SECTION 46-12-13
§ 46-12-13 Civil penalties.
Except as specified in §§ 46-12-26 and 46-12-27, any person who shall
violate the provisions of this chapter, or of any permit, rule, regulation, or
order issued pursuant thereto, shall be subject to a civil penalty of not more
than twenty-five thousand dollars ($25,000) for each day during which the
violation occurs. In an action for enforcement brought in the superior court
pursuant to this chapter or chapters 12.3, 12.4, or 12.5 of this title, the
court also may order any person to pay to the director any and all costs
incurred in the investigation, cleanup, and restoration of areas affected by
pollutants in connection with any violation. Nothing herein contained shall be
construed to limit the amount of monetary relief which the court can award in
any action brought pursuant to any other provision of the general laws or
pursuant to common law.
