Explanatory Note

(This note is not part of the Regulations)
These Regulations prescribe the qualifications to be held by the person appointed to the office of chief social work officer by a local authority under Part I of the Social Work (Scotland) Act 1968.
The 1968 Act imposed an obligation on a local authority to appoint a director of social work. The Local Government etc. (Scotland) Act 1994 replaces that obligation as from 1st April 1996 with a requirement to appoint a chief social work officer.
Regulation 3 prescribes the qualifications to be held by a chief social work officer. These qualifications are similar to those which were prescribed in relation to directors of social work.
Regulation 4 revokes the previous Regulations which prescribed the qualifications of a director of social work appointed by a local authority.

(1)
1968 c. 49; section 3 was substituted by section 45 of the Local Government etc. (Scotland) Act 1994 (c. 39); section 94(1) contains a definition of “prescribed” relevant to the exercise of the statutory powers under which these Regulations are made; that definition was inserted by the Children and Young Persons Act 1969 (c. 54), Schedule 5, paragraph 64(1) and amended by the Local Government (Scotland) Act 1973 (c. 65), Schedule 27, Part II, paragraph 186.

(2)
1962 c. 33.

(3)
1983 c. 41.

(5)

(6)
These qualifications were prescribed in relation to appointment by a local authority as director of social work by the Qualifications of Directors of Social Work (Scotland) Regulations (S.I. 1978/1284), where obtained prior to the coming into force of those Regulations ie prior to 30th September 1978.
