The Industrial Training (Construction Board) (Amendment) Order (Northern Ireland) 2010

The Department for Employment and Learning(1) makes the following Order in exercise of the powers conferred by Article 14(1) and (6) of the Industrial Training (Northern Ireland) Order 1984(2) and now vested in it(3).

In accordance with Article 14(2) of that Order, the Department has consulted with those organisations appearing to it to be representative of substantial numbers of employers and employees engaged in the construction industry.

Citation, commencement and interpretation

1.—(1) This Order may be cited as the Industrial Training (Construction Board) (Amendment) Order (Northern Ireland) 2010 and shall come into operation on 31 August 2010.

(2) “the principal Order” means the Industrial Training (Construction Board) Order (Northern Ireland) 1964(4).

Amendment

2.  Schedule 1 of the principal Order shall be amended to delete paragraph 1(a)(vi) “the provision or continued provision for any building or other construction or work above-mentioned of water, gas, lighting, heating or ventilation, being operations undertaken in, upon, above, or under the building or the close, curtilage or precincts thereof, or such construction or work, or any site above-mentioned;”.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order amends Schedule 1 of the Industrial Training (Construction Board) Order (Northern Ireland) 1964. It removes the provision or continued provision of water, gas, lighting, heating or ventilation activities from the scope of the Construction Industry Training Board in Northern Ireland. From 1 September 2010 employers engaged wholly or mainly in these activities will no longer be liable to pay levy to the Construction Industry Training Board, nor will they be able to benefit from Construction Industry Training Board grant or other support services.

Civil Engineering activities such as the design and construction of bridges, tunnels, roads, railways, dams, pipelines and major buildings remain in scope. Also, the infrastructure for transport, energy, industry and commerce remain in scope.
