      STATUTORY AUTHORITY:

KRS 351.335

      NECESSITY, FUNCTION,

AND CONFORMITY: KRS 351.335 requires the Department for Natural Resources to

promulgate rules and administrative regulations concerning the manufacture,

transportation, sale, storage, or use of explosives and unassembled components

of explosives, and the maintenance of such explosives which has a direct

bearing on safety to life and property. This administrative regulation effects

the provisions of that law.

 

      Section 1. Storage

of Explosives and Blasting Agents. (1) Explosives and related materials shall

be stored in approved facilities required under the applicable provisions of

the Internal Revenue Service regulations contained in 27 CFR 55, Commerce in

Explosives.

      (2) Blasting caps,

electric blasting caps, detonating primers, and primed cartridges shall not be

stored in the same magazine with other explosives or blasting agents.

      (3) Smoking and open

flames shall not be permitted within fifty (50) feet of explosives and

detonator storage magazines.

      (4) Permanent

underground magazines containing detonators shall not be located closer than

twenty-five (25) feet to any magazine containing other explosives or blasting
