      NECESSITY, FUNCTION, AND CONFORMITY: KRS 304.48-230

states that the executive director may promulgate reasonable administrative

regulations necessary for the proper administration of KRS Chapter 304 Subtitle

48. Pursuant to KRS 304.48-220(1)(e), the executive director should establish a

reasonable time period for a liability self-insurance group to correct a violation

of KRS Chapter 304 Subtitle 48 or related administrative regulations.

 

      Section 1. If a liability self-insurance group

fails to correct a violation of KRS Chapter 304 Subtitle 48 or related

administrative regulations within thirty (30) days of receiving notice of the

violation pursuant to KRS 304.2-120, the executive director may suspend or

revoke the certificate of filing of the liability self-insurance group.

 

      Section 2. Additional thirty (30) day time periods

may be granted by the executive director upon a showing by the liability

self-insurance group and determination by the executive director of good cause

for each extension. A request for extension shall be submitted in writing not

less than ten (10) days prior to the running of each thirty (30) day time

period. The request for extension shall contain sufficient detail to permit the

commissioner to make an informed decision.

 

      Section 3. A liability self-insurance group shall

notify the executive director in writing and provide supporting documentation immediately

upon correcting a violation of KRS Chapter 304 Subtitle 48 or related administrative
