CIRCULAR

Amending and supplementing a number of provisions of the Public Security Ministry's Circular no. 11/2003/tt-bca(c11) of july 3, 2003, guiding the grant of permits for, and control of operation of, means of transport temporarily imported for re-export within a definite period of time

On July 3, 2003, the Ministry of Public Security issued Circular No. 11/2003/TT-BCA(C11), guiding the grant of permits for, and control of operation of, means of transport temporarily imported for re-export within a definite period of time. In the course of implementation, difficulties and problems have arisen in the grant of permits for vehicles temporarily imported for re-export within a definite period of time. In order to meet the practical requirements, the Ministry of Public Security hereby issues amendments and supplements to a number of provisions of Circular No. 11/2003/TT-BCA(C11) of July 3, 2003 as follows:

1. Point 1 of Part I "General provisions" is supplemented as follows:

For motorcycles and mopeds which are temporarily imported for re-export within a definite period of time into the Vietnamese territory for circulation within border-gate areas, permits are not required.

2. Point 1, Section A of Part II "Procedures and dossiers of application for permits" is amended and supplemented as follows:

Particularly for motorcycles and mopeds, their owners or operators who apply for temporary import thereof into Vietnam through border gates must submit copies of the following papers, enclosed with their originals for comparison, to agencies competent to grant permits:

- The written registration of the vehicle;

- The passport or laissez-passer;

- The driving license (as required according to regulations and compatible with the type of the vehicle).

Where the owners cannot carry out the procedures, they may authorize others to do so according to law.

Where motorcycles or mopeds are circulated only within border-gate areas, permits are not required but the above-said papers (originals) must be produced to customs offices or border guards for examination and entry into monitoring books.

3. Point 3, Section B of Part II "Cases where vehicles temporarily imported for re-export are circulated within provinces or cities having border gates for more than 5 (five) days or circulated outside such provinces or cities" is amended as follows:

Within 3 (three) days after receiving the valid dossiers, directors of provincial/municipal Police Departments shall have to grant permits to temporarily imported means for circulation within provinces or cities having border gates for more than 5 (five) days or for circulation outside such provinces or cities.

Dossiers of application for permits shall be submitted to the Traffic Police Sections of the Police Departments of the provinces or cities having border gates; for localities where exist the Waterway Navigation Police Sections, the dossiers of application for permits for of boats or canoes shall be submitted thereto.

4. Organization of implementation:

This Circular takes effect 15 days after its publication in "CONG BAO." Other matters not mentioned in this Circular shall still comply with the provisions of the Public Security Ministry's Circular No. 11/2003/TT-BCA(C11) of July 3, 2003.

The General Department of Police shall have to direct, guide and inspect the implementation of this Circular.

The Road and Railway Traffic Police Department and directors of provincial/municipal Police Departments shall have to strictly implement the provisions of this Circular and other provisions of law concerning the grant of permits for, and control of operation of, means of transport temporarily imported for re-export within a definite period of time.
