   § 36-7-16  Eligibility to vote in

referendum. –

Only eligible employees as defined in § 218(d)(3) of the federal Social

Security Act, 42 U.S.C. § 418(d)(3), as amended, shall be eligible to vote

in the referendum. Persons who have retired and who are in receipt of payment

from the retirement system shall be ineligible to vote.
