Whereas the British Waterways Board is a harbour authority within the meaning of the Pilotage Act 1987(1) (“the 1987 Act”) for the navigation area described in the Act entitled “An Act for improving the Navigation of the River Ouze, in the County of York”(2) but is not a competent harbour authority within the meaning of the 1987 Act;
And whereas the British Waterways Board has applied to be treated as a competent harbour authority for the purposes of the 1987 Act;
And whereas the Secretary of State has informed the persons he considers may be affected by the Order, in accordance with section 1(7) of the 1987 Act;
And whereas objections made to the Order under the said section 1(7) have been withdrawn:

Now, therefore, the Secretary of State for the Environment, Transport and the Regions, in exercise of the powers conferred by section 1(4) of the 1987 Act, and of all other powers enabling him in that behalf, hereby makes the following Order:

Citation and commencement

1.  This Order may be cited as the Yorkshire Ouse (Pilotage Powers) Order 1998 and shall come into force on 22nd June 1998.

Interpretation

2.  In this Order—

“the Board” means the British Waterways Board;

“the harbour” means the navigation area described in the Act entitled “An Act for improving the Navigation of the River Ouze, in the County of York”.

Application of the Pilotage Act 1987

3.—(1) The Board shall be a competent harbour authority for the purposes of the Pilotage Act 1987.

(2) References in the Pilotage Act 1987 to the harbour authority’s harbour in their application to the Board’s harbour shall be taken as references to the area within the harbour which comprises the waters of the river Ouse bounded by—

(a)an imaginary straight line drawn across the river Ouse at a distance of 91.44 metres below and parallel to the south side of the bridge known as Skelton or Hook Railway Bridge at latitude 53°42'. 7 N; and

(b)an imaginary straight line running West across the river Ouse at latitude 53°47'. 5 N at Barlby.

Explanatory Note

(This note is not part of the Order)
This Order provides that the British Waterways Board is to be a competent harbour authority for an area at the mouth of the River Ouse for the purposes of the Pilotage Act 1987 and defines the area of its harbour for these purposes.
The applicant for the Order is the British Waterways Board, Naburn Lock, Naburn, York, North Yorkshire, YO1 4RU.
