The Road Traffic (Special Parking Area) (London Borough of Merton) (Amendment) Order 1995

Whereas the council of the London borough of Merton has applied to the Secretary of State for an order to be made under section 76 of the Road Traffic Act 1991(1) and the Secretary of State has consulted the Commissioner of Police of the metropolis in accordance with section 76(2) of that Act:

NOW, the Secretary of State for Transport, in exercise of the powers conferred by section 76(1) and section 77(6) of the Road Traffic Act 1991 and of all other powers enabling him in that behalf, hereby makes the following Order:—

Citation and commencement

1.  This Order may be cited as the Road Traffic (Special Parking Area) (London Borough of Merton) (Amendment) Order 1995 and shall come into force on 3rd April 1995.

Interpretation

2.  In this Order “the principal order” means the Road Traffic (Special Parking Area) (London Borough of Merton) Order 1994(2).

Amendment of the principal order

3.—(1) The principal order shall be amended as follows.

(2) In article 2—

(a)In paragraph (1) for the third unnumbered sub-paragraph there shall be substituted—

“a reference to the Schedule is a reference to the Schedule to this Order,”

(b)in paragraph (1) for the words “Schedule 2”, in the two places where those words occur, there shall be substituted “the Schedule”;

(c)in paragraph (1) for the words “that Schedule” there shall be substituted “the Schedule”; and

(d)paragraphs (2) and (3) shall be omitted.

(3) In article 3 for paragraph (1) there shall be substituted—

“(1) The Secretary of State hereby designates the London borough of Merton except the roads named or described in the Schedule as a special parking area.”

(4) For Schedule 1 there shall be substituted the Schedule set out in the Schedule to this Order.

(5) Schedule 2 shall be omitted

1.  A3 Kingston Bypass (Beverley Way and Malden Way) between the northern borough boundary with the Royal borough of Kingston Upon Thames and the southern borough boundary with the Royal borough of Kingston Upon Thames.

2.  A24 between the borough boundary with the London borough of Wandsworth and the borough boundary with the London borough of Sutton.

Explanatory Note

(This note is not part of the Regulations)
This Order amends the Road Traffic (Special Parking Area) (London Borough of Merton) Order 1994 (“the principal order”) so as to designate the whole of the London borough of Merton (excluding the roads specified in the Schedule) as a special parking area for the purposes of Part II of the Road Traffic Act 1991 with effect from 3rd April 1995. The new area subsumes the special parking area at Wimbledon designated by the principal order.
