CODIGO ENAL Law 25.816 Modifications. Sanctioned: November 12, 2003 promulgated: December 5, 2003

The Senate and Chamber of Deputies of the Argentine Nation assembled in Congress, etc. sanction with force of Law:

ARTICLE 1 Incorporate as article 80, paragraph 9, Title 1, Chapter 1, of the Criminal Code of the Nation, the following:

9.- Taking advantage of his role or position, when he is an integral member of the security, police or prison forces.

ARTICLE 2 Incorporate as article 163 bis, Title 6, Chapter 1, of the Criminal Code of the Nation, the following:

Article 163 bis . In the cases set forth in this Chapter, the penalty shall be increased by one third at a minimum and at a maximum, when the person who executes the offence is an integral member of the security, police or prison forces.

ARTICLE 3 Incorporate as article 167 bis, Title 6, Chapter 2, of the Criminal Code of the Nation, the following:

Article 167 bis . In the cases set forth in this Chapter, the penalty shall be increased by one third at a minimum and at a maximum, when the person who executes the offence is an integral member of the security, police or prison forces.

ARTICLE 4 Contact the national executive branch.
