Law 15/2012, 12 July, amending article 24.2 of the law 22/2011, from 29 December, of the budget for the financial year 2012 since the General Council in its session of July 12, 2012, has approved the following: law 15/2012, 12 July, amending article 24.2 of the law 22/2011 , 29 December, the budget for the financial year 2012 exhibition of illustrations by means of a resolution adopted at the meeting of 8 June 2012, the General Council entrusted the Government to take the necessary provisions in order to fill the vacancies of members of the police force who have given up or leave the body by way of retirement in order to maintain a size of police force that enables us to preserve and improve the excellent levels of public safety what is the Principality of Andorra.

In addition, the Superior Council of Justice has stated to the Government that, in order to maintain the proper functioning of the administration of Justice, it is necessary to cover immediately the judicial Secretary vacancies that are generated.

But the article 24 of the law 22/2011, from 29 December, of the budget for the financial year 2012, prevents the selection procedures for admission of new officers during the current financial year, and while it is true that the same standard expected, exceptionally, the possibility to authorize the hiring of staff even tual, this possibility does not solve the needs of mainly international police body or court clerks, which would not be suitable cover with temporary staff.

On the other hand, compliance with the international commitments of the Principality of Andorra with the MONEYVAL, the OECD and el GRECO, as well as those deriving from the signing of the monetary agreement with the European Union, involves the unavoidable need for the INAF, the UIF and the Ministry of finance have, since during this year, specialized personnel, in this case, it may be possible for but that, even so, it may not be hired without violating the constraints imposed by the above rule.

For this reason, it is necessary to modify the article 24 of the law of the budget for the financial year 2012, in order to relax the limitations provisions and make possible the selection procedures of revenue to cover the vacancies of the squares of the police force and the judicial secretaries, and the recruitment of specialized personnel that is essential because the INAF , the UIF and the Ministry of finance to be able to comply with the international commitments acquired by the Principality of Andorra.

Article only modifies the terms of paragraph 2 of article 24 of the law 22/2011, from 29 December, of the budget for the financial year 2012, which is worded as follows: "2. During the financial year 2012 general management vacancies that are generated, including retirements, cannot be covered by external personnel, with the exception of the vacancies occurring in the police force and court clerks.

The Minister responsible for finance and public service, with the approval of the Minister, may authorize the coverage of external staff vacancies for the projects that are strategically priorities. In these cases, merely cover vacancies with external temporary staff up to 10% of the seats.

Exceptionally, and to the needs deriving from compliance with international commitments acquired by the Principality of Andorra, you can authorize the hiring of temporary staff ".

Final provision this law enters into force on the day of its publication in the official bulletin of the Principality of Andorra.
