The Department of Health and Social Services, in exercise of the powers conferred on it by sections 50(8), 67(3) and 68(1) of, and paragraph 7 of Schedule 5 to, the Disability Discrimination Act 1995(1) and of all other powers enabling it in that behalf, hereby makes the following Regulations:

Citation, commencement and interpretation

1.—(1) These Regulations may be cited as the Northern Ireland Disability Council (No. 2) Regulations (Northern Ireland) 1996 and shall come into operation on 16th August 1996.

(2) In these Regulations—

“the Council” means the Northern Ireland Disability Council established by section 50(2) of the Disability Discrimination Act 1995; and

“the Department” means the Department of Health and Social Services.

(3) The Interpretation Act (Northern Ireland) 1954(3) shall apply to these Regulations as it applies to a Measure of the Northern Ireland Assembly.

Research

2.  The Department may, at the request of the Council, commission research to be undertaken on the Council’s behalf to assist it in the fulfilment of its statutory duties.

Advisers

3.  The Council may appoint a person to act as an adviser to the Council in the following circumstances and subject to the following conditions—

(a)that the person to be appointed has a specialist skill or knowledge which is necessary to assist the Council in the fulfilment of its statutory duties;

(b)that none of the members of the Council has such a specialist skill or knowledge;

(c)that the advice which the Council requires from the person to be appointed is not the function of its members or its staff to provide, and is not otherwise to be provided to the Council under any of the provisions of Schedule 5 to the Disability Discrimination Act 1995;

(d)that except in exceptional circumstances where a longer period of appointment is necessary, the appointment does not exceed 12 months;

(e)that the appointment is made in accordance with procedures agreed between the Council and the Department;

(f)that the Department is satisfied that the circumstances in paragraphs (a) to (c) apply and that the conditions in paragraphs (d) and (e) are met.

Explanatory Note

(This note is not part of the Regulations.)
These Regulations make provision for the Department of Health and Social Services to commission research at the request of the Northern Ireland Disability Council established by section 50 of, as modified in its application to Northern Ireland by Schedule 8 to, the Disability Discrimination Act 1995 (regulation 2). They also prescribe the circumstances in which the Council may appoint advisers, and the conditions subject to which such appointments are to be made (regulation 3).
