Implementation of actions. General principles. Integration. Functions, rights and obligations.

The Senate and Chamber of Deputies of the Argentine Nation assembled in Congress, etc. sanction with force of Law:

LAW OF COOPERADORES

ARTICLE 1 — The national State, the provinces and the Autonomous City of Buenos Aires guarantee — according to the National Education Act 26,206 — the participation of families and the educational community in the school institutions in general and, in particular, through the school cooperatives, as an area of participation of families in the institutional educational project, in order to collaborate in the educational process of students.

ARTICLE 2° — The implementation of the actions provided for in this Act shall be governed by the following general principles:

(a) Integration of the educational community.

(b) Democratization of education management.

(c) Improved school establishments.

(d) Promoting solidarity and cooperation practices.

(e) Promotion of equal treatment and opportunities.

(f) Promotion of educational inclusion.

(g) Defence of public education.

ARTICLE 3° — The respective jurisdictions shall give specific rules to promote and regulate the creation and strengthening of cooperatives, the recognition of existing ones and the monitoring and control of their functioning. They will also implement a registry in each jurisdiction and establish the policy framework that will allow school cooperatives to manage their resources.

ARTICLE 4° — School cooperatives will consist of parents, guardians or legal representatives of students and at least one (1) director of the educational institution. Teachers, pupils over the age of eighteen (18) and ex-alumnos of the institution may be part of the cooperative, as well as other members of the community, as provided for by the jurisdictional regulations.

ARTICLE 5° — School cooperatives shall issue their respective statutes by regulating their organization and the election of their authorities, having to have at least one president, one secretary, one treasurer.

The Statute shall be issued in compliance with the regulations establishing each jurisdiction, as appropriate.

ARTICLE 6° — School cooperatives may:

(a) To receive contributions and subsidies from national, provincial or municipal authorities.

(b) To receive contributions from its members, which shall in no case be mandatory for them.

(c) Funding through organized activities with the consent of the school authorities, as well as receiving contributions and/or donations from individuals, companies and civil society organizations. In no case may the funds received by these contributions have as a counterpart their explicit publication in advertising or propagandistic terms of the donor.

ARTICLE 7° — The functions of the school cooperatives include:

(a) Participate in actions aimed at promoting equality and strengthening democratic citizenship in educational institutions.

(b) To contribute to the improvement of the quality of the school space conditions, by collaborating in the maintenance and improvement of the school building and its equipment.

(c) To undertake cultural, recreational and sporting activities within the framework of the institutional projects of the respective establishment.

(d) Collaborate in the integration and inclusion of sectors of the community that are in situations of educational vulnerability or are excluded from schooling.

(e) Carry out solidarity activities with other school cooperatives.

(f) To receive and execute subsidies for the maintenance of educational establishments, the provision of furniture and equipment, the acquisition of supplies, teaching and bibliographic materials.

ARTICLE 8° — The Ministry of Education will design, in coordination with the jurisdictional authorities, dissemination campaigns on the importance of citizen cooperation and participation in the educational field, highlighting the social role of school cooperatives.

ARTICLE 9° — School cooperatives may be nuclear-armed in judicial, regional and national cooperative councils. The Ministry of Education, through the regulation of this Act, shall have the mechanisms for the participation of these councils in the Consultative Council for Education Policy of the Federal Council for Education.

ARTICLE 10. - The rights and obligations under this Act do not preclude the exercise of community participation in the terms laid down in articles 128 and 129 of the National Education Act 26,206.
