PROTOCOL
Concerning the authentic text in six languages
Convention
on International Civil Aviation
(Chicago, 1944)
THE FIRMING GOVERNMENTS,
CONSIDERING that, in resolution A31-16 of its thirty-first session, the Assembly requested, inter alia, the Council and the Secretary-General to take the necessary steps to intensify the progressive use of the Chinese language in the International Civil Aviation Organization (ICAO) and to monitor these measures closely in order to ensure that the Chinese language is used at the same level as the other languages of the Organization;
CONSIDERING that the English text of the International Civil Aviation Convention (hereinafter referred to as "the Convention") was opened for signature in Chicago on December 7, 1944;
CONSIDERING that, in accordance with the Protocol signed in Buenos Aires on 24 September 1968 on the authentic trilingual text of the Convention on International Civil Aviation, done in Chicago on 7 December 1944, the text of the Convention was adopted in the Spanish and French languages and, together with the text of the Convention in English, constitutes the equally authentic text in the three languages as provided for in the final clause of the Convention;
CONSIDERING that, on 30 September 1977, a Protocol was adopted on an amendment to the Convention on International Civil Aviation and a Protocol relating to the authentic quadrennial text of the Convention on International Civil Aviation (Chicago, 1944), which establish the authenticity of the text of the Convention and its amendments in the Russian language;
CONSIDERING that, on 29 September 1995, a Protocol on an Amendment to the Convention on International Civil Aviation and a Protocol relating to the authentic quinquennial text of the International Civil Aviation Convention (Chicago, 1944) were adopted, establishing the authenticity of the text of the Convention and its amendments in the Arabic language;
CONSIDERING that, therefore, it is appropriate to adopt the necessary provisions for the existence of the text of the Convention in the Chinese language;
CONSIDERING that, in adopting such provisions, it should be taken into account that there are amendments to the Convention in the Spanish, Arabic, French, English and Russian languages, whose texts are equally authentic and that, in accordance with Article 94, paragraph (a), of the Convention, any amendment shall only enter into force with respect to the States that have ratified it;
They've agreed to the following:
Article I
The Chinese language text of the Convention and the amendments thereto to this Protocol constitutes, together with the text of the Convention and the amendments thereto in the Spanish, Arabic, French, English and Russian languages, an equally authentic text in the six languages.
Article II
If a State Party to this Protocol has ratified or in the future ratifys any amendment made to the Convention in accordance with Article 94, paragraph (a), of the Convention, it shall be considered that the text in the Spanish, Arabic, Chinese, French, English and Russian languages of such amendment refers to the equally authentic text in the six languages resulting from this Protocol.
Article III
1. The States members of the International Civil Aviation Organization may be Parties to this Protocol by:
(a) signature, without reservation of acceptance, or
(b) signature, subject to acceptance, followed by acceptance, or
(c) acceptance.
2. The present Protocol shall be open for signature in Montreal until 16 October 1998 and thereafter in Washington, D.C.
3. Acceptance will be carried out by depositing an instrument of acceptance with the Government of the United States of America.
4. Accession to this Protocol or its ratification or approval shall be regarded as acceptance of it.
Article IV
1. This Protocol shall enter into force on the thirtieth day after twelve States, in accordance with the provisions of Article III, have signed it without reservation of acceptance or have accepted it after the amendment to the final clause of the Convention adopted on 1 October 1998, which provides that the text of the Convention in the Chinese language shall be deemed equally authentic.
2. With regard to any State that is subsequently a Party to this Protocol, in accordance with the provisions of Article III, the Protocol shall enter into force on the date of signature without reservation of acceptance or acceptance.
Article V
The accession of a State to the Convention after this Protocol has entered into force shall be considered as acceptance of this Protocol.
Article VI
Acceptance of this Protocol by a State shall not be regarded as ratification of any amendment to the Convention.
Article VII
As soon as this Protocol enters into force, it will be registered with the United Nations and the International Civil Aviation Organization by the Government of the United States of America.
Article VIII
1. This Protocol shall remain in force as long as the Convention is.
2. This Protocol shall cease to be in force with respect to a State only when the State ceases to be a party to the Convention.
Article IX
The Government of the United States of America shall inform all States members of the International Civil Aviation Organization and the Organization itself:
(a) any signature of this Protocol and the date thereof, indicating whether the signature was made without reservation or subject to acceptance;
(b) the deposit of any instrument of acceptance and the date thereof;
(c) the date on which the present Protocol enters into force in accordance with Article IV, paragraph 1.
Article X
The present Protocol, which is drafted in the Spanish, Arabic, Chinese, French, English and Russian languages, shall be deposited in the archives of the Government of the United States of America, which shall transmit duly certified copies thereof to the Governments of the States members of the International Civil Aviation Organization.
IN TESTIMONY OF WHAT ANYTHING, the undersigned Plenipotentiaries, duly authorized, have signed this Protocol.
