ARTICLE 1 : The following text is added at the end of article 70 (e), of Law 24.065, as follows:For the purpose of determining the surcharge that constitutes the National Electrical Energy Fund (FNEE), the above-mentioned value will be affected by a quarterly adequacy coefficient (CAT) for seasonal periods. This quarterly adequacy coefficient (CAT) will result in the consideration of the net turnover of generators by the term and spot contracts in the wholesale market corresponding to the immediate quarter prior to the liquidation, divided the total energy (in MWh) involved in that billing, and its comparison with the same ratio for the May/July 2003 quarter that will be taken as a basis.
ARTICLE 2 This calculation mechanism shall enter into force from the first quarter after the validity of this law. Article 3 Contact the Executive.IN THE SESSION OF THE ARGENTINE CONGRESS, IN GOOD AIRES, TO THE TWENTY DAYS OF THE NUMBER OF THE YEAR DOS MIL CUATRO.
