Explanatory Note

(This note is not part of the Regulations)
These Regulations, which come into force on 8th December 1995, amend the Plant Breeders' Rights (Fees) Regulations 1990 (as amended) by introducing provision for the payment of reduced renewal fees for plant breeders' rights for plant varieties in respect of which there is a subsisting Community plant variety right granted in accordance with Council Regulation (EC) 2100/94 on Community plant variety rights (OJ No. L 227, 1.9.94, p.1). The reduced renewal fees are set at approximately 50% of the corresponding standard renewal fees for plant breeders' rights for plant varieties in respect of which there is no subsisting Community plant variety right. No change is made by these Regulations to the level of the standard renewal fees.
A Compliance Cost Assessment in relation to these Regulations has been placed in the libraries of both Houses of Parliament, and copies can be obtained from the Plant Variety Rights Office and Seeds Division of the Ministry of Agriculture, Fisheries and Food, White House Lane, Huntingdon Road, Cambridge CB3 0LF.
