The Secretary of State for the Environment, Transport and the Regions, in exercise of the powers conferred on him by section 42A(3)(c) of the Local Government Finance Act 1988(1) and of all other powers enabling him in that behalf, hereby makes the following Order:

Citation, commencement and extent

1.  This Order, which extends to England only, may be cited as the Non-Domestic Rating (Rural Settlements) (England) Order 1999, and shall come into force on 22nd December 1999.

Designation of rural areas

2.  There are designated as rural areas for the purposes of section 42A (rural settlement lists) of the Local Government Finance Act 1988 the parishes and other areas named or described in the second column of the Schedule in the counties named in the first column.

(a)
“Kirklees” means the metropolitan borough of Kirklees, and

(b)
references to grid lines are to lines on the Ordnance Survey National Grid.

So much of the unparished area of the borough of King’s Lynn and West Norfolk as lies west of the River Ouse

West Yorkshire

The area of the former urban district of Colne Valley

The areas known as Castle Hill and Hall Bower, that is to say so much of Kirklees as lies—

(i)
north of the parish of Kirkburton,

(ii)
east of grid line SE14, and

(iii)
south of grid line SE15.

The areas known as Crosland Hill and South Crosland, that is to say so much of Kirklees as lies west of grid line SE12 and south of grid line SE15

The areas known as East Bierly and Drub, that is to say so much of Kirklees as lies—

(i)
north of a line drawn from east to west at mid point between grid lines SE26 and 27,

(ii)
east of a line drawn at mid point between grid lines SE17 and 18, and

(iii)
west of the A651 trunk road.

The area known as Hartshead, that is to say so much of the unparished area of Kirklees as lies—

(i)
south both of grid line SE24 and the A649 trunk road,

(ii)
west of grid line SE20, and

(iii)
north of the A62 trunk road.

The areas known as Upper Hopton, Biestfield and Whitley, that is to say so much of Kirklees as lies—

(i)
south of the Huddersfield to Wakefield railway,

(ii)
north of the parish of Kirkburton, and

(iii)
west of grid line SE24.

Explanatory Note

(This note is not part of the Order)
Schedule 1 to the Local Government and Rating Act 1997 amends the Local Government Finance Act 1988 to make provision for mandatory relief from non-domestic rates for certain general stores and post offices, and discretionary relief for hereditaments used for purpose beneficial to the local community, in certain rural settlements in areas designated as rural areas by order of the Secretary of State. The rural settlement are to be identified by reference to lists drawn up by billing authorities.
Article 2 of this Order designates areas in England for the purposes of these provisions, in addition to those designated by S.I. 1997/2792, S.I. 1998/393 and S.I. 1998/2836.
