The Department of the Environment for Northern Ireland, in exercise of the powers conferred on it by section 63(3) of the Criminal Procedure and Investigations Act 1996(1) and of every other power enabling it in that behalf, hereby makes the following Order:

Citation

1.  This Order may be cited as the Criminal Procedure and Investigations (1996 Act) (Commencement) Order (Northern Ireland) 1997.

Commencement

2.  The day appointed for the coming into operation of section 63 of the Criminal Procedure and Investigations Act 1996 shall be 1st April 1997.

Explanatory Note

(This note is not part of the Order.)
This Order brings into operation on 1st April 1997 section 63 of the Criminal Procedure and Investigations Act 1996, as substituted by paragraph 26 of Schedule 4 to that Act in its application to Northern Ireland. Section 63 inserts a new sub-paragraph (bb) into Article 18(4) of the Road Traffic (Northern Ireland) Order 1995 (provision of blood or urine in course of investigating whether certain road traffic offences have been committed). The new sub-paragraph allows a constable to require the provision of a blood or urine sample at a police station when he has cause to believe that a breath test device has not produced a reliable indication of the proportion of alcohol in the breath.
