The Secretary of State for Social Security, in exercise of the powers conferred on her by sections 6(5), 181(1) and 182(2) and (3) of the Pension Schemes Act 1993(1), and of all other powers enabling her in that behalf, having consulted with such persons as she considered appropriate (2), by this instrument, hereby makes the following regulations:–

Citation, commencement and interpretation

1.—(1) These Regulations may be cited as the Register of Occupational and Personal Pension Schemes (Amendment) Regulations 1997 and shall come into force on 29th June 1997.

(2) In these Regulations “the principal Regulations” means the Register of Occupational and Personal Pension Schemes Regulations 1997(3).

Amendment of the principal Regulations

2.—(1) The principal Regulations shall be amended in accordance with the following provisions of this regulation.

(2) In regulation 4 (information required in respect of a registrable scheme) in sub-paragraph (b) of paragraph (1) for the words from “receipt of a written notice” to “these Regulations,” substitute “Registrar's, on or after the date of the coming into force of these Regulations, sending by post to the trustees a written notice requiring that information to be furnished,”.

(3) In regulation 8 (transitional provisions) in paragraph (3) for the words “by 30th June 1997.” substitute the words “within 3 months of the Registrar’s sending by post to the trustees a written notice requiring that information to be furnished.”.

Explanatory Note

(This note is not part of the Regulations)
These Regulations amend the Register of Occupational and Personal Pension Schemes Regulations 1997 (“the principal Regulations”).
Regulation 1 relates to citation, commencement and interpretation.
The effect of regulation 2(2) is that incidental information required by the Registrar under regulation 4(1)(b) of the principal Regulations is to be provided by the trustees within 3 months of the Registrar’s sending to them by post a written notice requesting the information rather than within 3 months of receipt of such notice.
Regulation 2(3) amends regulation 8(3) of the principal Regulations. Where a scheme became registrable before 1st April 1997 the trustees shall provide the Registrar with the information mentioned in regulation 8(3) of the principal Regulations within 3 months of a request for the information from the Registrar.
An assessment of the compliance cost for employers of the measures arising from the Pensions Act 1995, including these Regulations, has been placed in the libraries of both Houses of Parliament.
