the same in a programmed form depending on the sown acres.

(Note Infoleg: by art. 2° of the Act No. 26,933 B.O. 30/5/2014, a hundred and sixty million pesos ($ 160,000) are extended to the Fund for Compensation of Income for Algodonean Production (FCIPA) created by Article 7 of Chapter I of Title II of this Law. This amount that may be increased in terms of economic circumstances that justify it will be financed through a provision covered by the National Treasury included in the General Budget of the Nation)

ARTICLE 12. The Fund shall be administered by the Implementation Authority in order to ensure that the objectives of this Act are met.

ARTICLE 13. Invite the cotton producing provinces to adhere to this law.

ARTICLE 14. Contact the national executive branch.
