The Secretary of State, in exercise of the powers conferred upon him by sections 45(4), 47 and 235(1) of the Local Government (Scotland) Act 1973(1) and sections 18 and 190(1) of the Local Government and Housing Act 1989(2) and of all other powers enabling him in that behalf, hereby makes the following Regulations:

Citation and commencement

1.  These Regulations may be cited as the Local Authorities Etc. (Allowances) (Scotland) Amendment Regulations 1998 and shall come into force on 14th January 1999.

Amendment of Regulations

2.  The Local Authorities Etc. (Allowances) (Scotland) Regulations 1995(3) shall be amended in accordance with regulations 3 to 5 below.

3.  In regulation 20–

(a)in paragraph (a), for “£23.58” there shall be substituted “£24.29”; and

(b)in each of paragraphs (b) and (c), for “£47.16” there shall be substituted “£48.57”.

4.  In regulation 21, for “£27.70” there shall be substituted “£28.53”.

5.  In column (2) of Schedule 2–

(a)for “6,344” there shall be substituted “6,534”;

(b)for “5,815” there shall be substituted “5,989”; and

(c)for “5,286” there shall be substituted “5,445”.

Revocation

6.  The Local Authorities Etc. (Allowances) (Scotland) Amendment Regulations 1997(4) are hereby revoked.

Explanatory Note

(This note is not part of the Regulations)
These Regulations amend the Local Authorities Etc. (Allowances) (Scotland) Regulations 1995, which make provision as to the payment of allowances of various sorts to members of Scottish local authorities and joint boards. The amendments all concern increases in the maximum amounts payable by way of allowances.

1973 c. 65; section 45 was repealed by the Local Government and Housing Act 1989 (c. 42), Schedule 12, Part II, but subsection (4) was saved for certain purposes by S.I. 1994/344; section 47 was amended by the Local Government, Planning and Land Act 1980 (c. 65), section 25(5), the Local Government and Housing Act 1989, Schedule 11, paragraph 34, and the Local Government etc. (Scotland) Act 1994 (c. 39), Schedule 14; section 235(1) contains a definition of “prescribed” relevant to the exercise of the statutory powers under which these Regulations are made.
