The Department of Economic Development, in exercise of the powers conferred on it by section 26(6) of the National Minimum Wage Act 1998(1), and of every other power enabling it in that behalf, hereby makes the following Order:

Citation and commencement

1.  This Order may be cited as the National Minimum Wage (Employment Dismissal Procedures Agreements) (Repeal) Order (Northern Ireland) 1998 and shall come into operation on 29th November 1998.

Repeal

2.  Sub-sections (5) and (6) of section 26 of the National Minimum Wage Act 1998 are hereby repealed.

Explanatory Note

(This note is not part of the Order.)
Article 142 of the Employment Rights (Northern Ireland) Order 1996 (“the 1996 Order”) makes certain provision in relation to dismissal procedure agreements, that is to say written agreements with respect to procedures relating to dismissals made by or on behalf of independent trade unions and employers or employers' associations. Section 26(5) of the National Minimum Wage Act (“the 1998 Act”) makes an amendment to this provision which is consequential upon the commencement of that Act. This amendment has now, however been superseded by amendments to Article 142 of the 1996 Order made by Article 13(1) of the Employment Rights (Dispute Resolution) (Northern Ireland) Order 1998. Accordingly, this Order repeals section 26(5) of the 1998 Act and the provision in that Act — section 26(6) — which authorised that repeal.
