Law 5/2011, of 30 June, credit supplement to finance the costs of the application of the article 86.2 f) of law 17/2008, of 3 October, of the social security since the General Council in its session of the 30th of June 2011 has approved the following: law 5/2011, 30 June , credit supplement to finance the costs of the application of the article 86.2 f) of law 17/2008, of 3 October, of the social security statement of reasons the entry into force, on 1 November 2009, the law 17/2008, of 3 October, social security has been an important reinforcement of the social policy and solidarity, funded by the transfer of the Government in the Caixa Andorrana de Seguretat Social (CASS). In accordance with article 86.2 f) of the aforementioned Law, the Government has to finance possible deficits that may occur in the general branch.

Specifically, this law has created new benefits at the expense of the general branch, as are all the benefits derived from occupational diseases, unemployments for temporary disability of people who carry out an activity for own account and the performance of paternity. Also modified the requirements necessary to be able to access some economic benefits, reducing waiting periods, and have increased the amount of disability pension benefits and salary benefits for temporary disability, with a significant increase in cases of work-related accidents. It should be added that the disability pensions of people who have between 60 and 65 years before being retirement branch finance assumed by the general. The law provides that these economic benefits the CASS take part of the quotation, which has also involved a higher expenditure of this branch. It should also be noted that has set an amount for the pensions of orphanhood, which before assumed the retirement and now are in charge of this branch, and by the end, it is necessary to mention that the law provides for the right to some policyholders have health coverage of 100% without a co-payment, which increase the cost of benefits for reimbursement.

Likewise, the law 17/2008, of 3 October, social security also States that the Government, in addition to finance possible deficits that may occur in the general branch, should contribute to the financing of the expenses of the general branch, of the branch of the retirement and family benefits. In this sense, this law also has meant the funding, Government transfer to the CASS, of the non-contributory benefits and contributions and family benefits, as well as the membership fees to the social security of the people interned in prisons settle in the Principality of Andorra.

Finally, you need to do here is that the reinforcement of the benefits that the law 17/2008, of 3 October, of the social security contributes only in part the deficit of the general branch of the CASS, since this branch has a deficit that can be considered for permanent structural nature in recent years as a result of the following factors mainly : the decrease of the income from contributions of the CASS because of the economic downturn that live Andorra initiated during the second half of 2007, with a continuous decrease in the number of wage earners; the aging of the population and the consequent increase in the number of pensioners, the economic benefits and reimbursement of which assumes the CASS; the application of the law 4/2006 of 7 April, of urgent measures and specific reform of the system in which they establish improvements in the rights of insured persons; new technologies applied to medicine, the number of chronic diseases, the consumption of drugs and health services.

Currently, the deficit of the general branch of the CASS for the year 2011 is encrypted in 35,485,393.91 euros, 33,760,141.50 euros of which are borne by the Government. Since the first quarter of this year, the Government has made cash at the CASS the amount of 6,639,138.84 euros, the amount estimated to liquidate is 27,121,002.66 euros.

Seen that the Government does not have sufficient budgetary credits to cover the deficit of the general branch for the amount mentioned.

Seen that the character of necessity and urgency of this expense is justified by the fact that the Government should have the budgetary credits to meet the amounts deriving from the application of the legislation in the area of Social Security;

Seen the report of the General intervention;

Seen the governmental agreement of 1 June 2011;

Article 1 approves a charge of credit for an amount of 27,121,002.66 euros, for the following budget heading: Public Health Department 610-613 area of budget management and administrative support health-41112 Caixa Andorrana de Seguretat Social-PROJ-0021 General Services.

Article 2 This credit fee is financed through a new debt.

Final provision this law shall enter into force the day after being published in the official bulletin of the Principality of Andorra.
