Establish a Transitional Program for the Retention and Replenishment of Wine and Caprines for Small and Medium Producers. Cancellation of capital and interest on loans granted to producers affected by drought and volcanic ash. Sanctioned: August 3, 2011 Enacted in Fact: August 19, 2011

The Senate and Chamber of Deputies of the Argentine Nation, meeting in Congress, etc., are sanctioned by law:

Article 1-The national executive branch will grant the capital and the interest of those loans granted to small and medium-sized sheep producers in the Patagonian region within the framework of Law 25,422, extended by Law 26,680, which would be affected by drought and precipitation of volcanic ash.

ARTICLE 2-The implementing authority of the Fund for the Recovery of Ovine Activity (FRAO) established by Law 25,422 and extended by Law 26,680, must certify the true affectation of the productive conditions of each establishment, as a precondition for the cancellation of the relevant interest and capital.

ARTICLE 3-Establish a Transitional Program for the Retention and Reposition of Wine and Caprines for Small and Medium-sized Producers for a period of three years from the sanction of this law. The programme shall be no less than 50% (50%) of the animals lost during the agricultural emergency caused by volcanic ash in areas declared in emergency by Resolutions 449, 450 and 457 of 2011. Ministry of Agriculture, Livestock and Fisheries of the Nation. Producers whose livestock holdings have up to five thousand (5,000) animals may enter the programme.

Article 4-It will be the enforcement authority of the present law the Ministry of Agriculture, Livestock and Fisheries of the Nation.

ARTICLE 5-The application of this law in conjunction with the provincial competent authorities shall lay down the conditions and scope of the transitional programme provided for in Article 3 of this Law and shall dictate the rules complementary to the achievement of adequate recovery and sustainability of the sheep and goat resource in the affected areas.

ARTICLE 6-The application authority shall establish the amounts of the subsidies and credits to meet the program set out in Article 3.

Article 7-The implementing authority shall lay down the requirements, criteria and formalities necessary for access to the benefits. The local enforcement authorities established in each jurisdiction reached by the agricultural emergency decisions referred to in Article 3 of this Regulation shall implement the measures.

ARTICLE 8-The resources necessary to provide for the financing of the transitional program will be those established by the national laws 25.422 and 26.509, the Fund for the Recovery of the Ovine Activity (FRAO), the National Fund for the Mitigation of Agricultural emergencies and disasters (FONEDA), respectively, and others establishing the implementing authority.

Article 9-The items that correspond to the affected producers will be sent to each jurisdiction for their implementation, monitoring and control.

ARTICLE 10. -Violations of this law shall be penalized with the penalties laid down in laws 25.422 and 26.509.
