Use of Payment Standards to Establish Need
(1) Need is the amount at the Department's payment standards that represents the client's need for items covered by the benefit.
(2) Special needs are costs in addition to standard allowances.
(3) In the GA and GAM programs, ongoing special needs are used to determine benefit amount as specified in OAR 461-160-0500.
(4) In the OSIP and OSIPM programs:
(a) The special need described in OAR 461-155-0630(2) is used to determine initial and ongoing eligibility.
(b) Except for individuals whose eligibility is determined based on the special need described in OAR 461-155-0630(2), special needs are used when determining the benefit amount or the client liability.

Prorated Standards; Adjusted Number in Household
(1) Prorated standards are used only
in the no-adult tables and the non-SSI OSIP and OSIPM table.
(2) In the OSIP and OSIPM
programs:
(a) Prorated standards only
apply when an individual or a couple receives free food and shelter from others
living in the household, and the individual or couple does not have an ownership
interest or rental liability in the residence.
(b) Prorated standards are
not applied to cases in which an individual receives services described in OAR chapter
411, division 015.
(c) Shelter-in-kind (see
OAR 461-145-0470) may apply when prorated standards are not used.
(3) In the TANF program,
the no-adult tables are used when there are no adults in the TANF need group (see
OAR 461-110-0630).
(4) Prorated standards are
based on the number of people in the need group, compared to the adjusted number
in the household group (see OAR 461-110-0210). The adjusted number in the household
is determined by taking the total number of individuals in the household, minus
the following individuals unless they are included in the need group:
(a) Unborns.
(b) Individuals receiving
long-term care (see OAR 461-001-0000) or home and community-based care (see OAR
461-001-0030).
(c) Foster children.
(d) Children receiving adoption
assistance.
(e) Live-in attendants who
live with the filing group (see OAR 461-110-0310) solely to provide necessary medical
or housekeeping services and are paid to provide these services.
(f) Landlords and tenants.
A landlord-tenant relationship exists if one person pays another at fair market
value (see OAR 461-001-0000) for housing and if:
(A) The filing group lives
independently from the landlord or tenant;
(B) The filing group has
and uses sleeping, bathroom, and kitchen facilities that are separate from the landlord
or tenant; and
(C) If bathroom or kitchen
facilities are shared, the housing must be a commercial establishment that provides
either room, board, or both for fair market value compensation.
(g) In the OSIP and OSIPM
programs only:
(A) The biological and adoptive
children of either spouse (see OAR 461-001-0000).
(B) Recipients of GA, OCCS
Medical Programs (see OAR 461-001-0000), OSIP, OSIPM, QMB, or TANF.

Income and Payment Standards; MAA,
MAF, REF, SAC, TANF
In the JOBS, REF, and TANF programs,
the income standards are as follows:
(1) The Countable Income
Limit Standard is the amount set as the maximum countable income limit.
(a) For each need group (see
OAR 461-110-0630) in the REF and TANF programs containing an adult, the following
table is used: [Table not included. See ED. NOTE.]
(b) In the TANF program,
a caretaker relative (see OAR 461-001-0000) other than a parent (see OAR 461-001-0000)
who chooses not to be included in the need group is subject to the "no-adult countable
income limit standard" for the need group under subsection (c) of this section.
The "non-needy countable income limit standard" for the filing group (see OAR 461-110-0330)
is set at 185 percent of the federal poverty level (see OAR 461-155-0180).
(c) In the REF and TANF programs,
when the need group contains no adults, the "no adult countable income limit standard"
is calculated as follows:
(A) Refer to the Countable
Income Limit Standard for need groups with adults. Use the standard for the number
of individuals in the household group (see OAR 461-110-0210).
(B) Divide the standard in
paragraph (A) of this subsection by the number of individuals in the household group.
Round this figure down to the next lower whole number if the figure is not a whole
number.
(C) Multiply the figure from
paragraph (B) of this subsection by the number of individuals in the need group.
The result is the standard.
(d) In the JOBS program,
for the filing group of a non-custodial parent who resides in Oregon and whose dependent
child (see OAR 461-001-0000) is receiving TANF program benefits in Oregon to participate
in an activity (see OAR 461-001-0025) of the JOBS program, the countable (see OAR
461-001-0000) income limit is set at 185 percent of the federal poverty level (see
OAR 461-155-0180).
(2) The Adjusted Income/Payment
Standard is used as the adjusted income limit and to calculate cash benefits for
need groups with an adult.
(a) For need groups containing
an adult in the REF and TANF programs, except as provided otherwise in subsection
(b) of this section, the following table is used: [Table not included. See ED. NOTE.]
(b) To calculate cash benefits
for a need group with an adult in the REF and TANF programs, the following table
is used: [Table not included. See ED. NOTE.]
(c) In the REF and TANF programs,
when the need group contains no adult, the No-Adult Adjusted Income/Payment Standard
is calculated as follows:
(A) Refer to the Adjusted
Income/Payment Standard for need groups with adults. Use the standard for the number
of individuals in the household group.
(B) Divide the standard in
paragraph (A) of this subsection by the number of individuals in the household group.
Round this figure down to the next lower whole number if the figure is not a whole
number.
(C) Multiply the figure from
paragraph (B) of this subsection by the number of individuals in the need group.
(D) Add $12 to the figure
calculated in paragraph (C) of this subsection.

Cooperation Incentive Payment Standard; REF, TANF
(1) The cooperation incentive is a monthly payment added to the TANF cash grant. OAR 461-135-0210 explains who is eligible for this incentive payment.
(2) Except as provided in section (4) of this rule, when there is an adult in the need group, the incentive payment is based on the number of people in the need group as follows:
(a) One person — $26.
(b) Two people — $32.
(c) Three people — $43.
(d) Four people — $52.
(e) Five people — $52.
(f) Six people — $75.
(g) Seven people — $75.
(h) Eight or more people — $109.
(3) Except as provided in section (4) of this rule, when there is no adult in the need group, the incentive is calculated as follows:
(a) The payment authorized by section (1) of this rule is determined based on the number of people in the household group rather than in the need group. For instance, if there are three people in the household group, the amount used for this calculation is $43.
(b) The figure obtained in subsection (a) of this section is divided by the number of people in the household group, and the result is rounded to the next lower whole number.
(c) The figure obtained in subsection (b) of this section is multiplied by the number of people in the need group. The result is the incentive payment.
(4) All Cooperation Incentive payments end on September 30, 2010. Beginning October 1, 2010, no client in the REF or TANF program will receive a Cooperation Incentive Payment.

Payment Standard for AFC and RCF; REF, TANF
For REF and TANF, the payment standard for one person in AFC or RCF is the same as the adjusted income standard for a need group with one adult per OAR 461-155-0030. The payment, minus a $30 personal allowance for clothing and personal incidentals, is for room and board.

Income and Payment Standard; EA
(1) The income limit in the EA program is the TANF adjusted income or payment standard found in OAR 461-155-0030(2). A client is ineligible for emergency assistance in any month he or she is eligible for the TANF program unless the grant for that month is less than the payment standard only because the grant was prorated for the month.
(2) EA benefits are limited as follows:
(a) The program will provide only the minimum amount necessary to meet the emergent need.
(b) The maximum EA benefit amount for the 30-day eligibility period is $100.
(c) Payments for food cannot exceed the maximum SNAP allotment by household size.
(d) The client is not eligible for an EA payment unless the payment enables the client to resolve the emergent need in its entirety without receiving JOBS support service payments (see OAR 461-190-0211 and 461-190-0221).

Child
Care Eligibility Standard, Payment Rates, and Copayments
The following provisions apply to child
care in the ERDC, JOBS, JOBS Plus, and TANF programs:
(1) The following definitions
apply to the rules governing child care rates:
(a) Infant: For all providers
other than licensed (registered or certified) care, a child aged newborn to 1 year.
For licensed care, an infant is a child aged newborn to 2 years.
(b) Toddler: For all providers
other than licensed (registered or certified) care, a child aged 1 year to 3 years.
For licensed care, a toddler is a child aged 2 years to 3 years.
(c) Preschool: A child aged
3 years to 6 years.
(d) School: A child aged
6 years or older.
(e) Special Needs: A child
who meets the age requirement of the program (ERDC or TANF) and who requires a level
of care over and above the norm for his or her age due to a physical, behavioral,
or mental disability. The need for a higher level of care must be determined by
the provider and the disability must be verified by one of the following:
(A) A physician, nurse practitioner,
clinical social worker, or any additional sources in OAR 461-125-0830.
(B) Eligibility for Early
Intervention and Early Childhood Special Education Programs, or school-age Special
Education Programs.
(C) Eligibility for SSI.
(2) The following definitions
apply to the types of care specified in the child care rate charts in subsections
(4)(a) through (4)(c) of this rule:
(a) The Standard Family Rate
applies to child care provided in the provider's own home or in the home of the
child when the provider does not qualify for the enhanced rate allowed by subsection
(b) of this section.
(b) The Enhanced Family Rate
applies to child care provided in the provider's own home or in the home of the
child when the provider meets the training requirements of the Oregon Registry,
established by the Oregon Center for Career Development in Childhood Care and Education.
(c) The Registered Family
Rate applies to child care provided in the provider's own home when the provider
meets criteria established by the Office of Child Care.
(d) The Certified Family
Rate applies to child care provided in a residential dwelling that is certified
by the Office of Child Care as a Certified Family Home. To earn this designation,
the facility must be inspected, and both provider and facility are required to meet
certain standards not required of a registered family provider.
(e) The Standard Center Rate
applies to child care provided in a facility that is not located in a residential
dwelling and is exempt from Office of Child Care Certification rules (see OAR 414-300-0000).
(f) The Enhanced Center Rate
applies to child care provided in an exempt center whose staff meet the training
requirements of the Oregon Registry established by the Oregon Center for Career
Development in Childhood Care and Education. Eligibility to receive the enhanced
center rate for care provided in an exempt center is subject to the following requirements:
(A) A minimum of one staff
member for every 20 children in care must meet the Oregon Registry training requirements
noted in subsection (b) of this section.
(B) New staff must meet the
Oregon Registry training requirements within 90 days of hire, if necessary to maintain
the trained staff-to-children ratio described in paragraph (A) of this subsection.
(C) There must be at least
one person present where care is provided who has a current certificate in infant
and child CPR and a current American Red Cross First Aid card or an equivalent.
(g) An enhanced rate will
become effective not later than the second month following the month in which the
Department receives verification that the provider has met the requirements of subsection
(b) or (f) of this section.
(h) The Certified Center
Rate applies to child care provided in a center that is certified by the Office
of Child Care.
(3) The following provisions
apply to child care payments:
(a) Providers not eligible
for the enhanced or licensed rate will be paid at an hourly rate for children in
care less than 158 hours per month subject to the maximum full-time monthly rate.
(b) Providers eligible for
the enhanced or licensed rate will be paid at an hourly rate for children in care
less than 136 hours a month, unless the provider customarily bills all families
at a part-time monthly rate subject to the maximum full-time monthly rate and is
designated as the primary provider for the case.
(c) At their request, providers
eligible for the enhanced or licensed rate may be paid at the part-time monthly
rate if they provide 63 or more hours of care in the month, customarily bill all
families at a part-time monthly rate, and are designated as the primary provider
for the case.
(d) Unless required by the
circumstances of the client or child, the Department will not pay for care at a
part-time monthly or a monthly rate to more than one provider for the same child
for the same month.
(e) The Department will pay
at the hourly rate for less than 63 hours of care in the month subject to the maximum
full-time monthly rate.
(f) The Department will pay
for up to five days each month the child is absent if:
(A) The child was scheduled
to be in care and the provider bills for the amount of time the child was scheduled
to be in care; and
(B) It is the provider's
policy to bill all families for absent days.
(g) The Department will not
pay for more than five consecutive days of scheduled care for which the child is
absent.
(4) The following are the
child care rates based on the type of provider, the location of the provider (shown
by zip code), the age of the child, and the type of billing used (hourly or monthly):

(5) Except to the extent
provided otherwise in section (12) of this rule, this section establishes the ERDC
eligibility standard and the client's copayment (copay).
(a) At initial certification,
the ERDC eligibility standard is met for a need group (see OAR 461-110-0630) of
eight or less if monthly countable income (see OAR 461-001-0000) for the need group
is less than 185 percent of the federal poverty level (FPL), as described in OAR
461-155-0180(6). The eligibility standard for a need group of eight applies to any
need group larger than eight.
(b) During the certification
period (see OAR 461-001-0000) and at recertification the ERDC eligibility standard
is met for a need group of eight or less if monthly countable income for the need
group during the 12 month period is less than 85 percent state median income (SMI)
or 250 percent FPL, whichever is higher, as described in OAR 461-155-0180(8) and
(9). The eligibility standard for a need group of eight applies to any need group
larger than eight.
(c) The minimum monthly ERDC
copay is $25.
(d) For a filing group (see
OAR 461-110-0310) whose countable income is at or below 50 percent of the 2007 FPL,
the copay is $25 or 1.5 percent of the filing group's monthly countable income,
whichever is greater.
(e) For a filing group whose
countable income is over 50 percent of the 2007 FPL, the copay amount is determined
with the following percentage of monthly income:
(A) Divide the filing group's
countable income by the 2007 FPL, drop all digits beyond two decimal points, subtract
0.5, and multiply this difference by 0.12.
(B) Add .015 to the amount
in paragraph (A) of this subsection. This sum is the percentage of monthly income
used to determine the copay amount. Multiply this sum by the filing group’s
countable income and round to the nearest whole dollar.
(f) The 2007 federal poverty
level used to determine copay amounts under subsections (d) and (e) of this section
is set at the following amounts: [Table not included. See ED. NOTE.]
(6) Subject to the provisions
in section (9) of this rule, the monthly limit for each child's child care payments
is the lesser of the amount charged by the provider or providers and the following
amounts:
(a) The monthly rate provided
in section (4) of this rule.
(b) The product of the hours
of care, limited by section (8) of this rule, multiplied by the hourly rate provided
in section (4) of this rule.
(7) The limit in any month
for child care payments on behalf of a child whose caretaker is away from the child's
home for more than 30 days because the caretaker is a member of a reserve or National
Guard unit that is called up for active duty is the lesser of the following:
(a) The amount billed by
the provider or providers.
(b) The monthly rate established
in this rule for 215 hours of care.
(8) The number of payable
billed hours of care for a child is limited as follows:
(a) In the ERDC and TANF
programs, the total payable hours of care in a month may not exceed the amounts
in paragraphs (A) or (B) of this subsection:
(A) 125 percent of the number
of child care hours authorized:
(i) Under OAR 461-160-0040(2)
and (5); or
(ii) To participate in activities
included in a case plan (see OAR 461-001-0025) including, for clients in the JOBS
Plus program, the time the client searches for unsubsidized employment and for which
the employer pays the client.
(B) The monthly rate established
in section (4) of this rule multiplied by a factor of not more than 1.5, determined
by dividing the number of hours billed by 215, when the client meets the criteria
for extra hours under section (10) of this rule.
(b) In the ERDC program,
for a client who earns less than the Oregon minimum wage, the total may not exceed
125 percent of the anticipated earnings divided by the state minimum wage not to
exceed 172 hours (which is full time).
(c) In the TANF program,
for a client who earns less than the Oregon minimum wage or is self-employed, the
total may not exceed 125 percent of the anticipated earnings divided by the state
minimum wage not to exceed 172 hours (which is full time). The limitation of this
subsection is waived for the first three months of the client's employment.
(d) In the ERDC program,
employed caretakers eligible under OAR 461-135-0400 may have education hours added
to the authorized work hours. Education hours may not exceed authorized work hours
and combined hours may not exceed 215 hours per month. Education hours are hours
required to participate in coursework that leads to a certificate, degree, or job-related
knowledge or skills attainment at an institution of higher education approved to
receive federal financial aid.
(9) The limit in any month
for child care payments on behalf of a child whose caretaker has special circumstances,
defined in section (10) of this rule, is the lesser of one of the following:
(a) The amount billed by
the provider or providers; or
(b) The monthly rate established
in section (4) of this rule multiplied by a factor, of not more than 1.5, determined
by dividing the number of hours billed by 215.
(10) The limit allowed by
section (9) of this rule is authorized once the Department has determined the client
has special circumstances. For the purposes of this section, a client has special
circumstances when it is necessary for the client to obtain child care in excess
of 215 hours in a month to perform the requirements of his or her employment or
training required to keep current employment, not including self-employment. This
is limited to the following situations:
(a) The commute time to and
from work exceeds two hours per day.
(b) The caretaker works an
overnight shift and care is necessary for both work hours and sleep hours.
(c) The caretaker works a
split shift and it is not feasible to care for the child between shifts.
(d) The caretaker consistently
works more than 40 hours per week.
(11) The payment available
for care of a child who meets the special needs criteria described in subsection
(e) of section (1) of this rule is increased in accordance with OAR 461-155-0151
if the requirements of both of the following subsections are met:
(a) The child requires significantly
more direct supervision by the child care provider than normal for a child of the
same age.
(b) The child is enrolled
in a local school district Early Intervention or Early Childhood Special Education
program or school-age Special Education Program. The enrollment required by this
subsection is waived if determined inappropriate by a physician, nurse practitioner,

(12) Starting May 1, 2012:
(a) The minimum monthly ERDC
copay is $27.
(b) Except as stated in subsection
(a) of this section, the Department adds 10 percent to the monthly client copay
amount set under section (5) of this rule by multiplying the copay amount by 1.1
and rounding down to the nearest whole dollar.
(13) A provider caring for
a child in a contracted child care slot with the Department will be paid the lesser
of the monthly rate provided in section (4) of this rule or the amount charged by
the provider.

High Special Needs; Child Care
(1) The payment authorized by OAR 461-155-0150(11) is calculated by adding the applicable special need payment authorized by section (4) of that rule to the additional amount determined by this rule.
(2) The additional amount determined by this rule is allowed in consideration of the additional cost to a child care provider for the additional care and supervision required because of a child's physical, mental or behavioral condition. To determine the additional amount, a factor determined by this rule is multiplied by:
(a) $2.50 for a payment calculated on an hourly basis; or
(b) $420 for a payment calculated on a monthly basis.
(3) The factor used to make the calculation described in section (2) of this rule is determined by first establishing a score for each category listed in section (5) of this rule. The score is established by multiplying a rating and the weight for each category. The weight is given in section (5). The rating is determined as follows:
(a) The child's need for care and supervision is assessed and is compared with the needs of other children of the same age, and a rating is determined for each category. The rating is a whole number from zero to ten.
(b) Benchmark scores are given in section (5) of this rule for each category using several descriptions of need. The child's level is matched with the benchmark descriptions, and a rating is assigned based on a comparison of the child's needs and the benchmark descriptions. If a child's level of need falls between -- or is described in part by -- two benchmarks in the rule, an appropriate intermediate rating is assigned based on the benchmarks scores.
(4) After a score is determined for each category, the scores are added. The sum of the scores is changed to 100 if it is less than 110 and is reduced to 300 if it exceeds 300. The adjusted score is decreased by 100, and the remainder is divided by 100. The result is the factor used in section (2) of this rule.
(5) The categories, their weights, and standards for their ratings are as follows:
(a) Level of medical care -- weight is 7:
(A) Child requires on-site medical attention by a licensed medical or mental health professional and the child care provider must have specialized training related to the child's medical or mental health needs -- rating of 10.
(B) The provider must have specialized training related to the child's medical or mental health needs and consults frequently with a medical or mental health professional -- rating of 8.
(C) Child requires medical attention by a caregiver who has received some specialized training related to the child's medical or mental health needs -- rating of 4.
(D) Child requires medical attention or monitoring by a caregiver who has received special instructions from the parent or a service provider related to the child's medical or mental health needs -- rating of 1.
(E) Child's needs can be met by staff with general knowledge -- rating of zero.
(b) Self-sufficiency with daily tasks -- weight is 5:
(A) Child requires total assistance with eating or toileting, such as requiring tube feedings or with special toileting needs, such as ostomy care -- rating of 10.
(B) Child requires considerable assistance in eating or toileting -- rating of 5.
(C) Child requires only minor assistance with eating or toileting -- rating of 1.
(D) Child can take care of daily tasks with very little assistance -- rating of zero.
(c) Mobility -- weight is 5:
(A) Child is unable to help with positioning or movement, needs frequent repositioning, and the child is difficult to move -- rating of 10.
(B) Child can help with transfers, pivoting and position -- rating of 5.
(C) Child is able to move independently with minor support -- rating of 1.
(D) Child's mobility is similar to other children of the same age -- rating of zero.
(d) Communication skills -- weight is 6:
(A) Child is unable to communicate needs and wants, and is unable to use alternative communication methods -- rating of 10.
(B) Child relies entirely upon alternative methods such as sign language, picture boards, gestures, or facial expressions, to communicate the child's needs or to understand requests made of the child -- rating of 8.
(C) Child has limited verbal skills. The child may require one-on-one communication to gain the child's attention, simplify instructions, or to understand the child's speech or gestures. Child may use alternative methods, mentioned in paragraph (B) of this sub-section, as a supplement to verbal skills -- rating of 4.
(D) Child's communication skills are roughly similar to other children of the same age -- rating of zero.
(e) Need for monitoring and intervention -- weight is 11:
(A) The child must remain within the child care provider's direct view at all times and needs frequent intervention to prevent harm to self or other children -- rating of 10.
(B) The child must remain within the provider's direct view at all times but does not need frequent intervention -- rating of 7.
(C) Child has behaviors that frequently require adult intervention but are not a threat to the child's or other children's safety -- rating of 4.
(D) Child needs assistance to initiate, respond to, or engage in peer interactions that are safe, positive, and appropriate -- rating of 2.
(E) Child needs some assistance but generally does well if the assistance is provided -- rating of zero.
(f) Cognition and comprehension -- weight is 7:
(A) Child is unable to recognize danger, is unable to follow instructions without one-on-one assistance, and has difficulty processing basic sensory information about the environment. This does not include vision or hearing as the primary difficulty -- rating of 10.
(B) Child needs to be given one instruction at a time and may need reminders of what was asked in order to complete instruction -- rating of 5.
(C) Child is able to understand and solve problems with some special attention -- rating of zero.
(g) Other special considerations -- weight is 5. There are other considerations relating to the level of supervision required for the child that are not included in the above categories. A rating is determined based on how much more supervision the child needs -- because of the other consideration -- than other children of the same age.

Income and Payment Standard; OSIPM
(1) An individual who is assumed eligible
per OAR 461-135-0010(6) is presumed to meet the income limits for the OSIPM program.
(2) An individual in a nonstandard
living arrangement (see OAR 461-001-0000) meeting the requirements of 461-135-0750,
who is not assumed eligible and does not meet the income standards set out in section
(4) of this rule, must have countable (see 461-001-0000) income that is equal to
or less than 300 percent of the full SSI standard for a single individual (except
OSIPM-EPD) or have established a qualifying trust as specified in 461-145-0540(9)(c).
(3) The OSIPM (except OSIPM-EPD)
adjusted income standard takes into consideration the need for shelter (housing
and utilities), food, and other items. The standard is itemized as follows: [Table
not included. See ED. NOTE.]
(4) An individual, other
than one identified in section (1), (2), or (6) of this rule, must have adjusted
income below the standard in this section. The Department determines the adjusted
number in the household under OAR 461-155-0020. [Table not included. See ED. NOTE.]
(5) In the OSIPM (except
OSIPM-EPD) program, an individual in a nursing facility or an ICF-MR is allowed
the following amounts for clothing and personal incidentals:
(a) For an individual who
receives a VA pension based on unreimbursed medical expenses (UME), $90 is allowed.
(b) For all other individuals,
$60 is allowed.
(c) For an individual identified
in subsection (b) of this section with countable income (including any SSI) that
is less than $60, the payment standard is equal to the difference between the individual's
countable income (including any SSI) and $60. For the purposes of this subsection,
countable income includes income that would otherwise be countable for an individual
who is assumed eligible under OAR 461-135-0010.
(6) In the OSIPM-EPD program,
the adjusted earned income limit is 250 percent of the federal poverty level for
a family of one.

Pursuit of Cost-Effective
Employer Sponsored Health Insurance
(1) This rule applies to the following
medical assistance programs: CEM, EXT, GAM, MAA, MAF, OHP (except OHP-CHP and OHP-OPU),
and OSIPM and is for the purpose of applying OAR 461-120-0345.
(2) The Health Insurance
Group (HIG) determines if employer sponsored health insurance meets the criteria
as cost effective for the purpose of OAR 410-120-1960.
(3) If the insurance is determined
to be cost effective and the client or eligible applicant pursues the insurance,
HIG will authorize reimbursement of the client or eligible applicant's portion of
the premium per OAR 410-120-1960.
(4) If the insurance is determined
to be cost effective and the client or eligible applicant fails to pursue cost effective
employer sponsored insurance, the Department will apply a penalty per OAR 461-120-0345.

Special Needs; Overview
(1) Ongoing special needs are
needs that last several months at a consistent cost. Examples are special diets
and accommodation allowances. OAR 461-155-0010 is used to determine how special
needs are considered for each program.
(2) To be eligible for a special
need item, a client may not have any other available resources in the community
or natural support system to meet the need, excluding resources used in determining
eligibility.
(3) To be eligible for a special
need item, a client may not be eligible for the item through Medicare, Medicaid,
or any other medical coverage.
(4) A client may be eligible
for an ongoing special need item if providing the ongoing special need item is authorized
in lieu of additional provider service hours pursuant to OAR 411-030-0002 to 411-030-0090
and is more cost-effective.
(5) The Department may authorize
payment for one-time and ongoing special needs for the following, in accordance
with OAR 461-155-0510 to 461-155-0710:
(a) One-time needs for the following:
(A) Community based facility
room and board (see OAR 461-155-0630).
(B) Community transition services
(see OAR 461-155-0526).
(C) Diversion and transition
services (see OAR 461-155-0710).
(D) Home adaptations to accommodate
a client's physical condition (see OAR 461-155-0551).
(E) Home repairs (see OAR 461-155-0600).
(F) Moving costs (see OAR 461-155-0610).
(G) Property taxes (see OAR
461-155-0620).
(b) Ongoing needs for the following:
(A) Accommodation allowances

Special Need; Community Transition Services; OSIP and OSIPM
(1) In the OSIP and OSIPM programs, the Department will authorize one-time payments for allowable expenses necessary for a client to set up housing in Oregon in the client's own home or apartment, or an assisted living facility as long as the facility is not required to provide the item covered by the payment by contract or by the administrative rules governing assisted living facilities (OAR 411-054-0000 to 411-054-0300). Payments are allowed only for a client returning to the community if the client meets the criteria for one of the service priority levels served by the Department according to OAR 411-015-0015(1):
(a) A client leaving a nursing facility.
(b) A client who has been admitted as an inpatient and is leaving an acute care hospital.
(2) Examples of allowable expenses are expenses for: moving belongings; housing security deposits; essential furnishings; eating utensils; food preparation items; deposits for utility hook-ups for heat, electricity, and telephone; climate control; and health and safety measures such as pest eradication or allergen control.
(3) Expenses not allowed include: rent for housing or temporary housing; ongoing utility costs; medical supplies such as lift chairs, reachers, grabbers, wheelchairs, and transfer trays; or recreational items such as a television or cable television access.
(4) Payment will be authorized only for the minimum amount necessary to establish the client's basic living arrangement.

Special Need; Food for Guide Dogs and Special Assistance Animals
(1) For an OSIP or OSIPM program client
receiving SSI, having an adjusted income less than the OSIPM program standard under
OAR 461-155-0250, or receiving home and community-based care (see OAR 461-001-0030),
a food allowance is allowed for guide dogs and special assistance animals that are
individually trained to:
(a) Meet the client's specific
medical needs by performing tasks, such as alerting and protecting a client who
is having a seizure; or
(b) Perform specific physical
tasks that the client is unable to do, such as picking up items that are dropped,
turning on light switches, and pulling a wheelchair.
(2) The maximum amount the
Department authorizes for this special need is $50 per month.
(3) Authorization of this
special need must be based on a proven medical need to sustain the client's independence.

Special Need; Home Adaptations to Accommodate a Client's Physical Condition
(1) In the OSIP and OSIPM programs, the Department will authorize -- consistent with the restrictions in this rule -- a one-time special needs payment for a home adaptation required by the client’s care plan, if the adaptation is needed to accommodate the client’s physical condition and prevent the client’s placement in a nursing facility.
(2) For a home adaptation:
(a) The client must be the owner or buyer of the house.
(b) The adaptation must cost less than moving to another home.
(c) Payment is limited to the lowest possible cost that will provide adequate facilities. The client must provide three competitive bids for the repairs, unless there are not three providers of the service in the local area.
(d) Providers of the adaptations must ensure that the work being completed meets current building codes.
(e) Adaptations authorized by this rule include only changes to the structure of the building, such as installation of ramps, grab-bars, and railings; widening of doorways; modification of bathroom facilities; and installation of electric and plumbing systems necessary to accommodate the client’s medical equipment or supplies.

(1) The Department may provide
a monthly supplementary payment for a client who meets the requirements of all of
the following subsections:
(a) The client must receive
SSI as his or her only source of income.
(b) The client must receive

Personal Care Services authorized under chapter 411, division 034 of Oregon Administrative
Rules.
(2) An eligible client (under
section (1) of this rule) receives a $15 monthly payment. The payment is considered

Special Need; Laundry Allowances
(1) OSIP and OSIPM clients who are receiving
SSI or home and community-based care (see OAR 461-001-0030) or have adjusted income
less than the OSIPM program income standard under OAR 461-155-0250, and GA and GAM
clients, are eligible for a laundry allowance if they have proven, excessive, coin-operated
laundry facility costs and do not:
(a) Have their own laundry
facilities; or
(b) Reside in an adult foster
care home, assisted living facility, nursing facility, residential care facility,
or specialized living facility, unless the specialized living facility is apartment
based.
(2) This allowance may not
exceed the amount required to wash and dry the laundry.

Special Need; Home Repairs, GA, OSIP, and OSIPM
In the GA, OSIP, and OSIPM programs, the Department will authorize a special need payment for home repairs for homeowners or buyers as a one-time special need within the following limits:
(1) The repairs must be needed to remove a physical hazard to the health and safety of the client.
(2) Payment for repairs authorized by this rule:
(a) Is limited to the least expensive means possible;
(b) Cannot exceed $1,000 in any 24-month period; and
(c) When the home is jointly owned, is limited to a percentage of the cost of the repairs equal to the percentage of client ownership.
(3) The repairs must cost less than moving to another home.
(4) Payment is limited to the lowest possible cost that will provide adequate facilities. The client must provide three competitive bids for the repairs, unless there are not three providers of the service in the local area.
(5) Before approving payment for repairs or new installations, the Department must consider the use value and determine whether it is consistent with the service plan for the client to remain in the house.
(6) Providers of the repairs or new installations must ensure that the work being completed meets current building codes.
(7) Repairs or replacements include, but are not limited to:
(a) Electrical wiring that does not constitute conversion to electrical space heating but that is needed:
(A) To avoid condemnation; or
(B) To remove a definite fire or shock hazard as documented by appropriate public officials.
(b) Plumbing — but not including the costs of plumbing items with which the house is not already equipped except that a toilet may be paid for when newly required by the creation or extension of a sewer district. Examples of what plumbing-related items may be covered include:
(A) Toilets and sinks.
(B) Cleaning or replacing septic tanks or cesspools.
(C) Installing sewer connections from house to street--but not sewer installation -- if required by the creation of a new sewer district or the extension of an existing district.
(c) Repair or replacement of existing electric pumps for wells needed to continue the water supply. This does not include drilling a new well.
(d) Heating equipment — repair of heating stoves, furnaces and water heaters and, if repair is not possible, replacement with the least expensive adequate equipment.
(e) Repair of roofs.
(f) Repair or replacement of steps and repair of floors.
(8) A client with a life estate is not eligible for this special need allowance. The individual who will benefit from the life estate, following the death of the client, is considered responsible for the home repairs.

Special Need; Moving Costs; GA, OSIP, OSIPM
For clients who
are 18 years of age or older in the GA, OSIP, and OSIPM programs:
(1) The
Department will authorize payment for the cost of moving a client's household effects
as a one-time special need if the requirements of at least one of the following
subsections are met:
(a) Moving
is essential to provide nonhazardous housing. "Hazardous" housing means a building
so deteriorated and unsafe that it is uninhabitable or subject to condemnation.
If no official certification to that effect can be obtained, the condition of the
dwelling must have been seen by a Department employee and documented in the case
record.
(b) The
client has been evicted for reasons other than his or her own neglect or failure
to make rent or house payments.
(c) The
move is a result of domestic violence or protective services.
(d) For
a client in a nonstandard living arrangement (see OAR 461-001-0000), the client
must move because the level of needed services increases or decreases.
(e) The
needs of the client would be better met out of state.
(2) Payment
for moving costs authorized by this rule:
(a) May
be authorized for not more than one move in any 12-month period;
(b) Is
limited to the least expensive means possible; and
(c) Cannot
exceed $500 in any 12-month period.
(3) Payments
necessary for a one-time move may be made over a period not to exceed 30 consecutive
days.
(4) A
filing group that has received a payment for moving costs under this rule is not
eligible for a moving cost payment again until the first day of the 12th month following
the first payment that was made for the most recent month.

Special Need; Property Taxes
(1) GA, OSIP and OSIPM clients who are homeowners or buyers are allowed a special need of one year of delinquent real property taxes, penalties and interest, if needed to prevent imminent foreclosure.
(2) Clients who are eligible for the Oregon Property Tax Deferral Program must opt to defer property taxes. If necessary, the state may provide payment for back property taxes, to bring the tax current, to allow clients to defer their ongoing property taxes.
(3) Clients who have not chosen to defer their property taxes, and have failed to pay their property taxes, will not receive a property tax special need payment unless the exception is authorized by the Department's Estate Administration Unit. The exception will be based on the value of the property, the potential of foreclosure and the potential of an Estates Administration Unit recovery of such property.
(4) "Imminent foreclosure" is indicated by a formal notice of foreclosure.

Special Need; Community Based Care; OSIPM
In the OSIPM program:
(1) A client is considered
living in a community based care facility (see OAR 461-001-0000) if the client resides
at one of the following care settings licensed by the Department:
(a) Adult Foster Care.
(b) Residential Care.
(c) Assisted Living.
(d) Specialized Living.
(e) Group Care Home.
(2) In determining eligibility
for OSIPM for an individual receiving care in a 24-hour mental health residential
care setting, such as an adult foster home, residential treatment home, residential
treatment facility, or a secure treatment facility, the special need (see OAR 461-155-0010)
is the amount of the service payment authorized by the Department and is added to
the OSIP maintenance standard.
(3) If a client who meets
the applicable income requirements begins living in a community based care facility:
(a) Payment for room and
board may be authorized during the month of admission at the initial placement,
limited to the approved rate.
(b) Room and board payments
may be paid to the community based care facility during the temporary absence of
a client if all of the following criteria are met:
(A) The absence occurs because
the client is admitted to a hospital or nursing home.
(B) The Department determines
the intent of the client to return to the community based care facility.
(C) The community based care
facility is willing to accept the room and board payment.
(D) The client returns one
month following the month in which the absence began.
(4) Spouses who each receive
SSI and receive services in a community based care facility, are eligible for a
payment in the amount that equals the difference between the OSIPM standard for
a one-person need group and the individual's total countable income. If one spouse
has income above the OSIPM standard, the excess income is applied to the other spouse's
countable income.

Special Need; Restaurant Meals
(1) To receive the restaurant meals
special need payment, OSIP and OSIPM clients who are receiving SSI, home and community-based
care (see OAR 461-001-0030), or have adjusted income less than the OSIPM program
income standard under OAR 461-155-0250 — and GA and GAM clients — must
have proven medical and nutritional needs that cannot be met with meals purchased
with SNAP program benefits.
(2) A client living in his
or her own home who is unable to prepare his or her own meals, but is eligible for
SNAP program benefits, may have his or her meals prepared by attendants that volunteer
or are compensated by the Seniors and People with Disabilities Division In-Home
Services program. A client also may receive, if eligible, Meals on Wheels services
to supplement his or her diet.
(3) The payment standard
for restaurant meals is $60 per month.

Special Need; Accommodation Allowance
(1) An OSIP or OSIPM program client
living in a nursing facility is not eligible for an accommodation allowance. An
OSIP or OSIPM program client living in a nonstandard living arrangement (see OAR
461-001-0000) is not eligible for an accommodation allowance unless he or she is
receiving, or is eligible to receive after a temporary absence, home and community-based
care (see OAR 461-001-0030) in-home services. An OSIP or OSIPM program client receiving
SSI or having an adjusted income less than the OSIPM program income standard (except
a client in a nursing facility) or eligible to receive or receiving home and community-based
care in-home services is allowed an accommodation allowance if the client is 18
years of age or older and meets the criteria in section (2) or (3) of this rule.
(2) Temporary absence of
client from home.
(a) A temporary accommodation
allowance may be authorized, when permitted under section (1) of this rule, if a
client meets the following criteria:
(A) The client leaves his
or her home or rental property and enters an adult foster care facility, assisted
living facility, group care home, hospital, nursing facility, residential care facility,
specialized living facility, or state psychiatric institution;
(B) The client cannot afford
to keep the home without the allowance;
(C) The client will be able
to return home within six months of leaving, according to a written statement from
a primary practitioner, RN, or PAS (pre-admission screening) RN; and
(D) The home will accommodate
the service plan of the client when the client returns.
(b) The allowance may be
authorized for six months. If, after six months, the client continues to meet the
criteria in subsection (a) of this section, an extension may be approved in writing
by a supervisor.
(c) The accommodation allowance
equals the total of the client's housing cost, including taxes and insurance, plus
the limited standard utility allowance for the SNAP program provided in OAR 461-160-0420.
(3) Additional cost for accommodation.
A client meeting the criteria in section (1) of this rule may receive an accommodation
allowance if the client's shelter cost exceeds the shelter standard in OAR 461-155-0250(2)
and the requirements of one of the following subsections are met:
(a) The client has a documented
increase in rent associated with access by an individual with a disability; or
(b) The client has been assessed
to need a live-in provider, has accepted the services of a live-in provider, and
requires an additional bedroom for the live-in provider.
(4) The accommodation allowance
is determined as follows:
(a) For a client who receives
an accommodation allowance based on increased costs associated with access by an
individual with a disability, only the additional increase in cost for the accommodation
is allowed.
(b) For a client who receives
an accommodation allowance based on the need for an additional bedroom for a live-in
provider, the amount of the accommodation allowance is the limited standard utility
allowance for the SNAP program under OAR 461-160-0420 plus:
(A) One-third of the monthly
rental cost; or
(B) One-third of the monthly
payment on the property agreement (including mortgage, trust deed, or land sale
contract). The property agreement is the agreement existing at the time the client
is approved for the accommodation allowance. The accommodation allowance for the
housing portion ends if the debt is refinanced, unless the refinancing was done
only to reduce the original property agreement's interest rate or total monthly
payment amount and the owner realized no direct or indirect payment of the home's
equity value from the refinancing.
(i) If the refinancing requirement
under this paragraph is met, the amount of the accommodation allowance is one-third
of the refinanced property agreement amount plus the limited standard utility allowance
under OAR 461-160-0420.
(ii) If the refinancing requirement
under this paragraph is not met and the housing portion of the accommodation allowance
ends, the client remains eligible only for the limited standard utility allowance
portion under OAR 461-160-0420.
(5) Special requirements.
(a) A client who rents and
qualifies for an allowance under section (3) of this rule must take the steps necessary
to obtain subsidized housing under any federal or state housing program. A client
who fails, at any time, to take the steps necessary to obtain subsidized housing
reasonably available is ineligible for the allowance. A client, who has been denied
or revoked from participation in any rent subsidy program based on the client's
own actions is ineligible for benefits under this rule.
(b) A client who rents housing
and refuses subsidized housing will no longer be eligible for an accommodation allowance,
except that if the housing that is offered is not suitable, related to accommodations,
and the client continues to have increased costs related to accommodations in the
client's current living situation, the accommodation allowance may continue until
such time as appropriate subsidized housing is found.

Special Need; Special Diet Allowance
(1) In the GA, GAM, OSIP, OSIPM, REF,
REFM, SFPSS, and TANF programs, a client is not eligible for a special diet allowance
if receiving any of the following:
(a) Room and board.
(b) Residential care facility
services or assisted living facility services.
(c) Nursing facility services.
(d) Adult foster care services.
(e) An allowance for restaurant
meals.
(f) A commercial food preparation
diet.
(2) A GA, GAM, REF, REFM,
SFPSS, or TANF client, or an OSIP or OSIPM client receiving SSI, having an adjusted
income less than the OSIPM program income standard under OAR 461-155-0250, or receiving
in-home services is eligible for a special diet allowance if the client meets the
following requirements:
(a) The client would be in
an imminent life-threatening situation without the diet, as verified by medical
documentation from a Department-approved medical authority (see OAR 461-125-0830);
and
(b) A nutritionist verifies
that the special diet needed exceeds the cost of a regular diet.
(3) The amount of a special
diet allowance is calculated as follows:
(a) In the REF, REFM, SFPSS,
and TANF programs, the difference between the actual cost of the special diet and
a prorated share of the SNAP program benefit for the appropriate number of clients
in the benefit group (see OAR 461-110-0750).
(b) In the GA, GAM, OSIP,
and OSIPM programs, the lesser of the following:
(A) The difference between
the actual cost of the special diet and the amount provided in the basic standard
for food (see OAR 461-155-0250).
(B) A maximum of $300 per
month, or an exceptional amount, authorized by the SPD Program Assistance Section,
which will not exceed the cost of home IV therapy.
(4) Local management staff
must approve the request for a special diet allowance.
(5) Each special diet allowance
must be reviewed at six-month intervals.

Special Need — Supplemental Telephone Allowance; OSIPM
In the OSIPM program:
(1) The Department
provides a telephone allowance for a client receiving SSI, a client with an adjusted
income less than the OSIPM program standard under OAR 461-155-0250, or a client
receiving in-home services if the client is 18 years of age or older and is unable
to leave his or her residence without assistance due to a documented medical condition.
(2) The telephone
allowance may cover the following costs:
(a) The least
expensive appropriate telephone service or the basic rate, whichever is less.
(b) The cost
of telephone adaptive equipment, if the client has a medically documented need (for
instance, TDD, a special headset, dialing mechanism, or emergency response system).
(c) Necessary
installation charges.
(3) An SSI-eligible
client or a client with an adjusted income less than the OSIPM program standard
granted a telephone allowance must apply for a payment through the Oregon Telephone
Assistance Program (OTAP).

Prescription Drug Co-pay Coverage
In the OSIPM program for a client who is receiving SSI:
(1) The Department will provide a payment for all Medicare Part D or Veteran's Administration Health Care prescription co-pays if a client's co-pays exceed $10 per month.
(2) Payment for Medicare Part D co-pays is limited to the current Low-Income Subsidy (LIS) program amounts for a fully dual eligible individual under 100 percent of the Federal Poverty Limit.
(3) If the payment exceeds $30 per month, it must be approved by Seniors and People with Disabilities Division central office staff.

Special Need; Personal Incidentals and Room and Board Allowances; OSIPM
In the OSIPM program:
(1) In the following circumstances, personal incidentals and room and board allowances may be paid for an individual to reside in a community based care facility (see OAR 461-155-0630) to avoid placement in a nursing facility or leave a nursing facility or an acute care hospital, when an individual meets the requirements of one of the following subsections:
(a) Is determined to be eligible based on a disability determination made by the Department (see OAR 461-125-0370).
(A) To receive this payment, the individual must pursue SSI by making application with the Social Security Administration (SSA) and appealing denials until SSA makes a final administrative decision. If SSI is denied at the final SSA administrative level, the individual is no longer eligible for this payment.
(B) The payment is the difference between the countable (see OAR 461-001-0000) income of the individual and the OSIPM program adjusted income standard (see OAR 461-155-0250).
(b) Is leaving a nursing facility and limited to a maximum SSI payment of $30 or to a maximum Veterans benefit payment of $90. The payment is the difference between the countable income of the individual and the OSIPM program adjusted income standard (see OAR 461-155-0250).
(c) Is a qualified non-citizen under OAR 461-120-0125 who is not eligible for SSI due to not meeting the requirements to become a naturalized citizen within the SSI time limit.
(A) The individual must pursue naturalization.
(B) The payment is the difference between the countable income of the individual and the OSIPM adjusted income standard (see OAR 461-155-0250).
(d) Does not have sufficient income to divert to the community spouse (see OAR 461-001-0030) due to the difference between the personal needs allowance related to a nursing facility placement and the personal needs allowance and room and board related to a community based care facility placement. The allowance is issued only when the individual or community spouse requests or chooses a nursing facility placement rather than a community based care facility placement because the community spouse needs the resulting higher diversion amount to meet his or her monthly expenses.
(A) For all individuals, the allowance is the difference between the amount of the individual's income that would be available to divert to the community spouse under a nursing facility placement and the amount of the individual's income available under the community based care facility placement, using the liability calculation as outlined in OAR 461-160-0620.
(B) For an individual whose income is less than the adjusted OSIPM program standard, the allowance is the amount calculated under paragraph (A) of this subsection plus the difference between the OSIPM program adjusted income standard and the individual's countable income.
(2) The payment amount is prorated in the first month for an individual who moves to a community based care facility on any day other than the first day of the month.

Special Need; Diversion and Transition Services; OSIP and OSIPM
In the OSIP and OSIPM programs:
(1) The Department may authorize
one-time payments for expenses that the Department has determined are necessary
to divert or transition individuals from nursing facility services. Payments are
allowed for clients who are receiving or eligible to receive community based care
(see OAR 461-001-0000).
(2) Payments will be authorized
at the lowest possible cost.
(3) To be eligible for payment,
clients may not be eligible for the item through Medicare, Medicaid, or any other
medical coverage.
(4) Payment for a household
item is not allowed if the community based care facility is required to provide
the item by contract or administrative rule.
(5) Payment is not allowed
if the item or service may be provided under any other special need rule in this
division (OAR 461-155-0510 to 461-155-0700).
