§

1164. Civil penalties

(a) A person who

violates any provision of this chapter or the rules adopted under this chapter,

or who commits any of the acts described in section 1163 of this title shall in

addition to any other penalty be subject to a civil penalty of not more

than  $5,000.00. Each violation shall be

a separate and distinct offense and, in the case of a continuing violation,

each day's continuance thereof shall be deemed a separate and distinct offense.

In no event shall the cumulative penalty exceed 

$25,000.00 per occurrence.

(b) The

secretary may, in the name of the agency, obtain a temporary or permanent

injunction to restrain a violation of this chapter.

(c) After notice

and opportunity for hearing, the secretary may suspend or revoke any license

issued pursuant to chapters 63 and 65 of this title for any violation of this
