The Secretary of State, in exercise of the powers conferred on him by sections 2(9) and 15(5) of the Local Government Act 1988(1), and of all other powers enabling him in that behalf, hereby makes the following Order:

Citation and commencement

1.  This Order may be cited as the Local Government Act 1988 (Defined Activities) (Exemption) (Reigate and Banstead Borough Council, Vale of White Horse District Council and Aylesbury Vale District Council) Order 1997 and shall come into force on 18th November 1997.

Exemption of catering services

2.—(1) The provision of catering for purposes of schools and welfare(2) by Reigate and Banstead Borough Council shall not be treated as a defined activity so long as it is carried out before 31st March 1998.

(2) The provision of catering other than for the purposes of schools and welfare(3) by Reigate and Banstead Borough Council shall not be treated as a defined activity so long as it is carried out at the Donyngs Recreation Centre, the Banstead Sports Centre and the Horley Anderson Centre during the period beginning with 1st January 1998 and ending with 30th June 1998.

Exemption of sports and leisure management

3.  The management of sports and leisure facilities(4) by the Vale of White Horse District Council and the Aylesbury Vale District Council shall not be treated as a defined activity so long as it is undertaken—

(a)in the case of the Vale of White Horse District Council, at the Tilsley Park Sports Complex, Abingdon before 31st December 1997,

(b)in the case of the Aylesbury Vale District Council, at the Reg Maxwell and Vale swimming pools before 30th September 1998.

Explanatory Note

(This note is not part of the Order)
Under Part I of the Local Government Act 1988 (competition), work falling within certain defined activities may be carried out by local authorities only if particular conditions are fulfilled.
This Order exempts from the requirements of Part I for limited periods the provision of certain catering services by Reigate and Banstead Borough Council and the management of certain sports and leisure facilities by the Vale of White Horse District Council and the Aylesbury Vale District Council.
