The Department of Health and Social Services, in exercise of the powers conferred on it by Articles 19(3), 19(7) and 36(2) of the Registered Homes (Northern Ireland) Order 1992(1) and of all other powers enabling it in that behalf, hereby makes the following regulations:

Citation, commencement and interpretation

1.—(1) These regulations may be cited as the Nursing Homes (Amendment) Regulations (Northern Ireland) 1998 and shall come into operation on 1st May 1998.

(2) In these regulations, “the principal regulations” means the Nursing Homes Regulations (Northern Ireland) 1993(2).

Amendment of Schedule 1 to the principal regulations

2.  In paragraph 1 of Schedule 1 (Registered Fees) to the principal regulations—

(a)in sub-paragraph (a) for “£230” there shall be substituted “£261”; and

(b)in sub-paragraph (b) for “£840” there shall be substituted “£952”.

Amendment of Schedule 3 to the principal regulations

3.  In Schedule 3 (Annual Fees) to the principal regulations—

(a)in paragraph 1 for “£41” there shall be substituted “£46”; and

(b)in paragraph 3 for “£240” there shall be substituted “£215”.

Explanatory Note

(This note is not part of the regulations.)
These regulations amend the Nursing Homes Regulations (Northern Ireland) 1993 which make provision for the registration of nursing homes under the Registered Homes (Northern Ireland) Order 1992.
These regulations increase the prescribed fees payable in respect of applications for registration. They increase the annual fees payable in respect of homes in which beds are provided for the use of patients at night. They lower the annual fees payable for homes in which no beds are provided for the use of patients at night.
