The Secretary of State for Health, in exercise of the powers conferred on him by section 92(1) of the National Health Service Act 1977(1) and of all other powers enabling him in that behalf, having regard to the change in the arrangements for the administration of hospitals and other establishments and facilities resulting from the establishment of the United Leeds Teaching Hospitals National Health Service Trust(2), having consulted the Leeds Teaching Hospitals Special Trustees and that Trust in accordance with section 92(3) of that Act, hereby makes the following Order:

Citation, commencement and interpretation

1.—(1) This Order may be cited as the Leeds Teaching Hospitals Special Trustees (Transfer of Trust Property) Order 1997 and shall come into force on 28th February 1997.

(2) In this Order—

“the Special Trustees” means the Leeds Teaching Hospitals Special Trustees;

“the Trust” means the United Leeds Teaching Hospitals National Health Service Trust;

“the trust property” means the items specified in a schedule of trust property prepared by and agreed upon by the Special Trustees and the Trust on 11th December 1995, which schedule has been signed on behalf of both the Special Trustees and the Trust.

Transfer of trust property

2.  On 28th February 1997 the trust property shall be transferred from the Trust to the Special Trustees.

Explanatory Note

(This note is not part of the Order)
This Order transfers to the Leeds Teaching Hospitals Special Trustees on 28th February 1997 trust property formerly held by the United Leeds Teaching Hospitals National Health Service Trust. A copy of the schedule of trust property to which the Order refers can be obtained at the Department of Health, Audit Liaison Unit, Quarry House, Quarry Hill, Leeds LS2 7UE.
