The Secretary of State for Health, in exercise of the powers conferred on him by section 126(3) of the National Health Service Act 1977(1) and section 5(1) of the National Health Service and Community Care Act 1990(2) and of all other powers enabling him in that behalf, having completed the consultation prescribed under section 5(2) of that latter Act(3) and considering it appropriate that the functions of the trust should include functions in relation to the provision of services for one or more Health Authorities(4), hereby makes the following Order:—

Citation and commencement

1.  This Order may be cited as the Dudley Priority Health National Health Service Trust (Establishment) Amendment Order 1998 and shall come into force on 9th November 1998.

Amendment of Establishment Order

2.  For article 3 of the Dudley Priority Health National Health Service Trust (Establishment) Order 1994(5) (nature and functions of the trust) there shall be substituted the following article:—

“Nature and functions of the trust

3.—(1) The trust is established for the purposes specified in section 5(1) of the Act.

(2) The trust’s functions (which include functions which the Secretary of State considers appropriate in relation to the provision of services by the trust for one or more Health Authorities) shall be—

(a)to own and manage pursuant to section 5(1)(a) of the Act Department of Psychiatry, Russells Hall Hospital, Busheyfields Road, Russells Hall, Dudley DY1 2LZ and associated hospitals, and there to provide and manage hospital accommodation and services;

(b)to own and manage pursuant to section 5(1)(a) of the Act Ridge Hill, Brierley Hill Road, Stourbridge, West Midlands DY8 5ST and associated premises, and from there to provide and manage community health services; and

(c)to provide and manage pursuant to section 5(1)(b) of the Act:—

(i)Sedgley Health & Social Care Centre, Ladies Walk, Priory Lane, Sedgley,

(ii)Wychbury Medical Centre, 121 Oakfield Road, Wollescote, Stourbridge, West Midlands DY9 9DS,

(iii)Steppingstones Medical Practice, Stafford Street, Dudley, West Midlands DY1 1RT,

(iv)Feldon Lane Clinic, Feldon Lane, Halesowen, West Midlands B62 9DR,

(v)Bayer Street site, Coseley, West Midlands WV14 9BS,

(vi)Wrens Nest Estate site, Dudley, West Midlands,

(vii)The Elms Health Centre, Slade Road, Cradley, Halesowen, West Midlands B63 2UR,

and from there to provide and manage community health services.”.

Explanatory Note

(This note is not part of the Order)
This Order amends the Order (“the Establishment Order”) which established the Dudley Priority Health National Health Service Trust.
The Establishment Order is amended to confer on the trust the purpose specified in section 5(1)(b) of the National Health Service and Community Care Act 1990 to provide and manage specified premises not previously provided or managed by Health Authorities.
