The Secretary of State for Health, in exercise of the powers conferred on him by section 92(1) of the National Health Service Act 1977(1) and of all other powers enabling him in that behalf, having regard to the change in the arrangements for the administration of hospitals and other establishments and facilities formerly managed by the Chester Health Authority resulting from the establishment of the West Cheshire National Health Service Trust(2), having consulted the South Cheshire Health Authority(3) and that Trust in accordance with section 92(3) of that Act, hereby makes the following Order:
Citation, commencement and interpretation
1.—(1) This Order may be cited as the West Cheshire National Health Service Trust (Transfer of Trust Property) Order 1995 and shall come into force on 14th November 1995.
(2) In this Order—
“the Authority” means the South Cheshire Health Authority;
“the Trust” means the West Cheshire National Health Service Trust;
“the trust property” means the items specified in a schedule of trust property prepared by and agreed upon by the Chester Health Authority and the Trust on 9th February 1995, which schedule has been signed on behalf of that Authority and the Trust.
Transfer of trust property
2. On 14th November 1995 the trust property shall be transferred from the Authority to the Trust.

Explanatory Note
(This note is not part of the Order)
This Order transfers to the West Cheshire National Health Service Trust on 14th November 1995 trust property formerly held by the South Cheshire Health Authority. A copy of the schedule of trust property to which the Order refers can be obtained from the Department of Health, NHS Trust Unit, Room 1W29, Quarry House, Quarry Hill, Leeds LS2 7UE.
