Thus, and in order to ensure the attainment of these aims, the law of higher education seeks to regulate the whole system of higher education.

Higher education in Andorra is today, at the beginning of the 21st century, facing new challenges arising from the increasingly intense interaction with European environment. From the statements of the Sorbonne (1998) and Bologna (1999) the majority of countries and the entire University community in Europe have entered an intense process of convergence of their respective higher education systems. With the desire to participate actively in this process, the Principality of Andorra adapts its legal system in the field of higher education, in accordance with the principles of the so-called European area of higher education.

Guarantee the quality of higher education, promote the mobility of students and teachers, set up a flexible system of qualifications based on three university cycles, adopt the European Diploma Supplement to the diploma and promote learning throughout life and the European dimension in higher education, are the main objectives behind the construction of the European area of higher education. These are some of the major challenges to which you want to answer with this law.

But not we start from scratch. The higher education model developed from the creation by law of the University of Andorra in 1997 has reached the full consolidation. Today it is necessary to define new objectives but to the future development of our system of ensenyaPerò don't we start from scratch. At the same time, continue deepening in the modernization of the University system and in higher professional education is an imperative linked to the necessary process of modernization of our society. It is necessary to provide a new dimension in higher education in order to continue responding to the training needs of the citizens and, at the same time, to be able to offer a contribution in the international community, with the ability to attract students, teachers and researchers from other countries. The adaptation to the new international environment requires the demarcation between the two major methods of higher education: University studies and of higher professional education, as is made explicit in the structure of the law.

The law, which is divided into four titles, defined in the preliminary title the general legal status of a model of higher education, which is composed of the University system and by higher education establishments, and which is developed by the University teaching and research activities.

In the first, the law regulates public university education, developed through the University of Andorra. The chapter I establishes the public nature of the University of Andorra, created by law in 1997, and recognizes, in the context of the law, their autonomy. Finally, in the fourth, the law establishes the legal regime of private higher education. The starting point is the recognition of the principle of freedom of education and maintains a high level of demand at the same time to acknowledge, on the part of public authorities, the creation of universities or the establishments of higher professional education of a private character.

Article 5 governing bodies and representation of universities 1. The law and the rules of organisation and operation of the universities establish their governing bodies and representation, as well as the procedures for their appointment and revocation.

Article 6 the structure and objectives of the higher professional education 1. The higher professional education is structured in establishments, cor1. -Adapt the offerings to the needs of the labour market.

-To provide students with information and guidance in the area of vocational training and qualifications for the job.

-Make sure the balance between theory and practice, encouraging training stays in various companies.

Article 7 Access 1. Can access to higher education, all students who have obtained the degree of Bachelor or equivalent provisions of the regulations and have passed the entrance examinations that have been established, either in general or for certain schools.

Article 8 academic titles 1. The Government establishes the qualifications, of any grade, who have State character.

Article 9 Powers of inspection and evaluation


The Government exercises its powers of inspection and evaluation with respect to universities and higher professional education establishments in Andorra, by the relevant bodies for the development of the powers mentioned above.

Article 10 Nature of institutions of higher education 1. Are public universities and higher professional education establishments created in accordance with this law and to develop the purposes set forth in article 3 of the law.

Title i. Of the public university education at the University of Andorra chapter i. Article 15 public Character and autonomy of the University of Andorra 1. Article 17 of the governing bodies 1. For the academic and administrative functions, are the governing bodies of the University of Andorra the University Council, the rector, the centre directors and the Manager.

2. To exercise administrative functions, the ordinary organ of Government is the Manager.

3. The holders of governing bodies may exercise under partial dedication and in exclusive dedication.

Article 18 composition and functions of the University Council 1. The University Council is the highest authority of the pluripersonal University of Andorra. At the same time, is the body through which the society participates in the University.

2. The University Council has the following composition: a) the rector, who is the Chair.

b) two members representing the Administration appointed by the Government.

c) two members appointed by the teachers elected by and from among the Group of teachers.

Chapter III. Structure and funding of the University of Andorra Article 29 Structure in centres and areas 1. In order to accomplish their goals and develop their functions, the University is divided into faculties, schools and departments.

2. The Center is the organizational unit and management in the field of which the necessary courses and research programmes are developed enough to get the titles of the State or, if appropriate, are degrees or diplomas from the University.

3. The Department is the unit responsible for organizing and developing, in one or more schools, the teaching and research of its respective discipline, as well as to carry out other activities which by nature may reciprocate. Every teacher has to belong necessarily to a certain area.

Article 33 cooperation agreements 1. The University may establish agreements with foreign universities in order to encourage mutual aid, Exchange and cooperation. Teachers and assistants are responsible for the tasks of teaching and research.

4. The teaching staff is hired in accordance with the labor law in Andorra. The basic remuneration is set by the Government of Andorra. The contract can set this premium remuneration, as well as other specific characteristics.

5. f) Exercise the functions assigned to the place of work and any others that may arise from their relationship with the University, in accordance with the statutes and other rules that are established.

g) to participate in all matters affecting the University life, according to the established by these statutes and the applicable regulations.

h) respect the other members of the University community and peaceful coexistence.

Section 4a. Article 45 disciplinary Responsibility and disciplinary teaching staff non-teaching staff are subject to disciplinary liability under the terms and conditions set forth in this law.

Article 46 types of infringements 1. The offences committed by the teaching and non-teaching staff in the exercise of their duties will qualify for serious offences and of very serious offences.

2. Constitutes serious breach of any of the duties of teaching and non-teaching personnel established in this law.

3. Are very serious offences: a) the unjustified absence for a period exceeding three days.

b) The repeated and unjustified lack of punctuality and attendance.

c) the physical or mental abuse and the exile to students, teachers and non-teaching staff.

d) Procure for itself or for third parties, improper economic benefits, taking advantage of the position or the work place.

f) recidivism in serious offences.

e) enjoy representation in the National Commission of the higher Professional education.

f) to exercise freedom of expression, Assembly and Association in the field of higher professional education establishments.

3. Students have, in addition, the following duties: a) to develop the activity of study with the dedication and the necessary exploitation.

b) comply with the rules and internal regulations of the higher professional education and taking care of instruments and materials made available to you.

Article 55 1 Staff. The staff of the higher professional education is composed of teachers and non-teaching staff.

4. The Ministry in charge of higher education must issue a report on the project within a maximum period of six months from the presentation of the project. If the report is positive, the Government, within a period of two months, he has to send a Bill to the General Council.
